az Európa Tanács kiváltságairól és mentességeiről szóló, Párizsban, 1949. szeptember 2-án kelt Általános Megállapodás második, negyedik, ötödik számú kiegészítő jegyzőkönyveinek, valamint az Emberi Jogok Európai Bizottsága és Bírósága eljárásaiban részt vevő személyekre vonatkozó, Londonban, 1969. május 6-án kelt Európai Megállapodásnak a kihirdetéséről *

1. § Az Országgyűlés az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás *  Párizsban, 1956. december 15-én kelt második, Párizsban, 1961. december 16-án kelt negyedik, Strasbourgban, 1990. június 18-án kelt ötödik számú kiegészítő jegyzőkönyveit, valamint az Emberi Jogok Európai Bizottsága és Bírósága eljárásaiban *  részt vevő személyekre vonatkozó, Londonban, 1969. május 6-án kelt Megállapodást e törvénnyel kihirdeti.

2. § A kiegészítő jegyzőkönyvek és a Megállapodás eredeti angol nyelvű szövege és annak hiteles magyar fordítása a következő:

„SECOND PROTOCOL TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE

Provisions in respect of the members of the European Commission of Human Rights

The governments signatory hereto, being members of the Council of Europe,

Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4th November, 1950, the members of the European Commission of Human Rigths (hereinafter referred to as „the Commission”) are entilted, during the discharge of their functions, to privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder,

Considering that it is necessary to specify and define the said privileges and immunities in a Protocol to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2nd September, 1949,

Have agreed as follows:

Article 1

The members of the Commission shall, while exercising their functions and during their journeys to and from their place of meeting, enjoy the following privileges and immunities:

a) immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process every kind;

b) inviolability for all papers and documents;

c) exemption in respect of themselves and their spouses from immigration restrictions or aliens registration in the State which they are visiting or through which they are passing in the exercise of their functions.

Article 2

1. No administrative or other restrictions shall be imposed on the free movement of members of the Commission to and from the place of meeting of the Commission.

2. Members of the Commission shall, in the matter of customs and exchange control, be accorded:

a) by their own government, the same facilities as those accorded to senior officials travelling abroad on temporary official duty;

b) by the governements of other members, the same facilities as those accorded to representatives of foreign governments on temporary official duty.

Article 3

In order to secure for the members of the Commission complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Article 4

Privileges and immunities are accorded to the members of the Commission, not for the personal benefit of the individuals themselves, but in order to safeguard the independent exercise of their functions. The Commission alone shall be competent to waive the immunity of its members; it has not only right, but is under a duty, to waive the immunity of one of its members in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 5

This Protocol shall be open to the signature of the members of the Council of Europe who may become Parties to it either by;

a) signature without reservation in respect of ratification or by;

b) signature with reservation in respect of ratification followed by ratification.

Instruments of ratification shall be deposited with the Secretary General of the Council of Europe.

Article 6

1. This Protocol shall enter into force as soon as three members of the Council of Europe shall, in accordance with Article 5, have signed it without reservation in respect of ratification or shall have ratified it.

2. As regards any member subsequently signing it without reservation in respect of ratification, or ratifying it, this Protocol shall enter into force at the date of signature or deposit of the instrument of ratification.

Article 7

The Secretary General of the Council of Europe shall notify members of the Council of the date of entry into force of this Protocol and shall give the names of any members who have signed it without reservation in respect of ratification or who have ratified it.

In witness whereof the undersigned, being duly authorised to that effect, have signed the present Protocol.

Done at Paris, this 15th day of December 1956, in English and in French, both texts being equally authoritative, in a single copy which shall remain deposited in the archives ot the Council of Europe. The Secretary General shall send certified copies to each of the signatory governements.

FOURTH PROTOCOL TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE

Provisions concerning the European Court of Human Rights

The governments signatory hereto, being members of the Council of Europe,

Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4th November 1950 (hereinafter referred to as „the Convention”), the members of the European Court of Human Rights (hereinafter referred to as „the Court”) are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder,

Considering that it is necessary to specify and define the said privileges and immunities in a Protocol to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2nd September 1949,

Have agreed as follows:

Article 1

For the purposes of this Protocol, the term „judges” means judges elected in accordance with Article 39 of the Convention as well as any ad hoc judge appointed by a State party concerned in pursuance of Article 43 of the Convention.

Article 2

The judges shall, while exercising their functions and during journeys made in the exercise of their functions, enjoy the following privileges and immunities:

a) immunity from personal arrest or detention and from seizure of their personal baggage, and, in respect of words spoken or written and all acts done by them in their official capacity, immunity from legal process of every kind;

b) exemption in respect of themselves and their spouses as regards any restrictions on their freedom of movement on exit from and return to their country of residence, and entry into and exit from the country in which they exercise their functions; and from aliens' registration in the country which they are visiting or through which they are passing in the exercise of their functions.

Article 3

In the course of journeys undertaken in the exercise of their functions, the judges shall, in the matter of customs and exchange control, be accorded:

a) by their own government the same facilities as those accorded to senior government officials travelling abroad on temporary official duty;

b) by the governments of other members, the same facilities as those accorded to heads of diplomatic missions.

Article 4

1. Documents and papers of the Court, judges and Registry, in so far as they relate to the business of the Court, shall be inviolable.

2. The official correspondence and other official communications of the Court, its members and the Registry may not be held up or subjected to censorship.

Article 5

In order to secure for the judges complete freedom of speech and complete independence in the discharge of their duties, the immunity from legal process in respect of words spoken or written and all acts done by them in discharging their duties shall continue to be accorded, notwithstanding that the persons concerned are no longer engaged in the discharge of such duties.

Article 6

Privileges and immunities are accorded to judges not for the personal benefit of the individuals themselves but in order to safeguard the independent exercise of their functions. The Court alone, sitting in plenary session, shall be competent to waive the immunity of judges; it has not only the right, but is under a duty, to waive the immunity of a judge in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 7

1. The provisions of Articles 2 to 5 this Protocol shall apply to the Registrar of the Court and to the Deputy Registrar when he is acting as the Registrar, without prejudice to any privileges and immunities to which they may be entitled under Article 18 of the General Agreement on Privileges and Immunities of the Council of Europe.

2. The provisions of Article 18 of the General Agreement on Privileges and Immunities of the Council of Europe shall apply to the Deputy Registrar of the Court in respect of his services as such when he is not acting as Registrar.

3. The privileges and immunities referred to in parapraphs 1 and 2 of this article are accorded to the Registrar and Deputy Registrar, not for the personal benefit of the individuals themselves but to facilitate the discharge of their duties. The Court alone, sitting in plenary session, shall be competent to waive the immunity of its Registrar and Deputy Registrar, it has not only the right, but is under a duty, to waive such immunity in any case where, in its opinion, the immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which the immunity is accorded.

Article 8

1. Any State may, at the time of its signature without reservation in respect of ratification, of its ratification or at any time thereafter, declare, by notification addressed to the Secretary General of the Council of Europe, that the present Protocol shall extend to all or any of the territories for whose international relations it is responsible and where, according to Article 63 ot the Convention for the Protection of Human Rights and Fundamental Freedoms, the said Convention applies.

2. The Protocol shall extend to the territory or territories named in the notification as from the thirtieth day after the receipt of this notification by the Secretary General of the Council of Europe.

Article 9

This Protocol shall be open to the signature on the members of the Council of Europe who may become parties to it either by:

a) signature without reservation in respect of ratification, or by

b) signature with reservation in respect of ratification followed by ratification.

Instruments of ratification shall be deposited with the Secretary General of the Council of Europe.

Article 10

1. This Protocol shall enter into force as soon as three members of the Council of Europe shall, in accordance with Article 9, have signed it without reservation in respect of ratification or shall have ratified it.

2. As regards any member subsequently signing it without reservation in respect of ratification, or ratifying it, this Protocol shall enter into force at the date of signature, of deposit of the instrument of ratification.

Article 11

The Secretary General of the Council of Europe shall notify members of the Council of:

a) the names of signatories and the deposit of any instrument of ratification;

FIFTH PROTOCOL TO THE GENERAL AGREEMENT ON PRIVILEGES AND IMMUNITIES OF THE COUNCIL OF EUROPE

The member States of the Council of Europe, signatories hereto,

Considering that, under the terms of Article 59 of the Convention for the Protection of Human Rights and Fundamental Freedoms (hereinafter referred to as „the Convention”), signed at Rome on 4 November 1950, the members of the European Commission of Human Rights (hereinafter referred to as „the Commission”) and of the European Court of Human Rights (hereinafter referred to as „the Court”) are entitled, during the discharge of their functions, to the privileges and immunities provided for in Article 40 of the Statute of the Council of Europe and in the Agreements made thereunder,

Recalling that the said privileges and immunities have been specified and defined in the Second and Fourth Protocols, signed at Paris on 15 December 1956 and 16 December 1961 respectively, to the General Agreement on Privileges and Immunities of the Council of Europe, signed at Paris on 2 September 1949,

Considering that it is necessary, in the light of changes in the operation of the Convention's control machinery, to supplement the above-mentioned General Agreement by another Protocol,

Have agreed as follows:

Article 1

1. Members of the Commission and members of the Court shall be exempt from taxation on salaries, emoluments and allowances paid to them by the Council of Europe.

2. The term „members of the Commission and members of the Court” includes members who, after having been replaced, continue to deal with cases which they already have under consideration as well as any ad hoc judge appointed in pursuance of the provisions of the Convention.

Article 2

1. This Protocol shall be open for signature by the member States of the Council of Europe, which may express their consent to be bound by:

a) signature without reservation as to ratification, acceptance or approval, or

b) signature subject to ratification, acceptance or approval, followed by ratification acceptance or approval.

2. No member State of the Council of Europe shall sign without reservation as to ratification, ratify, accept or approve this Protocol unless it has already ratified, or simultaneously ratifies, the General Agreement on Privileges and Immunities of the Council of Europe.

3. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

Article 3

1. This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which three member States of the Council of Europe have expressed their consent to be bound by the Protocol in accordance with the provisions of Article 2.

2. In respect of any member State which subsequently expresses its consent to be bound by it, the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of signature or of the deposit of the instrument of ratification, acceptance or approval.

Article 4

Pending the entry into force of this Protocol in accordance with paragraphs 1 and 2 of Article 3, the Signatories agree to apply the Protocol provisionally from the date of signature, so far as it is possible to do so under their respective constitutional systems.

Article 5

The Secretary General of the Council of Europe shall notify the member States of the Council of:

a) any signature;

b) the deposit of any instrument of ratification, acceptance or approval;

c) any date of entry into force of this Protocol in accordance with Article 3;

d) any other act, notification or communication relating to this Protocol.

In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.

Done at Strasbourg, this 18th day of June 1990, in English and French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall trasmit certified copies to each member State of the Council of Europe.

EUROPEAN AGREEMENT RELATING TO PERSONS PARTICIPATING IN PROCEEDINGS OF THE EUROPEAN COMMISSION AND COURT OF HUMAN RIGHTS

The member States of the Council of Europe, signatory hereto,

Having regard to the Convention for the Protection of Human Rigths and Fundamental Freedoms, signed at Rome on 4th November 1950 (hereinafter referred to as „the Convention”),

Considering that it is expedient for the better fulfilment of the purposes of the Convention that persons taking part in proceedings before the European Commission of Human Rights (hereinafter referred to as „the Commission”) or the European Court of Human Rights (hereinafter referred to as „the Court”) shall be accorded certain immunities and facilities,

Desiring to conclude an Agreement for this purpose,

Have agreed as follows:

Article 1

1. The persons to whom this Agreement applies are:

a) agents of the Contracting Parties and advisers and advocates assisting them;

b) persons taking part in proceedings instituted before the Commission under Article 25 of the Convention, whether in their own name or as representatives of one of the applicants enumerated in the said Article 25;

c) barristers, solicitors or professors of law, taking part in proceedings in order to assist one of the persons enumerated in sub-paragraph b above;

d) persons chosen by the delegates of the Commission to assist them in proceedings before the Court;

e) witnesses, experts and other persons called upon by the Commission or the Court to take part in proceeding before the Commission or the Court.

2. For the purposes of this Agreement, the terms „Commission” and „Court” shall include a Sub- Commission or Chamber, or members of either body carrying out their duties under the terms of the Convention or of the rules of the Commission or of the Court, as the case may be; and the term „taking part in proceedings” shall include making communications with a view to a complaint against a State which has recognised the right of individual petition under Article 25 of the Convention.

3. If, in the course of the exercise by the Committee of Ministers of its functions under Article 32 of the Convention, any person mentioned in paragraph 1 of this article is called upon to appear before, or to submit written statements to the Committee of Ministers, the provisions of this Agreement shall apply in relation to him.

Article 2

1. The persons referred to in paragraph 1 of Article 1 of this Agreement shall have immunity from legal process in respect of oral or written statements made, or documents or other evidence submitted by them before or to the Commission or the Court.

2. This immunity does not apply to the communication, outside the Commission or the Court, by or on behalf of any person entitled to immunity under the preceding paragraph, of any such statements, documents or evidence or any part thereof submitted by that person to the Commission or the Court.

Article 3

1. The Contracting Parties shall respect the right of the persons referred to in paragraph 1 of Article 1 of this Agreement to correspond freely with the Commission and the Court.

2. As regards persons under detention, the exercise of this right shall in particular imply that:

a) if their correspondence is examined by the competent authorities, its despatch and delivery shall nervertheless take place without undue delay and without alteration;

b) such persons shall not be subject to disciplinary measures in any form on account of any communication sent through the proper channels to the Commission or the Court;

c) such persons shall have the right to correspond, and consult out of hearing of other persons, with a lawyer qualified to appear before the courts of the country where they are detained in regard to an application to the Commission, or any proceedings resulting therefrom.

3. In application of the preceding paragraphs, there shall be no interference by a public authority except such as is in accordance with the law and is necessary in a democratic society in the interests of national security, for the detection or prosecution of a criminal offence or for the protection of health.

Article 4

1. a) The Contracting Parties undertake not to hinder the free movement and travel, for the purpose of attending and returning from proceedings before the Commission or the Court, of persons referred to in paragraph 1 of Article 1 of this Agreement whose presence has in advance been authorised by the Commission or the Court.

b) No restrictions shall be placed on their movement and travel other than such as are in accordance with the law and necessary in a democratic society in the interests of national security or public safety, for the maintenance of ordre public, for the prevention of crime, for the protection of health or morals, or for the protection of the rights and freedoms of others.

2. a) Such persons shall not, in countries of transit and in the country where the proceedings take place, be prosecuted or detained or be subjected to any other restriction of their personal liberty in respect of acts or convictions prior to the commencement of the journey.

b) Any Contracting Party may at the time of signature or ratification of this Agreement declare that the provisions of this paragraph will not apply to its own nationals. Such a declaration may be withdrawn at any time by means of a notification addressed to the Secretary General of the Council of Europe.

3. The Contracting Parties undertake to re-admit on his return to their territory any such person who commenced his journey in the said territory.

4. The provisions of paragraph 1 and 2 this article shall cease to apply when the person concerned has had for a period of 15 consecutive days from the date when his presence is no longer required by the Commission or the Court the opportunity of returning to the country from which his journey commenced.

5. Where there is any conflict between the obligations of a Contracting Party resulting from paragraph 2 of this article and those resulting from a Council of Europe Convention or from an extradition treaty or other treaty concerning mutual assistance in criminal matters with other Contracting Parties, the provisions of paragraph 2 of this article shall prevail.

Article 5

1. Immunities and facilities are accorded to the persons referred to in paragraph 1 of Article 1 of this Agreement solely in order to ensure for them the freedom of speech and the independence necessary for the discharge of their functions, tasks or duties, or the exercise of their rigths in relation to the Commission and the Court.

2. a) The Commision or the Court, as the case may be, shall alone be competent to waive, in whole or in part, the immunity provided for in paragraph 1 of Article 2 of this Agreement; they have not only the right but the duty to waive immunity in any case where, in their opinion, such immunity would impede the course of justice and waiver in whole or in part would not prejudice the purpose defined in paragraph 1 of this article.

b) The immunity may be waived by the Commission or by the Court, either ex officio or at the request, addressed to the Secretary General of the Council of Europe, of any Contracting Party or of any person concerned.

c) Decisions waiving immunity or refusing the waiver shall be accompanied by a statement of reasons.

3. If a Contracting Party certifies that waiver of the immunity provided for in paragraph 1 of Article 2 of this Agreement is necessary for the purpose of proceedings in respect of an offence against national security, the Commission or the Court shall waive immunity to the extent specified in the certificate.

4. In the event of the discovery of a fact which might, by its nature, have a decisive influence and which at the time of the decision refusing waiver of immunity was unknown to the author of the request, the latter may make a new request to the Commission or the Court.

Article 6

Nothing in this Agreement shall be construed as limiting or derogating from any of the obligations assumed by the Contracting Parties under the Convention.

Article 7

1. This Agreement shall be open to signature by the member States of the Council of Europe, who may become Parties to it either by:

a) signature without reservation in respect of ratification or acceptance, or

b) signature with reservation in respect of ratification or acceptance, followed by ratification or acceptance.

2. Instruments of ratification or acceptance shall be deposited with the Secretary General of the Council of Europe.

Article 8

1. This Agreement shall enter into force one month after the date on which five member States of the Council shall have become Parties to the Agreement, in accordance with the provisions of Article 7.

2. As regards any member States who shall subsequently sign the Agreement without reservation in respect of ratification or acceptance or who shall ratify or accept it, the Agreement shall enter into force one month after the date of such signature or after the date of deposit of the instrument of ratification or acceptance.

Article 9

1. Any Contracting Party may, at the time of signature or when depositing its instrument of ratification or acceptance, specify the territory or territories to which this Agreement shall apply.

2. Any contracting Party may, when depositing its instrument of ratification or acceptance or at any later date, by declaration addressed to the Secretary General of the Council of Europe, extend this Agreement to any other territory or territories specified in the declaration and for whose international relations it is responsible or on whose behalf it is authorised to give undertakings.

3. Any declaration made in pursuance of the preceding paragraph may, in respect of any territory mentioned in such declaration, be withdrawn according to the procedure laid down in Article 10 of this Agreement.

Article 10

1. This Agreement shall remain in force indefinitely.

2. Any Contracting Party may, insofar as it is concerned, denounce this Agreement by means of a notification addressed to the Secretary General of the Council of Europe.

3. Such denunciation shall take effect six months after the date of receipt by the Secretary General of such notification. Such a denunciation shall not have the effect or releasing the Contracting Parties concerned from any obligation which may have arisen under this Agreement in relation to any person referred to in paragraph 1 of Article 1.

Article 11

The Secretary General of the Council of Europe shall notify the member States of the Council of:

a) any signature without reservation in respect of ratification or acceptance;

b) any signature with reservation in respect of ratification or acceptance;

c) the deposit of any instrument of ratification or acceptance;

d) any date or entry into force of this Agreement in accordance with Article 8 thereof;

e) any declaration received in pursuance of the provisions of paragraph 2 of Article 4 and of paragraphs 2 and 3 of Article 9;

f) any notification of withdrawal of a declaration in pursuance of the provisions of paragraph 2 of Article 4 and any notification received in pursuance of the provisions of Article 10 and the date on which any denunciation takes effect.

In witness whereof the undersigned, being duly authorised thereto, have signed this Agreement.

Done at London, this 6th day of May 1969, in the English and French languages, both texts being equally authoritative, in a single copy which shall remain deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each of the signatory States.

MÁSODIK KIEGÉSZÍTŐ JEGYZŐKÖNYV AZ EURÓPA TANÁCS KIVÁLTSÁGAIRÓL ÉS MENTESSÉGEIRŐL SZÓLÓ ÁLTALÁNOS MEGÁLLAPODÁSHOZ

Az Emberi Jogok Európai Bizottsága tagjaira vonatkozó rendelkezések

Az aláíró Kormányok, az Európa Tanács tagjai

figyelemmel arra, hogy az emberi jogok és az alapvető szabadságok védelméről szóló, Rómában, 1950. november 4-én aláírt Egyezmény 59. Cikke szerint az Emberi Jogok Európai Bizottságának (a továbbiakban: „a Bizottság”) tagjait feladataik ellátása során az Európa Tanács Alapszabályának 40. Cikkében, és az annak alapján kötött megállapodásokban meghatározott kiváltságok és mentességek illetik meg,

figyelemmel arra, hogy szükségessé vált az említett kiváltságok és mentességek pontos meghatározása egy, a Párizsban, 1949. szeptember 2-án aláírt, az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodást kiegészítő jegyzőkönyvben,

az alábbiakban állapodtak meg:

1. Cikk

A Bizottság tagjai feladataik ellátása, valamint az ülés helyére történő oda- és visszautazásuk során a következő kiváltságokban és mentességekben részesülnek:

a) mentesség az őrizetbe vétel és a letartóztatás, valamint személyes poggyászuk lefoglalása alól, továbbá a hivatalos minőségükben tett szóbeli és írásbeli nyilatkozatuk, és minden hivatalos cselekményük tekintetében mindenfajta joghatóság alól;

b) sérthetetlenség minden irat és okmány részére;

c) kivétel saját személyük és házastársuk tekintetében a bevándorlási korlátozások és az idegenekre vonatkozó bejelentési kötelezettség alól abban az államban, amelyet feladataik ellátása során meglátogatnak, vagy amelyen átutaznak.

2. Cikk

1. A Bizottság ülésének helyére történő oda- és visszautazásuk során a Bizottság tagjainak szabad mozgása semmiféle adminisztratív vagy egyéb korlátozás alá nem vonható.

2. A Bizottság tagjai a vám- és devizaellenőrzés terén:

a) saját Kormányuk részéről ugyanolyan könnyítésekben részesülnek, mint az ideiglenesen hivatalos útra külföldre utazó magas rangú tisztviselők;

b) a többi Tagállam Kormánya részéről ugyanolyan könnyítésekben részesülnek, mint amelyekben ideiglenes hivatalos feladataik ellátása során a külföldi Kormányok képviselői részesülnek.

3. Cikk

Azért, hogy feladataik ellátása során a Bizottság tagjai számára biztosítva legyen a teljes szólásszabadság és a teljes függetlenség, az általuk feladataik ellátása körében tett szóbeli és írásbeli nyilatkozatokra, illetve cselekedeteikre vonatkozó joghatóság alóli mentesség a Bizottság tagjai megbízatásának megszűnte után is fennmarad.

4. Cikk

A Bizottság tagjai nem azért részesülnek kiváltságokban és mentességekben, hogy azok személyes előnyükre szolgáljanak, hanem azért, hogy biztosítva legyen feladataik független gyakorlása. Kizárólag a Bizottság jogosult a tagjai mentességét megszüntetni; a Bizottságnak nemcsak joga, hanem kötelessége is, hogy megszüntesse valamely tagja mentességét minden olyan esetben, amikor megítélése szerint a mentesség fenntartása akadályozná az igazságszolgáltatást, és amikor a megszüntetés megtehető anélkül, hogy sértené azt a célt, amelyért a mentességet adták.

5. Cikk

Ez a jegyzőkönyv az Európa Tanács tagjai részére áll nyitva aláírásra, melyek a jegyzőkönyv részesévé válhatnak:

a) megerősítés fenntartása nélkül aláírással, vagy

b) megerősítés fenntartásával történt aláírással, melyet megerősítés követ.

A megerősítésről szóló okiratokat az Európa Tanács Főtitkáránál kell letétbe helyezni.

6. Cikk

1. Ez a jegyzőkönyv akkor lép hatályba, amikor az Európa Tanács három tagja az 5. Cikknek megfelelően a megerősítés fenntartása nélkül aláírja, vagy megerősíti azt.

2. Mindazon tagok vonatkozásában, amelyek ezt követően a megerősítés fenntartása nélkül írják alá vagy erősítik meg, a jegyzőkönyv az aláírás vagy a megerősítésről szóló okirat letétbe helyezésének időpontjában lép hatályba.

7. Cikk

Az Európa Tanács Főtitkára értesíti a Tanács tagjait ezen jegyzőkönyv hatálybalépésének időpontjáról, és megadja valamennyi tag nevét, amely a megerősítés fenntartása nélkül aláírta, vagy megerősítette azt.

Az Emberi Jogok Európai Bíróságára vonatkozó rendelkezések

Az aláíró Kormányok, az Európa Tanács tagjai

figyelemmel arra, hogy az emberi jogok és az alapvető szabadságok védelméről szóló, Rómában, 1950. november 4-én aláírt Egyezmény (a továbbiakban: „az Egyezmény”) 59. Cikke alapján az Emberi Jogok Európai Bíróságának (a továbbiakban: „a Bíróság”) tagjait feladataik ellátása során az Európa Tanács Alapszabályának 40. Cikkében, és az annak alapján kötött Megállapodásokban meghatározott kiváltságok és mentességek illetik meg,

figyelemmel arra, hogy szükségessé vált az említett kiváltságok és mentességek pontos meghatározása egy, a Párizsban, 1949. szeptember 2-án aláírt, az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodást kiegészítő jegyzőkönyvben,

az alábbiakban állapodtak meg:

1. Cikk

Ezen Jegyzőkönyv alkalmazásában a „bírák” kifejezés egyaránt jelenti az Egyezmény 39. Cikke szerint megválasztott bírákat és bármely, az érintett Tagállam által az egyezmény 43. Cikkének figyelembevételével kinevezett ad hoc bírót.

2. Cikk

Feladataik ellátása és feladataik ellátása céljából végzett utazásaik során a bírák az alábbi kiváltságokban és mentességekben részesülnek:

a) mentesség az őrizetbe vétel és a letartóztatás, valamint személyes poggyászuk lefoglalása alól, továbbá a hivatalos minőségükben tett szóbeli és írásbeli nyilatkozatuk és minden cselekményük tekintetében mindenfajta joghatóság alól;

b) kivétel saját személyük és házastársuk tekintetében a mozgásszabadság bármely korlátozása alól a lakóhelyük szerinti országokból való kilépést és az oda történő visszatérést, valamint az azon országba történő be- és kilépést illetően, amelyben feladataikat ellátják; továbbá kivétel az idegenekre vonatkozó bejelentési kötelezettség alól abban az államban, amelyet feladataik ellátása során meglátogatnak, vagy amelyen átutaznak.

3. Cikk

Feladataik ellátása során végzett utazásaik alkalmával a bírák a vám- és devizaellenőrzés során:

a) saját Kormányuk részéről ugyanolyan könnyítésekben részesülnek, mint az ideiglenes külföldi hivatalos útra utazó magas rangú kormánytisztviselők;

b) a többi Tagállam Kormánya részéről ugyanolyan könnyítésekben részesülnek, mint a diplomáciai missziók vezetői.

4. Cikk

1. A Bíróságnak, a bíráknak és a jegyzői hivatalnak a Bíróság tevékenységével kapcsolatos okmányai és iratai sérthetetlenek.

2. A Bíróság, a bírák és a jegyzői hivatal hivatalos levelezése és más hivatalos közlései nem tarthatók vissza, és cenzúra alá nem vonhatók.

5. Cikk

Azért, hogy feladataik ellátása során a bírák számára biztosítva legyen a teljes szólásszabadság és a teljes függetlenség, az általuk feladataik ellátása körében tett szóbeli és írásbeli nyilatkozatokra, illetve cselekedeteikre vonatkozó joghatóság alóli mentesség a bírák megbízatásának megszűnte után is fennmarad.

7. Cikk

1. Ezen jegyzőkönyv 2-5. Cikkeinek rendelkezéseit kell alkalmazni a Bíróság Főjegyzője és főjegyzőként eljáró Helyettes Főjegyzője tekintetében is, azon kiváltságok és mentességek sérelme nélkül, amelyekre az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás 18. Cikke őket feljogosítja.

2. Az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás 18. Cikke rendelkezéseit kell alkalmazni a Bíróság Helyettes Főjegyzője tekintetében is, amikor feladatai ellátása során nem Főjegyzőként jár el.

3. A Főjegyző és a Helyettes Főjegyző nem azért részesülnek az ezen Cikk 1. és 2. bekezdésében említett kiváltságokban és mentességekben, hogy azok személyes előnyükre szolgáljanak, hanem azért, hogy biztosítva legyen feladataik független gyakorlása. Kizárólag a Bíróság teljes ülése jogosult a Főjegyző és a Helyettes Főjegyző mentességét megszüntetni; a Bíróság teljes ülésének nemcsak joga, hanem kötelessége is, hogy megszüntesse az ilyen mentességet minden olyan esetben, amikor megítélése szerint a mentesség fenntartása akadályozná az igazságszolgáltatást, és amikor a megszüntetés megtehető anélkül, hogy sértené azt a célt, amelyért a mentességet adták.

8. Cikk

1. A megerősítés fenntartása nélküli aláíráskor, a megerősítéskor vagy azt követően bármikor, az Európa Tanács Főtitkárához intézett értesítéssel bármely állam kijelentheti, hogy ez a jegyzőkönyv minden olyan területre, vagy e területek egy részére terjed ki, amelyek nemzetközi kapcsolataiért felelősséget visel, és amelyeken az emberi jogok és az alapvető szabadságok védelméről szóló Egyezmény 63. Cikke értelmében az Egyezmény alkalmazásra kerül.

2. Ez a jegyzőkönyv az értesítésben megjelölt területre vagy területekre ezen értesítésnek az Európa Tanács Főtitkára általi kézhezvételét követő harmincadik naptól kezdve terjed ki.

9. Cikk

Ez a jegyzőkönyv az Európa Tanács tagjai részére áll nyitva aláírásra, melyek a jegyzőkönyv részesévé válhatnak:

a) megerősítés fenntartás nélküli aláírással, vagy

b) megerősítés fenntartásával történt aláírással, melyet megerősítés követ.

A megerősítésről szóló okiratokat az Európa Tanács Főtitkáránál kell letétbe helyezni.

10. Cikk

figyelembe véve, hogy az Egyezmény ellenőrző rendszerének működésében bekövetkezett változásokra tekintettel szükségessé vált a fent említett Általános Megállapodás kiegészítése egy további jegyzőkönyvvel,

az alábbiakban állapodtak meg:

1. Cikk

1. A Bizottság és a Bíróság tagjai mentességben részesülnek az Európa Tanács részéről nekik nyújtott fizetések, javadalmazások és juttatások adózása alól.

2. „A Bizottság és a Bíróság tagjai” kifejezés magában foglalja azokat a tagokat, akik, miután helyükbe más lépett, tovább foglalkoznak olyan ügyekkel, melyek vizsgálatát már megkezdték, valamint az Egyezmény rendelkezéseinek megfelelően kinevezett bármely ad hoc bírót.

2. Cikk

1. Ez a jegyzőkönyv az Európa Tanács tagállamai részére áll nyitva aláírásra, melyek kifejezhetik egyetértésüket, hogy az rájuk nézve kötelező

a) megerősítés, elfogadás vagy jóváhagyás fenntartása nélküli aláírással;

b) megerősítés, elfogadás vagy jóváhagyás fenntartásával történt aláírással, amelyet megerősítés, elfogadás vagy jóváhagyás követ.

2. Ezt a jegyzőkönyvet az Európa Tanács egyetlen Tagállama sem írhatja alá a megerősítés fenntartása nélkül, és nem erősítheti meg, fogadhatja el, vagy hagyhatja jóvá akkor, hogyha még nem erősítette meg, vagy egyidejűleg nem erősíti meg az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodást.

3. A megerősítésről, elfogadásról vagy jóváhagyásról szóló okiratokat az Európa Tanács Főtitkáránál kell letétbe helyezni.

3. Cikk

1. Ez a Jegyzőkönyv az azon időpontot követő három hónapos időszak lejárta utáni hónap első napján lép hatályba, amikor az Európa Tanács három Tagállama egyetértését fejezi ki azzal, hogy ez a jegyzőkönyv a 2. Cikk rendelkezéseinek megfelelően kötelező legyen számára.

2. Mindazon Tagállamok vonatkozásában, amelyek ezt követően fejezik ki egyetértésüket azzal, hogy ez a jegyzőkönyv kötelező legyen számukra, a jegyzőkönyv az aláírás, vagy a megerősítésről, elfogadásról vagy jóváhagyásról szóló okirat letétbe helyezésének időpontját követő három hónapos időszak lejárta utáni hónap első napján lép hatályba.

4. Cikk

Az aláírók egyetértésüket fejezik ki azzal, hogy ezen jegyzőkönyvnek a 3. Cikk 1. és 2. bekezdései szerint történő hatálybalépését megelőzően e jegyzőkönyv az aláírás időpontjától kezdve ideiglenes alkalmazást nyerjen, amennyiben ez saját alkotmányos rendjük szerint lehetséges.

5. Cikk

Az Európa Tanács Főtitkára értesíti a Tanács Tagállamait

a) minden aláírásról;

b) minden megerősítő, elfogadó vagy jóváhagyó okirat letétbe helyezéséről;

c) e jegyzőkönyvnek a 3. Cikk szerint történt hatálybalépésének időpontjáról;

d) az e jegyzőkönyvre vonatkozó minden jogcselekményről, értesítésről vagy közlésről.

Minek hiteléül a kellőképpen meghatalmazott alulírottak aláírták ezt a jegyzőkönyvet.

AZ EMBERI JOGOK EURÓPAI BIZOTTSÁGA ÉS BÍRÓSÁGA ELJÁRÁSAIBAN RÉSZT VEVŐ SZEMÉLYEKRE VONATKOZÓ EURÓPAI MEGÁLLAPODÁS

Az Európai Tanács ezen Megállapodást aláíró Tagállamai

tekintettel az emberi jogok és az alapvető szabadságok védelméről szóló, Rómában, 1950. november 4-én kelt Egyezményre (a továbbiakban: „az Egyezmény”),

figyelemmel arra, hogy az Egyezmény céljainak jobb megvalósítása érdekében szükségessé vált az Emberi Jogok Európai Bizottsága (a továbbiakban: „a Bizottság”), illetve az Emberi Jogok Európai Bírósága (a továbbiakban: „a Bíróság”) előtti eljárásokban részt vevő személyek számára bizonyos mentességek és könnyítések biztosítása,

attól a kívánságtól vezérelve, hogy erre a célra Megállapodást kössenek,

az alábbiakban állapodtak meg:

1. Cikk

1. A személyek, akikre ezen Megállapodás vonatkozik:

a) a Szerződő Felek képviselői, valamint az őket segítő tanácsadók és ügyvédek;

b) azok a személyek, akik a Bizottság előtt az Egyezmény 25. Cikke alapján indított eljárásokban vesznek részt saját nevükben, vagy az említett 25. Cikkben felsorolt kérelmezők egyikének képviselőiként;

c) azon ügyvédek vagy jogtudósok, akik azért vesznek részt az eljárásokban, hogy segítséget nyújtsanak a fenti b) pontban felsorolt személyek bármelyike számára;

d) azon személyek, akiket a Bizottság képviselői azért választottak ki, hogy azok a bíróság előtti eljárásokban számukra segítséget nyújtsanak;

e) a tanúk, a szakértők és más személyek, akiket a Bizottság vagy a Bíróság kért fel a Bizottság vagy a Bíróság előtti eljárásokban való részvételre.

2. Ezen Megállapodás alkalmazásában a „Bizottság” és „Bíróság” kifejezések magukban foglalják az Albizottságokat és a Kamarákat, illetve a fenti testületek tagjait, amennyiben azok az Egyezmény értelmében, vagy a Bizottság, illetve a Bíróság szabályzata szerint látják el feladataikat, az ügytől függően; az „eljárásban való részvétel” kifejezés magában foglalja az Egyezmény 25. Cikke szerinti egyéni panaszjogot elismerő állam ellen benyújtott panasszal kapcsolatban tett mindenfajta kommunikációt.

3. Amennyiben a Miniszteri Bizottságnak az Egyezmény 32. Cikke szerinti feladatai gyakorlása során bármely, a fenti 1. bekezdésben említett személyt a Miniszteri Bizottság előtti megjelenésre, vagy ahhoz intézendő írásos nyilatkozat beterjesztésére hívnak fel, vele kapcsolatban ezen Megállapodás rendelkezéseit kell alkalmazni.

2. Cikk

1. Az ezen Megállapodás 1. Cikkének 1. bekezdésében említett személyek joghatóság alóli mentességben részesülnek a Bizottság vagy a Bíróság előtt általuk tett szóbeli vagy írásbeli nyilatkozatok, illetve az azokhoz általuk benyújtott okiratok vagy más bizonyítékok tekintetében.

2. Ez a mentesség nem vonatkozik az előző bekezdés szerint mentességre jogosult bármely személy által, vagy annak nevében a Bizottság vagy a Bíróság elé terjesztett nyilatkozatokkal, okiratokkal vagy bizonyítékokkal, illetve azok bármely részével kapcsolatos, a Bizottságon vagy a Bíróságon kívüli kommunikációra.

3. Cikk

1. A Szerződő Felek tiszteletben tartják az ezen Megállapodás 1. Cikkének 1. bekezdésében említett személyek jogát arra, hogy a Bizottsággal és a Bírósággal szabadon levelezzenek.

2. A fogva tartott személyek tekintetében e jog gyakorlása különösen magában foglalja, hogy

a) amennyiben levelezésüket az illetékes hatóságok ellenőrzik, annak elküldése és továbbítása indokolatlan késedelem és változtatás nélkül történjék;

b) az ilyen személyek semmilyen formában nem vonhatók fegyelmi intézkedés alá a Bizottsággal vagy a Bírósággal a megfelelő csatornákon keresztül folytatott kommunikáció miatt;

c) ezen személyeknek joguk van arra, hogy a fogva tartás helye szerinti ország bíróságai előtt megjelenésre jogosult jogásszal a Bizottsághoz intézendő kérelem, vagy az abból eredő bármilyen eljárás vonatkozásában levelezzenek, és olyan körülmények között konzultáljanak, hogy azt más személy ne hallhassa.

3. Az előző bekezdések alkalmazásába hatóság nem avatkozhat be, kivéve a törvényben meghatározott olyan esetekben, amikor az egy demokratikus társadalomban a nemzetbiztonság, a bűncselekmény felderítése, a bűnüldözés, a büntetőeljárás vagy a közegészség védelme érdekében szükséges.

4. Cikk

1. a) A Szerződő Felek kötelezik magukat arra, hogy az ezen Megállapodás 1. Cikkének 1. bekezdésében meghatározott személyek Bizottság vagy Bíróság előtti megjelenés, illetve onnan történő visszatérés célját szolgáló szabad mozgását és utazását nem akadályozzák, amennyiben e személyeket a megjelenésre a Bizottság vagy a Bíróság előzetesen feljogosította.

b) Mozgásukat és utazásukat csak a törvényben meghatározott olyan korlátozásoknak lehet alávetni, amelyek egy demokratikus társadalomban a nemzetbiztonság vagy a közbiztonság érdekében, a közrend fenntartása, a bűncselekmény megelőzése, a közegészség vagy az erkölcsök védelme, avagy mások jogainak és szabadságainak védelme érdekében szükségesek.

2. a) A tranzitországokban és az eljárást lefolytató országokban ezen személyek ellen nem lehet büntetőeljárást folytatni, őket fogva tartani, vagy személyes szabadságukat bármilyen más módon korlátozni olyan cselekmények vagy elítélések miatt, amelyek az utazás megkezdését megelőzően történtek.

b) Ezen Megállapodás aláírásának vagy megerősítésének időpontjában bármely Szerződő Fél kinyilváníthatja, hogy ezen bekezdés rendelkezéseit nem alkalmazza saját állampolgáraival szemben. Az ilyen nyilatkozat bármely időpontban visszavonható az Európa Tanács Főtitkárához intézett értesítéssel.

3. A Szerződő Felek kötelezik magukat arra, hogy visszaérkezésekor minden olyan személyt bebocsátanak saját területükre, aki utazását azon területről kezdte meg.

4. Ezen Cikk 1. és 2. bekezdése rendelkezéseinek az alkalmazása megszűnik akkor, hogyha az érintett személynek attól a naptól fogva, amikor jelenlétére a Bizottság vagy a Bíróság már nem tartott igényt, folytatólagosan 15 napon keresztül lehetősége volt, arra, hogy visszatérjen abba az országba, amelyikből utazását megkezdte.

5. Amennyiben bármilyen ellentét merül fel egy Szerződő Félnek ezen Cikk 2. bekezdéséből származó kötelezettségei és az Európa Tanács valamely Egyezménye vagy más Szerződő Felekkel fennálló kiadatási vagy más kölcsönös bűnügyi jogsegély-szerződéses kötelezettségei között, ezen Cikk 2. bekezdésének rendelkezései érvényesülnek.

5. Cikk

1. Az ezen Megállapodás 1. Cikkének 1. bekezdésében említett személyek kizárólag azért részesülnek mentességekben és kedvezményekben, hogy biztosítva legyen számukra a Bizottsággal és a Bírósággal kapcsolatos funkcióik, feladataik, vagy kötelezettségeik, vagy jogaik gyakorlásához szükséges szólásszabadság és függetlenség.

2. a) Az ügytől függően, kizárólag a Bizottság vagy a Bíróság jogosult arra, hogy részben vagy teljesen megszüntesse az ezen Megállapodás 2. Cikkének 1. bekezdésében biztosított mentességet; a Bizottságnak vagy a Bíróságnak nemcsak joga, hanem kötelessége is, hogy megszüntesse a mentességet minden olyan esetben, amikor megítélése szerint a mentesség fenntartása akadályozná az igazságszolgáltatást, és amikor a részben vagy teljesen történő lemondás megtehető anélkül, hogy sértené az ezen Cikk 1. bekezdésében meghatározott célt.

b) A mentességet a Bizottság vagy a Bíróság megszüntetheti hivatalból vagy bármely Szerződő Félnek, illetve bármely érintett személynek az Európa Tanács Főtitkárához intézett kérelmére.

c) A mentességet megszüntető vagy a megszüntetést elutasító határozatoknak indokolást kell tartalmazniuk.

3. Amennyiben egy Szerződő Fél igazolja, hogy az ezen Megállapodás 2. Cikkének 1. bekezdése szerinti mentesség megszüntetése nemzetbiztonság elleni bűncselekmény miatt indított eljárás érdekében szükséges, akkor a Bizottság vagy a Bíróság az igazolásban meghatározott mértékben megszünteti a mentességet.

4. Amennyiben olyan tény kerül feltárásra, amely jellegénél fogva döntő fontosságú, és a mentesség megszüntetését elutasító határozat időpontjában ismeretlen volt a kérelem előterjesztője számára, akkor az utóbbi új kérelmet terjeszthet a Bizottság vagy a Bíróság elé.

6. Cikk

Ezen Megállapodás egyetlen rendelkezését sem lehet úgy értelmezni, hogy az korlátozná vagy szűkítené azokat a kötelezettségeket, amelyeket a Szerződő Felek az Egyezményben vállaltak.

7. Cikk

1. Ezen Megállapodás az Európa Tanács Tagállamai részére áll nyitva aláírásra, amelyek a Megállapodás részesévé válhatnak:

a) megerősítés vagy elfogadás fenntartása nélküli aláírással, vagy

b) megerősítés vagy elfogadás fenntartásával történt aláírással, melyet megerősítés vagy elfogadás követ.

2. A megerősítésről vagy elfogadásról szóló okiratokat az Európa Tanács Főtitkáránál kell letétbe helyezni.

8. Cikk

1. Ez a Megállapodás az azon időpontot követő egy hónapos időszak lejárta után lép hatályba, amikor az Európa Tanács öt Tagállama a 7. Cikk rendelkezéseinek megfelelően ezen Megállapodás részesévé válik.

2. Mindazon Tagállamok vonatkozásában, amelyek ezt követően a megerősítés vagy elfogadás fenntartása nélkül írják alá a Megállapodást, vagy amelyek megerősítik vagy elfogadják azt, ezen Megállapodás az aláírás, illetve a megerősítésről vagy elfogadásról szóló okirat letétbe helyezésének időpontját követő egy hónapos időszak lejárta után lép hatályba.

9. Cikk

1. Az aláíráskor vagy a megerősítésről, illetve elfogadásról szóló okirat letétbe helyezésének időpontjában bármely Szerződő Fél meghatározhatja azt a területet, illetve azokat a területeket, amelyeken ezen Megállapodás alkalmazást nyer.

2. A megerősítésről vagy elfogadásról szóló okirat letétbe helyezésének időpontjában, vagy bármely későbbi időpontban, az Európa Tanács Főtitkárához intézett nyilatkozatában bármelyik Szerződő Fél kiterjesztheti ezen Megállapodás alkalmazását a nyilatkozatban meghatározott bármely olyan területre vagy területekre, amelynek vagy amelyeknek nemzetközi kapcsolataiért felelősséget visel, illetve amely vagy amelyek nevében eljárni jogosult.

3. Az előző bekezdés alapján tett minden nyilatkozat, a nyilatkozatban meghatározott bármely terület vonatkozásában visszavonható az ezen Megállapodás 10. Cikkében meghatározott eljárás szerint.

10. Cikk

1. Ez a Megállapodás meghatározatlan ideig marad hatályban.

2. Az Európa Tanács Főtitkárához intézett értesítéssel az őt érintő részben bármelyik Szerződő Fél felmondhatja ezen Megállapodást.

3. A felmondás az értesítésnek a Főtitkár általi kézhezvétele időpontjától számított hat hónapos időszak eltelte után lép hatályba. Az ilyen felmondás nem mentesíti az érintett Szerződő Feleket az ezen Megállapodásból származó olyan kötelezettség alól, amely az 1. Cikk 1. bekezdésében említett személyek vonatkozásában merülhet fel.

11. Cikk

Az Európa Tanács Főtitkára értesíti a Tanács Tagállamait

a) minden megerősítés vagy elfogadás fenntartása nélküli aláírásról;

b) minden megerősítés vagy elfogadás fenntartásával tett aláírásról;

c) minden megerősítő vagy elfogadó okirat letétbe helyezéséről;

d) ezen Megállapodás 8. Cikke szerint történt hatálybalépése időpontjairól;

e) minden, a 4. Cikk 2. bekezdése, illetve a 9. Cikk 2. és 3. bekezdéseinek rendelkezései szerint kézhez vett nyilatkozatról;

f) minden, a 4. Cikk 2. bekezdésének rendelkezésein alapuló nyilatkozatot visszavonó értesítésről és minden, a 10. Cikk rendelkezésének megfelelően kézhez vett értesítésről, továbbá minden olyan időpontról, amikor valamely felmondás hatályba lép.

Minek hiteléül a kellőképpen meghatalmazott alulírottak aláírták ezen Megállapodást.

Készült Londonban, 1969. május 6. napján, angol és francia nyelven, egyetlen példányban, melyet az Európa Tanács levéltárában kell elhelyezni. Mindkét nyelvű szöveg egyaránt hiteles. Az Európa Tanács Főtitkára az Európa Tanács valamennyi aláíró állam részére hiteles másolatot küld.”

3. § Ez a törvény a kihirdetését követő 8. napon lép hatályba. Az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás Párizsban, 1956. december 15-én kelt második, és a Párizsban, 1961. december 16-án kelt negyedik számú kiegészítő jegyzőkönyvekben foglaltakat 1996. január 20-tól kezdődően, a Strasbourgban, 1990. június 18-án kelt, az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás ötödik számú kiegészítő jegyzőkönyvében foglaltakat 1996. május 1-jétől kezdődően, a Londonban, 1969. május 6-án kelt, az Emberi Jogok Európai Bizottsága és Bírósága eljárásaiban részt vevő személyekre vonatkozó Európai Megállapodásban foglaltakat 1996. február 21-től kezdődően kell alkalmazni.
