1999. évi XXXIII. törvény

a Magyar Köztársaságnak az Európa Tanács Társadalomfejlesztési Alapjához történő csatlakozása és ezzel összefüggésben az Európa Tanács kiváltságairól és mentességeiről szóló, Párizsban, 1949. szeptember 2-án kelt Általános Megállapodás Harmadik Kiegészítő Jegyzőkönyvének kihirdetéséről * 

1. § Az Országgyűlés az Európa Tanács Társadalomfejlesztési Alapjához történő csatlakozást és ezzel összefüggésben az Európa Tanács kiváltságairól és mentességeiről szóló, Párizsban, 1949. szeptember 2-án kelt Általános Megállapodás Harmadik Kiegészítő Jegyzőkönyvét e törvénnyel kihirdeti.

„Third Protocol to the General Agreement on Privileges and Immunities of the Council of Europe

Strasbourg, 6. III. 1959

The Governments signatory hereto, being Members of the Council of Europe, signatories of the General Agreement on Privileges and Immunities of the Council of Europe or Parties to the said Agreement and, at the same time, Members of the Council of Europe Resettlement Fund for National Refugees and Over-population,

having regard to the provisions of Articles I and IX g) of the Articles of Agreement of the aforesaid Fund * ,

having regard to Article 40 of the Statute of the Council of Europe,

desirous of defining the legal regime of the property, assets and operations of the Resettlement Fund, and the legal status of its organs and officials,

considering that it is necessary to facilitate the realisation of the statutory purposes of the Fund by the most generous possible reduction in direct or indirect taxation affecting the operations of the Fund and borne ultimately by the beneficiaries of loans granted by the Fund,

desirous of supplementing, in respect of the Resettlement Fund, the provisions of the General Agreement on Privileges and Immunities of the Council of Europe,

have agreed as follows:

Part I

Articles of Agreement, personality, capacity

Article 1

The Articles of Agreement of the Council of Europe Resettlement Fund, as approved by the Committee of Ministers in Resolution (56) 9, or as amended by the aforesaid Committee, or by the Governing Body acting within the limits laid down in Article IX h) of the said Articles of Agreement, shall be an integral part of the present Protocol.

The Council of Europe Resettlement Fund shall possess juridical personality and, in particular, the capacity

(i) to contract;

(ii) to acquire and dispose of immovable and movable property;

(iii) to institute legal proceedings;

(iv) to carry out any transaction related to its statutory purposes.

The operations, acts and contracts of the Resettlement Fund shall be governed by this Protocol, by the Articles of Agreement of the Fund and by regulations issued in pursuance of the said Articles of Agreement. In addition, a national law may be applied in a particular case, provided that the Fund expressly agrees thereto and that such law does not derogate from this Protocol nor from the said Articles of Agreement.

Part II

Courts, property, assets, operations

Article 2

Any competent court of a Member of the Fund or of a State in whose territory the Fund has contracted or guaranteed a loan may hear suits in which the Fund is a defendant.

Nevertheless:

(i) No action shall be brought in such courts, either against the Fund by a Member or persons acting for or deriving claims from a Member, or by the Fund against a Member or the persons aforesaid;

(ii) Differences arising out of any loan or guarantee contract concluded by the Fund with a Member or with any other borrower approved by that Member shall be settled by arbitration in accordance with procedure laid down in the said contract. Differences arising out of any loan or guarantee contract signed by the Fund shall be settled by arbitration procedure under arrangements specified in the Loan Regulations drawn up in pursuance of Article X, Section I d), of the Articles of Agreement of the Fund.

Article 3

The property and assets of the Fund, wheresover located and by whomsoever held, shall be immune from all forms of seizure, attachment or execution before the delivery against the Fund of an enforceable judgement which can no longer be disputed by common remedies at law.

Enforcement of awards by execution, where such awards result from arbitration in accordance with the third paragraph of Article 2 shall, in the territory of Members of the Fund, take place through the legal channels prescribed in each such Member State and after endorsement with the executory formula customary in the State in whose territory the award is to be executed; for the purpose of such endorsement, no check shall be required other than verification that the award is authentic, that it conforms to the rules concerning competence and procedure set forth in the Loan Regulations of the Fund and that it does not conflict with a final judgement passed in the country concerned. Each signatory shall, on deposit of its instrument of ratification, notify the other signatories through the Secretary-General of the Council of Europe what authority is competent under its laws to discharge this formality.

Article 4

The property and assets of the Fund, wheresoever located and by whomsoever held, shall be immune from search, requisition, confiscation, expropriation or any other form of distraint by executive or legislative action.

The buildings and premises used for the operations of the Fund, and also its archives, shall be inviolable.

Article 5

To the extent necessary to the achievement of its statutory purposes the Fund may:

a) hold currency of any kind and operate accounts in any currency;

b) freely transfer its funds through banking channels from one country to another or within any country and convert any currency held by it into any other currency.

In exercising its rights under this Article, the Fund shall pay due regard to any representations made to it by the Government of any Member.

Article 6

The property and assets of the Fund shall be free from restrictions, regulations, controls and moratoria of any nature.

Article 7

The Resettlement Fund and its assets, income and other property shall be exempt from all direct taxes.

The Resettlement Fund shall be exempt from all taxes in the territory of Members of the Fund in respect of transactions and operations relating to loans contracted by the Fund with a view to applying their proceeds, in accordance with its purpose, to the needs of refugees and surplus population or relating to loans granted or guaranteed by the Fund in accordance with its statutory provisions.

The Fund shall not be granted exemption from any rates, taxes or dues which are merely charges for public utility services.

Member Governments shall, whenever possible, make appropriate arrangements for:

a) exemption from taxes on income derived from interest on bonds issued or loans contracted by the Fund;

b) the remission or return of excise duties and taxes which form part of the price to be paid for movable or immovable property or of the payment for services rendered, when the Fund, for official purposes, is making substantial purchases or procuring services the total cost of which includes such excise duties and taxes.

No tax of any kind shall be levied on any security or bond issued or guaranteed by the Fund (or any dividend or interest thereon) by whomsoever held:

a) which discriminates against such security or bond solely because it is issued or guaranteed by the Fund; or

b) if the sole legal basis for such tax is the place or currency in which the security or bond is issued, guaranteed, made payable or paid, or the location of the headquarters or of any office or place of business maintained by the Fund.

Article 8

The Fund shall be exempt from all customs duties, prohibitions and restrictions on imports and exports in respect of articles required for its official use, unless such prohibition or restrictions have been imposed for reasons of ordre public, safety or health. Articles imported under exemption will not be disposed of in any way in the country into which they are imported, except under conditions approved by the Government of that country.

Part III

Organs

Article 9

The organs referred to in Article VIII of the Articles of Agreement of the Fund shall enjoy in the territory of each Member State, for their official communications, treatment at least as favourable as that accorded by that Member to diplomatic missions of any other Government. No censorship shall be applied to the official correspondence and other official communications of the organs of the Fund.

Article 10

Members of the Governing Body, the Administrative Council and the Auditing Board shall be immune from legal process in respect of words spoken or written and all acts performed by them in Their official capacity and within the limit of their authority. They shall continue to enjoy such immunity after their terms of office have expired. In addition, they shall be accorded the same immunities from immigration restrictions and alien registration requirements and the same exchange and travel facilities as are accorded by Members to representatives of other Governments of the Fund having comparable rank. Sums paid to them in respect of expenses necessarily incurred in the discharge of their duties shall be exempt from taxation.

Article 11

The privileges and immunities are accorded to the individuals mentioned in Article 10 not for their own personal benefit, but in order to safeguard the independent exercise of their functions. Consequently, a Member not only has the right, but is in duty bound, to waive the immunity of its representatives in any case where, in the opinion of the Member, immunity would impede the course of justice, and where it can be waived without prejudice to the purpose for which it is accorded.

Article 12

a) The provisions of Articles 10 and 11 may not be invoked by a representative against the authorities of the State of which he is or has been the representative.

b) Articles 10, 11 and 12 a) shall apply equally to deputy representatives, advisers, technical experts and secretaries of delegations.

Part IV

Officials

Article 13

The Governor and officials of the Fund shall be accorded the privileges and immunities specified in Article 18 of the General Agreement on Privileges and Immunities of the Council of Europe.

The Governor will specify the categories of officials to which the provisions of the aforesaid Article shall apply.

The communications specified in Article 17 of the General Agreement on Privileges and Immunities of the Council of Europe shall be made by the Secretary-General of the Council in respect of the Governor and also of the officials referred to in the preceding paragraph.

The Secretary-General, after consulting the Governor, shall have the right and the duty to waive the immunity of any official in any case where he considers that immunity would impede the course of justice and can be waived without prejudice to the satisfactory operation of the Fund. In the case of the Governor, the Governing Body of the Fund shall have the right to waive immunity.

Part V

Application of the Agreement

Article 14

The Governments of Member States of the Fund undertake to seek such constitutional authority as may be necessary to fulfil the statutory obligations assumed by those States vis-á-vis the Resettlement Fund. They undertake likewise to seek such authority in good time in order to be able to fulfil any undertakings into which they may have entered as borrower or guarantor, in accordance with Article VI, Section 3, of the Articles of Agreement of the Resettlement Fund.

Article 15

The Fund may conclude with any Member State special agreements on the detailed application of the provisions of the present Protocol, supplementing the said provisions or derogating from those of Article 13 above. It may likewise conclude agreements with any State which is not a member of the Fund, modifying the application of the provisions of the present Protocol so far as that State is concerned.

Part VI

Final clauses

Article 16

The present Protocol shall be ratified and the instruments of ratification deposited with the Secretary-General of the Council of Europe. It shall enter into force as soon as three signatories representing at least one-third of the Fund’s holdings have deposited their instruments of ratification. For the other Members of the Fund it shall enter into force on the date when their respective instruments of ratification are deposited.

Nevertheless, pending the entry into force of this Protocol in accordance with the foregoing paragraph, the signatories agree, in order not to delay the satisfactory operation of the Fund, to apply the Protocol provisionally from 1st September 1958, or, at latest, from the date of signature, to the extent compatible with their constitutional rules.

Article 17

Any Government which becomes a Member of the Resettlement Fund after the signature of the present Protocol may accede thereto by depositing an instrument of accession with the Secretary-General of the Council of Europe. Such accession shall become effective on the date of deposit if this takes place after the Protocol has entered into force, and upon the date of such entry into force if the accession takes place prior to that date.

Any Government which has deposited an instrument of accession before the entry into force of the Protocol shall immediately apply the latter provisionally, to the extent compatible with its constitutional rules.

In witness whereof the undersigned plenipotentiaries have signed the present Protocol.

Done at Strasbourg; this 6th day of March 1959, in English and in French, both texts being equally authentic, in a single copy which shall remain in the archives of the Council of Europe. The Secretary-General shall transmit certified copies to each of the signatories or States acceding.

As regards tax exemption, the Federal Republic of Germany will be unable to grant to Resettlement Fund loans more advantageous terms than those accorded to its own loans or the loans of other international organisations. Article 7, paragraph 4, cannot therefore entail any obligation on the part of the Government of the Federal Republic of Germany to make the arrangements mentioned therein.

Troisieme Protocole Additionnel a l’Accord General sur les Privilèges et Immunites du Conseil de lEurope

Strasbourg, 6. III. 1959

Les Gouvernements signataires, Membres du Conseil de l’Europe, signataires de l’Accord Général sur les Privilèges et Immunités du Conseil de l’Europe ou Parties à cet Accord et, en męme temps, Membres du Fonds de Rétablissement du Conseil de l’Europe pour les réfugies nationaux et les excédents de population,

vu les dispositions des articles 1er et IX g) du Statut dudit Fonds * ,

vu l’article 40 du Statut du Conseil de l’Europe,

désireux de préciser le régime juridique des biens, avoirs et opérations, ainsi que le statut juridique des organes et des agents du Fonds de Rétablissement,

considérant que, á ce sujet, il est nécessaire que la réalisation des objectifs statutaires du Fonds soit facilitée par la réduction aussi large que possible des charges fiscales qui pèsent directement ou indirectement sur les opérations du Fonds et qui retombent en définitive sur les bénéficiaires des pręts accordés par le Fonds,

désireux de compléter, en ce qui concerne le Fonds de Rétablissement, les dispositions de l’Accord Général sur les Privilèges et Immunités du Conseil de l’Europe,

sont convenus de ce qui suit:

Titre I

Statut, personnalité et capacité

Article 1

Le Statut du Fonds de Rétablissement du Conseil de l’Europe, approuve par la Résolution (56) 9 du Comité des Ministres, ou amendé, soit par celui-ci, soit par le Comité de Direction, ce dernier agissant dans les limites de l’article IX h) dudit Statut, fait partie intégrante du présent Protocole.

Le Fonds de Rétablissement du Conseil de l’Europe à la pleine personnalité juridique et, notamment, la capacité de:

(i) contracter;

(ii) acquérir des droits et biens mobiliers et immobiliers et en disposer;

(iii) ester en justice;

(iv) effectuer toute opération en rapport avec son objectif statutaire.

Les opérations, actes et contrats du Fonds de Réétablissement sont régis par le présent Protocole, par le Statut du Fonds et par les dispositions réglementaires prises conformément ŕ ce Statut. Le Fonds peut, en outre, consentir expressément á l’application subsidiaire d’une loi nationale pour autant que celle-ci ne déroge pas au présent Protocole et audit Statut.

Titre II

Juridictions, biens, avoirs, opérations

Article 2

Toutes juridictions compétentes d’un État membre du Fonds ou d’un État oů le Fonds a contracté ou garanti des emprunts peuvent connaître des litiges ou le Fonds est partie défenderesse.

Toutefois:

(i) Aucune action ne pourra ętre intentée devant ces juridictions, soit contre le Fonds par un État membre ou par des personnes agissant pour le compte dudit État membre ou faisant valoir des droits cédés par ce dernier, soit par le Fonds contre un État membre ou contre lesdites personnes;

(ii) Les litiges nés de contrats d’emprunt ou de garantie d’emprunt conclus par le Fonds avec un État membre ou tout autre emprunteur agréé par cet État seront réglés par une procédure arbitrale à déterminer dans lesdits contrats. Les litiges nés de contrats de pręt ou de garantie signes par le Fonds seront règles par recours à une procédure arbitrale dont les modalités sont définies par le Règlement des Pręts pris en application de l’article X, section I d), du Statut du Fonds.

Article 3

Les biens et avoirs du Fonds, en quelque lieu qu’ils se trouvent et quels qu’en soient les détenteurs, seront ŕ l’abri de toute forme de saisie d’opposition ou d’exécution, avant que n’ait été rendu contre le Fonds un jugement exécutoire qui n’est plus susceptible d’ętre attaqué par les voies de recours ordinaires.

L’exécution forcée, sur le territoire des États membres du Fonds, des sentences intervenues ŕ la suite d’une procédure arbitrale visée à. l’article 2, alinéa 3, est poursuivie suivant les voies de droit en vigueur dans chacun de ces États et après qu’aura été apposée - sans autre contrőle que celui de la vérification de l’authenticité de ces sentences de leur conformité aux règles de compétence et de procédure établies par le Règlement des Pręts du Fonds, ainsi que de l’absence de contradiction entre lesdites sentences et un jugement définitif intervenu dans le pays intéressé - la formule exécutoire usitée dans l’État sur le territoire duquel la sentence doit ętre exécutée. Chaque signataire notifiera, lors du dépőt de son instrument de ratification, aux autres signataires, par l’entremise du Secrétaire Général du Conseil de l’Europe, quelle est, d’après la législation de son pays, l’autorité compétente pour pourvoir à cette formalité.

Article 4

Les biens et les avoirs du Fonds, en quelque lieu qu’ils se trouvent et quels qu’en soient les détenteurs, seront exempts de perquisitions réquisitions, confiscations, expropriations ou de toute autre forme de contrainte ordonnée par le pouvoir exécutif ou par le pouvoir législatif.

Les bâtiments et locaux utilises pour le fonctionnement des services du Fonds, ainsi que les archives de ce dernier sont inviolables.

Article 5

Dans la mesure nécessaire ŕ l’accomplissement de son objectif statutaire, le Fonds de Réétablissement peut:

a) détenir toutes devises et tous avoirs de compte en n’importe quelle monnaie;

b) transférer librement par voie bancaire ses fonds d’un pays dans un autre ou ŕ l’interieur d’un pays quelconque et convertir toutes devises détenues par lui en toute autre monnaie.

Dans l’exercice des droits prévus par cet article, le Fonds de Réétablissement tiendra compte de toute représentation qui lui sera faite par le Gouvernement de tout État membre.

Article 6

Les biens et avoirs du Fonds sont exempts de restrictions, réglementations, contrőles et moratoires de toute nature.

Article 7

Le Fonds de Réétablissement, ses avoirs, revenus et autres biens, sont exonérés de tous impőts directs.

Le Fonds de Réétablissement est exonéré de tous impőts dans les États membres du Fonds sur les transactions et opérations relatives aux emprunts que le Fonds contracte pour en affecter le produit, conformément ŕ son objet, aux besoins des réfugiés et des excédents de population et aux prêts qu’il consent ou qu’il garantit dans les conditions statutairement prévues.

Aucune exonération n’est accordée au Fonds en ce qui concerne les impőts, taxes et droits qui ne constituent que la simple rémunération de services d’utilité publique.

Les Gouvernements des États membres prennent, chaque fois qu’il leur est possible, les dispositions appropriées en vue:

a) de l’exoneration des impőts sur les revenus afférents aux intéręts des obligations émises ou des emprunts contractés par le Fonds;

b) de la remise ou du remboursement du montant des droits indirects et des taxes entrant dans le prix des biens immobiliers ou mobiliers, ou dans celui des prestations de service, lorsque le Fonds, pour son usage officiel, effectue des achats importants ou bénéficie de services dont le prix comprend des droits et taxes de cette nature.

Aucun impőt, de quelque nature que ce soit, ne sera perçu sur les valeurs ou obligations émises ou garanties par le Fonds (y compris tout dividende ou intéręt y afférent), quel qu’en soit le détenteur:

a) si cet impőt constitue une mesure de discrimination contre une telle valeur ou obligation du seul fait qu’elle est émise ou garantie par le Fonds; ou

b) si le seul fondement juridique d’un tel impőt est le lieu ou la devise dans laquelle la valeur ou l’obligation est émise ou garantie, rendue payable ou payée, ou encore l’emplacement du siège, de tout bureau ou centre d’opérations du Fonds.

Article 8

Le Fonds est exonéré de tous droits de douane, prohibitions et restrictions d’importation et d’exportation ŕ l’égard des articles destines ŕ son usage officiel, ŕ moins que ces prohibitions ou restrictions n’aient été dictées par des raisons d’ordre public, de sécurité publique et de santé publique. Toutefois, les articles importes en franchise ne seront pas cédés ŕ un titre quelconque sur le territoire du pays dans lequel ils auront été introduits, sauf dans des conditions agréées par le gouvernement de ce pays.

Titre III

Organes

Article 9

Les organes visés ŕ l’article VIII du Statut du Fonds bénéficient sur le territoire de chaque état membre, pour leurs communications officielles, d’un traitement au moins aussi favorable que le traitement accorde par ce Membre aux missions diplomatiques de tout autre gouvernement. La correspondance officielle et les autres communications officielles des organes du Fonds ne peuvent ętre censurées.

Article 10

Les membres du Comité de Direction, du Conseil d’Administration et du Comité de Surveillance jouissent de l’immunite de juridiction pour les actes accomplis par eux, y compris leurs paroles et écrits, en leur qualité officielle et dans les limites de leurs attributions. Cette immunité leur reste acquise ŕ l’expiration de leur mandat. Ils bénéficient, en outre, en ce qui concerne les restrictions ŕ l’immigration, l’enregistrement des étrangers, les réglementations de change et les facilites de voyage, du męme traitement que celui qui est accorde par les États membres aux représentants des autres gouvernements du Fonds possédant un statut équivalent. Les sommes qui leur sont allouées en frais de représentation ou dépenses inhérentes ŕ l’exercice de leurs fonctions ne sont soumises ŕ aucune imposition fiscale.

Article 11

Les immunités et privilèges sont accordes aux personnes visées par l’article 10, non pas pour leur bénéfice personnel, mais dans le but d’assurer en toute indépendance l’exercice de leurs fonctions. Par conséquent, un Membre a non seulement le droit mais le devoir de lever l’immunite de son représentant dans tous les cas ou, ŕ son avis, l’immunite empêcherait que justice ne soit faite et ou l’immunite peut ętre levée sans nuire au but pour lequel elle est accordée.

Article 12

a) Les dispositions des articles 10 et 11 ci-dessus ne sont pas opposables aux autorités de l’État dont la personne est ou a été le représentant.

b) Les articles 10, 11 et 12 a), s’appliquent également aux représentants adjoints, conseillers, experts techniques et secrétaires de délégation.

Titre IV

Agents

Article 13

Le Gouverneur du Fonds et les agents du Fonds jouissent des privilèges et immunités prévus ŕ l’article 18 de l’Accord Général sur les Privilèges et Immunités du Conseil de l’Europe.

Le Gouverneur déterminera les catégories des agents auxquels s’appliquent, en tout ou partie, les dispositions dudit article.

Les communications prévues ŕ l’article 17 de l’Accord Général sur les Privilèges et Immunités du Conseil de l’Europe seront faites par le Secrétaire Général du Conseil tant en ce qui concerne le Gouverneur que les agents vises á l’alinéa précédent.

Le Secrétaire Général, après consultation du Gouverneur, peut et doit lever l’immunité accordée á un agent dans tous les cas ou il estime que cette immunité empęcherait l’exercice normal d’une action de justice et pourrait ętre levée sans que cette mesure portât préjudice au bon fonctionnement du Fonds. A l’égard du Gouverneur, le Comité de Direction du Fonds a qualité pour prononcer la levée des immunités.

Titre V

Application de l’accord

Article 14

Les Gouvernements des États membres du Fonds s’engagent ŕ solliciter les autorisations constitutionnelles qui seraient éventuellement nécessaires pour faire face aux obligations statutaires que ces États assument ŕ l’égard du Fonds de Réétablissement. Ils s’engagent également a solliciter en temps utile lesdites autorisations afin de pouvoir remplir les engagements qu’ils auraient contractes au titre d’emprunteur ou de garant, conformément à, la section 3 de l’article VI du Statut du Fonds de Réétablissement.

Article 15

Le Fonds pourra conclure avec tout État membre des accords spéciaux précisant les modalités d’application des dispositions du présent Protocole, complétant lesdites dispositions ou portant dérogation ŕ celles de l’article 13 ci-dessus. I1 peut également conclure des accords avec tout État non membre du Fonds de Réétablissement pour l’aménagement ŕ leur égard de l’application des dispositions de ce Protocole.

Titre VI

Dispositions finales

Article 16

Le présent Protocole sera ratifie et les instruments de ratification seront déposes près le Secrétaire Général du Conseil de l’Europe. Il entrera en vigueur des que trois signataires représentant au moins le tiers des titres du Fonds auront déposé leurs instruments de ratification. Pour les autres Membres du Fonds, il entrera en vigueur ŕ la date de dépőt de leurs instruments de ratification respectifs.

Toutefois, en attendant l’entrée en vigueur du Protocole dans les conditions prévues au paragraphe précédent, les signataires conviennent, afin d’éviter tout délai dans le bon fonctionnement du Fonds de Réétablissement, de le mettre ŕ titre provisoire en application le 1er septembre 1958 ou au plus tard dès sa signature, dans la mesure compatible avec leurs règles constitutionnelles respectives.

Article 17

Tout Gouvernement devenu, après la signature de ce Protocole, Membre du Fonds de Réétablissement, peut adhérer au présent Protocole par le dépőt d’un instrument d’adhésion près le Secrétaire Général du Conseil de l’Europe. Cette adhésion produira effet ŕ la date de ce dépőt si elle est intervenue après l’entree en vigueur du Protocole, et ŕ la date de cette entrée en vigueur si l’adhésion est antérieure ŕ cette entrée.

Tout Gouvernement ayant dépose un instrument d’adhésion avant l’entrée en vigueur du Protocole mettra celui-ci immédiatement en application provisoire, dans la mesure compatible avec ses règles constitutionnelles.

En foi de quoi, les plénipotentiaires soussignés ont signé le présent Protocole.

Fait ŕ Strasbourg, le 6 mars 1959, en français et en anglais, les deux textes faisant également foi, en un seul exemplaire, qui sera dépose dans les archives du Conseil de l’Europe. Le Secrétaire Général en communiquera des copies certifiées conformes ŕ tous les signataires ou adhérents.

Az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás Harmadik Kiegészítő Jegyzőkönyve

Az aláíró kormányok, melyek tagjai az Európa Tanácsnak, aláírói az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodásnak, illetve részesei e Megállapodásnak és ugyanakkor tagjai az Európa Tanács Nemzeti Menekültügyi és Túlnépesedési Letelepedési Alapjának (Council of Europe Resettlement Fund for National Refugees and Overpopulation),

tekintettel a fent említett Alap Alapszabályának I. és IX. g) Cikkére,

tekintettel az Európa Tanács Alapszabályának 40. Cikkére,

abbeli óhajukban, hogy meghatározzák a Letelepedési Alap vagyonának, eszközeinek és tevékenységének jogi kereteit, valamint szervei és tisztviselői jogi státuszát,

úgy ítélve, hogy szükséges megkönnyíteni az Alap törvény által meghatározott céljainak megvalósítását a közvetlen vagy közvetett adózás legnagyobb mértékű csökkentése révén (mely adózás) az Alap működését érinti, és (amelyet) végső fokon az Alap által nyújtott kölcsönök kedvezményezettjei viselnek,

abbeli óhajukban, hogy kiegészítsék az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodásnak a Letelepedési Alapra vonatkozó rendelkezéseit,

a következőkben állapodtak meg:

I. Rész

Alapszabály, jogi személyiség, jogképesség

1. Cikk

Az Európa Tanács Letelepedési Alapjának Alapszabálya, amint azt az (56) 9. határozatban a Miniszteri Bizottság jóváhagyta, illetve amint a fenti Bizottság vagy a fent említett Alapszabály IX. h) Cikkében lefektetett kereteken belül eljáró Kormányzó Testület módosította, a jelen Jegyzőkönyv szerves részét képezik.

Az Európa Tanács Letelepedési Alapja jogi személy és képessége van arra, hogy

(i) szerződéseket kössön;

(ii) ingó és ingatlan vagyont szerezzen, illetve idegenítsen el;

(iii) jogi eljárást kezdeményezzen;

(iv) törvényben rögzített céljaihoz kapcsolódóan bármely tranzakciót végrehajtson.

A Letelepedési Alap tevékenységeit, eljárásait és szerződéseit a jelen Jegyzőkönyv, az Alap Alapszabálya, valamint az említett Alapszabálynak megfelelően kiadott rendelkezések szabályozzák. Ezen felül, adott esetben egy nemzeti törvény alkalmazható, feltéve, ha az Alap kifejezetten hozzájárul ehhez, és ha az ilyen törvény nem csorbítja a jelen Jegyzőkönyvet, illetve a nevezett Alapszabályt.

II. Rész

Bíróságok, vagyon, eszközök, tevékenységek

2. Cikk

Az Alap Tagállamaiban vagy egy olyan államban, amelynek területén az Alap szerződést kötött vagy kölcsönt ígért, bármely illetékes bíróság tárgyalhat olyan peres ügyeket, amelyben az Alap alperes.

Mindazonáltal:

(i) A fent meghatározott bíróságoknál a Tagállamok, vagy egy Tagállam nevében fellépő, illetve avval szemben követeléssel rendelkező személyek nem jogosultak kereset benyújtására az Alap ellen, és ugyanakkor az Alap sem jogosult kereset benyújtására egy Tagállam vagy a fenti személyek ellen;

(ii) Bármilyen, az Alap által egy Tagállammal vagy bármilyen más, az adott Tagállam által elismert kölcsönvevővel kötött kölcsön- vagy garanciaszerződésből származó nézeteltéréseket a nevezett szerződésben lefektetett eljárással összhangban, választottbíróság útján rendeznek. Bármely, az Alap által aláírt kölcsön- vagy garanciaszerződésből származó nézeteltéréseket az Alap Alapszabálya X. Cikkének 1. d) pontja értelmében megfogalmazott Kölcsönzési Szabályzatban rögzített rendelkezések alapján, választottbírósági eljárással rendezik.

3. Cikk

Az Alap vagyona és eszközei, legyenek bárhol és bárki kezelésében, mentességet élveznek mindennemű lefoglalás, zárolás vagy végrehajtás alól, mindaddig amíg az Alap ellen olyan érvényesíthető ítélet nem születik, amely a szokásos jogorvoslati eljárással többé nem vitatható.

Olyan ítéletek végrehajtással való érvényesítése, amelyek a fenti 2. Cikk harmadik bekezdésében meghatározott választottbírósági eljárás eredményei, az Alap Tagállamainak területén kerülnek végrehajtásra az egyes Tagállamokban érvényes jogi úton, és miután azon Tagállam szokásos végrehajtási záradékával ellátták, amelynek területén az ítélet végrehajtandó; az ilyen végrehajtási záradék tekintetében nem szükséges egyéb ellenőrzés, mint annak igazolása, hogy az ítélet eredeti, és hogy megfelel az Alap Kölcsönzési Szabályzatának illetékességre és eljárásra vonatkozó szabályainak, valamint, hogy nem áll ellentétben az adott országban hozott jogerős ítélettel. Minden aláíró köteles a ratifikációs okmánya letétbe helyezésekor értesíteni a többi aláíró felet az Európa Tanács Főtitkárán keresztül arról, hogy mely hatóság illetékes az adott ország törvényei szerint ez ügyben eljárni.

4. Cikk

Az Alap vagyona és eszközei, legyenek bárhol és bárki kezelésében, mentességet élveznek mindennemű kutatás, lefoglalás, elkobzás, államosítás vagy bármely egyéb, végrehajtás vagy törvény által rendelt zárolás alól.

Az Alap működéséhez használt épületek és ingatlanok, valamint annak irattára sérthetetlenek.

5. Cikk

Az Alap törvényben rögzített céljai eléréséhez szükséges mértékig jogosult:

a) bármely valutát birtokolni, és bármely valutában számlát vezetni;

b) szabadon átutalni pénzeszközeit banki csatornákon keresztül egyik országból a másikba, vagy egy adott országon belül, valamint átváltani a birtokában lévő valutát bármely egyéb valutára.

A jelen Cikkben foglalt jogai gyakorlásában az Alap kellő figyelmet fordít bármely Tagállam kormányának nála tett bejelentéseire.

6. Cikk

Az Alap vagyona és eszközei mentességet élveznek mindennemű korlátozás, szabályozás, felügyelet és moratórium alól.

7. Cikk

A Letelepedési Alap és annak eszközei, jövedelme és egyéb vagyona mentesülnek mindennemű közvetlen adó alól.

A Letelepedési Alap mentesül valamennyi adó alól az Alap Tagállamai területén folytatott tranzakciók és az Alap által nyújtott hitelekkel kapcsolatos tevékenység tekintetében, abból a célból, hogy az abból származó összegeket célkitűzéseivel összhangban a menekültek és a túlnépesedett területek lakossága segítésére fordítsa, illetve olyan kölcsönök vagy garanciák tekintetében, amelyeket az Alap Alapszabályának rendelkezései szerint nyújtott.

Az Alap nem élvez mentességet olyan helyi adók, adók vagy illetékek alól, amelyek közüzemi szolgáltatások díjaként kerülnek kivetésre.

A Tagállamok kormányai - amikor csak lehetséges - kötelesek megfelelő intézkedéseket tenni az alábbiak tekintetében:

a) az Alap által kibocsátott kötvények, vagy az általa nyújtott hitelek kamatából származó jövedelemre vonatkozó adózás alóli mentesség biztosítása;

b) olyan fogyasztási adók vagy illetékek elengedése vagy visszatérítése, amelyek ingó vagy ingatlan vagyon megvásárlásakor fizetendők a vételáron felül, illetve nyújtott szolgáltatások árán felül, olyan esetekben, amikor az Alap hivatalos célra nagyobb mértékű vásárlásokat eszközöl, illetve szolgáltatásokat vesz igénybe, mely vásárlások, illetve szolgáltatások igénybevételének teljes költségében benne foglaltatnak a fenti fogyasztási adók vagy illetékek.

Nem vetnek ki semmifajta adót olyan értékpapírra vagy kötvényre (illetve az azokból származó osztalékra vagy az arra fizetendő kamatra), amelyet az Alap bocsátott ki, vagy garantált, legyen az bárki tulajdonában, ha

a) az ilyen adó hátrányos megkülönböztetést eredményez az ilyen értékpapírokkal vagy kötvényekkel szemben kizárólag azért, mert azokat az Alap bocsátotta ki, vagy garantálta;

b) az ilyen adó kivetésének jogi alapja az a terület vagy valuta (illetve az Alap által fenntartott központi iroda vagy bármely egyéb iroda, vagy működési terület), ahol vagy amelyben az értékpapírt vagy kötvényt kibocsátották, garantálták, fizetése esedékessé vált, vagy kifizették.

8. Cikk

Az Alap mentességet élvez a hivatalos céljait szolgáló import vagy export cikkekre vonatkozó mindennemű vám, tiltás és korlátozás alól, kivéve, ha az ilyen tiltások vagy korlátozások a közrend érdekében, illetve egészségügyi vagy biztonsági okokból kerültek kivetésre. A mentesség mellett importált cikkek semmiféleképpen sem értékesíthetők abban az országban, ahova behozatalra kerültek, kivéve az adott ország kormánya által jóváhagyott feltételekkel.

III. Rész

Szervek

9. Cikk

Az Alap Alapszabályának VIII. Cikkében említett szerveket a hivatalos kapcsolattartás tekintetében minden Tagállam területén legalább olyan kedvező elbánás illeti meg, mint amilyet az a Tagállam bármely más kormány diplomáciai képviseleteinek biztosít. Az Alap szerveinek hivatalos levelezése és egyéb hivatalos kapcsolattartása nem cenzúrázható.

10. Cikk

A Kormányzó Testület, az Adminisztratív Tanács és a Felügyelő Bizottság tagjai mentességet élveznek bármely jogi eljárás alól szóbeli és írásos nyilatkozataik tekintetében, valamint valamennyi olyan cselekedetük tekintetében, amelyet hivatalos minőségükben és hatáskörükön belül tesznek. A fenti mentesség megbízatásuk lejárta után is megilleti őket. Ezenfelül ugyanazon mentességeket élvezik a bevándorlási korlátozások és az idegenekre vonatkozó bejelentési kötelezettség tekintetében, valamint ugyanazon pénzváltási és utazási lehetőségek illetik meg őket, mint amelyet a Tagállamok az Alap más kormányai hasonló rangú képviselőinek biztosítanak. A kötelezettségeik végzése során felmerülő szükséges költségek fedezése céljára számukra kifizetett összegek mentesülnek az adózás alól.

11. Cikk

A 10. Cikk meghatározott személyek kiváltságai és mentességei nem személyes előnyök szerzését szolgálják, hanem feladataik független elvégzését hivatottak biztosítani. Ennek megfelelően egy Tagállam nemcsak jogosult, hanem egyben köteles képviselőinek mentességéről lemondani bármely olyan esetben, amikor a Tagállam véleménye szerint a mentességi jog gyakorlása gátolja az igazságszolgáltatást, és amikor a mentességi jogról való lemondás megtehető anélkül, hogy sértené a célt, amelyért a mentességet adták.

12. Cikk

a) A képviselő nem hivatkozhat 10-11. Cikkekre annak az államnak a hatóságai előtt, ahol képviselőként lép vagy lépett fel.

b) A 10-11. és 12. a) Cikkek, egyaránt vonatkoznak a delegációk képviselő-helyetteseire, tanácsadóira, szakértőire és titkárnőire.

IV. Rész

Tisztviselők

13. Cikk

Az Alap Kormányzója és tisztviselői az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás 18. Cikkében meghatározott kiváltságokban és mentességekben részesülnek.

A Kormányzó határozza meg, hogy a nevezett Cikk rendelkezései a tisztviselők mely csoportjaira vonatkoznak.

Az Európa Tanács kiváltságairól és mentességeiről szóló Általános Megállapodás 17. Cikkében meghatározott nyilatkozatot a Tanács Főtitkára teszi meg a Kormányzó és az előző bekezdésben nevezett tisztviselők tekintetében.

A Főtitkár a Kormányzóval való egyeztetés után jogosult és köteles bármely tisztviselő mentességéről lemondani, valamennyi olyan esetben, amikor megítélése szerint a mentesség fenntartása gátolja az igazságszolgáltatást, és a lemondás nem sérti az Alap érdekeit. A Kormányzó tekintetében az Alap Kormányzó Testülete jogosult a mentességről történő lemondásra.

V. Rész

A Megállapodás alkalmazása

14. Cikk

Az Alap Tagállamainak kormányai vállalják, hogy olyan alkotmányos hatáskört szereznek, amely a Letelepedési Alap vonatkozásában a Tagállamok által felvállalt törvényes kötelezettségeik teljesítéséhez szükséges. Ugyanakkor vállalják azt is, hogy a fenti hatáskört megfelelő időben szerzik meg annak érdekében, hogy bármely olyan vállalást, amelyet a Letelepedési Alap Alapszabályának VI. Cikk 3. pontjának megfelelően mint kölcsönfelvevő vagy garanciaadó tettek, teljesíteni tudjanak.

15. Cikk

Az Alap jogosult bármely Tagállammal külön megállapodásokat kötni a jelen Jegyzőkönyv rendelkezéseinek részletes alkalmazásáról, kiegészítve a rendelkezéseket, vagy eltérve a fenti 13. Cikk rendelkezéseitől. Ugyanakkor jogosult az Alap bármely olyan állammal megállapodásokat kötni, amely nem tagja az Alapnak, módosítva az adott állam vonatkozásában a jelen Jegyzőkönyv rendelkezéseit.

VI. Rész

Záró rendelkezések

16. Cikk

A jelen Jegyzőkönyvet meg kell erősíteni, és a megerősítő okiratokat a Főtitkárnál kell letétbe helyezni. A Jegyzőkönyv hatályba lép, mihelyt az Alap vagyonának legalább egyharmad részét képviselő, három aláíró letétbe helyezte a megerősítő okiratokat. Az Alap többi Tagállama szempontjából a Jegyzőkönyv azon a napon lép hatályba, amikor saját megerősítő okirataikat letétbe helyezik.

Mindazonáltal, a jelen Jegyzőkönyvnek az előző bekezdéssel összhangban való hatálybalépéséig az aláírók megállapodnak abban, hogy - annak érdekében, hogy ne késleltessék az Alap hatékony működését - a Jegyzőkönyvet 1958. szeptember 1-jétől, vagy legkésőbb az aláírás időpontjától, ideiglenesen alkalmazzák annyiban, amennyiben azt a saját alkotmányos rendjük lehetővé teszi.

17. Cikk

Bármely olyan kormány, amely a Letelepedési Alapnak a jelen Jegyzőkönyv aláírása után válik tagjává, jogosult az Alaphoz csatlakozni oly módon, hogy csatlakozási okmányát letétbe helyezi az Európa Tanács Főtitkáránál. A csatlakozás a letétbe helyezés napján lép érvénybe, feltéve, hogy ez a Jegyzőkönyv hatálybalépését követő időpontra esik, és a Jegyzőkönyv hatálybalépésének napján, amennyiben a csatlakozás egy azt megelőző időpontra esik.

Minden kormány, mely a Jegyzőkönyv hatálybalépése előtt helyezett letétbe egy csatlakozási okiratot a Jegyzőkönyvet ideiglenes jelleggel azonnal alkalmazza annyiban, amennyiben azt a saját alkotmányos rendje lehetővé teszi.

A fentiek hiteléül az erre nézve kellően felhatalmazottak a jelen Jegyzőkönyvet aláírták.

Készült Strasbourgban, 1959. március 6-án, angol és francia nyelven, egyetlen példányban, amelyet az Európa Tanács levéltárában kell elhelyezni. Mindkét nyelvű szöveg egyaránt hiteles. A Főtitkár valamennyi aláíró vagy csatlakozó állam részére hiteles másolatot küld.

Ami az adómentességet illeti, a Német Szövetségi Köztársaság nem lesz képes kedvezőbb feltételekkel kölcsönt nyújtani a Letelepedési Alapnak, mint amelyekkel saját kölcsöneit vagy más nemzetközi szervezetek kölcsöneit nyújtja. A 7. Cikkely 4. pontja ezért nem jár semminemű kötelezettséggel a Német Szövetségi Köztársaság Kormányának arra nézve, hogy teljesítse az imént említett intézkedéseket.
