2013. évi CCXI. törvény

a Magyarország Kormánya és a Török Köztársaság Kormánya között a kulturális központok nyitásáról, működtetéséről és tevékenységéről szóló Egyezmény kihirdetéséről * 

1. § Az Országgyűlés e törvénnyel felhatalmazást ad a Magyarország Kormánya és a Török Köztársaság Kormánya között a kulturális központok nyitásáról, működtetéséről és tevékenységéről szóló Egyezmény (a továbbiakban: Egyezmény) kötelező hatályának elismerésére.

2. § Az Országgyűlés az Egyezményt e törvénnyel kihirdeti.

3. § Az Egyezmény hiteles magyar és angol nyelvű szövege a következő:

„EGYEZMÉNY
MAGYARORSZÁG ÉS A TÖRÖK KÖZTÁRSASÁG KORMÁNYAI KÖZÖTT A KULTURÁLIS KÖZPONTOK NYITÁSÁRÓL, MŰKÖDTETÉSÉRŐL ÉS TEVÉKENYSÉGÉRŐL

Magyarország Kormánya és a Török Köztársaság Kormánya (a továbbiakban: „Felek”);

A Felek közötti barátság és együttműködés erősítésének céljából;

A kölcsönösség és viszonosság elve alapján;

A kulturális központok kölcsönös nyitása, működtetése és tevékenysége tárgyában az alábbi

Egyezményt kötötte:

I. Fejezet

Alapvető rendelkezések

1. cikk

(1) A Magyar Fél kulturális központot hoz létre Isztambulban, a Török Fél kulturális központot hoz létre Budapesten (a továbbiakban: „Kulturális Központok”).

(2) A Kulturális Központokat a Török Köztársaságban a Magyar Nagykövetség, Magyarországon pedig a Török Nagykövetség Kulturális Részlegeként hozzák létre.

(3) A Kulturális Központok kulturális diplomáciai tevékenységet folytatnak a Küldő és a Fogadó Fél hatályos jogszabályai alapján.

(4) A Kulturális Központok nyitására, műkötetésére és tevékenységére a jelen Egyezmény rendelkezései az irányadók. A jelen Egyezményben nem szabályozott kérdésekben a Fogadó Fél hatályos jogszabályai az irányadók.

(5) A jelen Egyezmény értelmében „Fogadó Fél”: az ország, melynek a területén létrejön a Kulturális Központ, míg „Küldő Fél”: az ország, amely a Kulturális Központot a másik ország területén létrehozza.

(6) A Kulturális Központok megnyitására és bezárására, az alapszabály megalkotására, a személyzet kiválasztására, a szervezet összetételére, valamint a döntéshozatali és levelezési eljárásaira a Küldő Fél hatályos jogszabályai az irányadók. A Kulturális Központoknak az említett ügyekben jogkörük lesz a szabályok és eljárások meghatározására, amelyre a Fogadó Fél hatóságai általi engedélyezési vagy jóváhagyási követelmény nem vonatkozik.

(7) A Kulturális Központoknak nem lehet a jelen Egyezmény 5., 13., illetve 14. cikkében rögzítettektől eltérő feladata, és nem végezhetnek az ott rögzítettektől eltérő tevékenységet, továbbá nem végezhetnek olyan tevékenységet, amit a Fogadó Fél hatályos jogszabályai kifejezetten tiltanak.

(8) A Kulturális Központokra és személyzetükre – státuszuktól és állampolgárságuktól függetlenül –, amennyiben olyan tevékenységet végeznek, vagy cselekményt követnek el, amely a Fogadó Fél hatályos jogszabályai szerint bűncselekménynek minősül, a Fogadó Fél hatályos jogszabályai szerinti jogi eljárások vonatkoznak a jelen Egyezmény által biztosított kiváltságok és mentességek sérelme nélkül.

2. cikk

(1) A Magyar Fél Kulturális Központjának megnevezése „Isztambuli Magyar Intézet”. Az Isztambuli Magyar Intézet irányítását és felügyeletét a Balassi Intézet látja el, amelynek adminisztratív székhelye Budapesten van.

(2) A Török Fél Kulturális Központjának megnevezése „Yunus Emre Török Kulturális Központ”. A Yunus Emre Kulturális Központot a „Yunus Emre Alapítvány” nyitja meg, és irányítja, amely a Török Fél joga szerint alapítványi státusszal rendelkezik, és amelynek adminisztratív székhelye Ankarában van.

3. cikk

Diplomáciai úton megadott kölcsönös hozzájárulásuk alapján a Felek a jelen Egyezmény 1. cikkében rögzítettől eltérő településeken is engedélyezik a Kulturális Központ fiókintézeteinek létrehozását. A fiókintézetek nyitása külön megállapodás tárgyát képezi, ami nem lehet ellentétes a jelen Egyezményben foglaltakkal. A Kulturális Központ fiókintézeteire is a jelen Egyezmény Kulturális Központokra vonatkozó rendelkezéseit kell megfelelően alkalmazni.

4. cikk

(1) A Kulturális Központok a Fogadó Fél hatályos jogszabályai szerint rendelkeznek jogi személyiséggel és jogképességgel.

(2) A Kulturális Központok ennek megfelelően, feladataik ellátása érdekében, a Fogadó Fél hatályos jogszabályaival összhangban szerződéseket köthetnek a Fogadó Fél állami szerveivel, helyi önkormányzataival, társadalmi szervezeteivel, valamint jogi és természetes személyeivel.

5. cikk

A Kulturális Központok az alábbi feladatokat látják el:

1. A Felek népei közötti kölcsönös megértés és barátság elősegítése;

2. Közreműködés a Felek közötti kapcsolatok és együttműködés fejlesztéséhez a kultúra, az oktatás és a tudomány területén;

3. A Küldő Fél nyelvének, kultúrájának, történelmének és művészetének népszerűsítését célzó ismeretterjesztő rendezvények szervezése;

4. A jelen Egyezmény, valamint a Felek közötti kulturális, oktatási és tudományos együttműködésre vonatkozó más egyezmények, jegyzőkönyvek vagy programok/projektek végrehajtásának támogatása.

6. cikk

(1) A Felek a viszonosság elve alapján felmérik annak lehetőségét, hogy a Kulturális Központok és fiókintézeteik számára megfelelő ingatlant biztosítsanak. Amennyiben az ingatlanok kölcsönös biztosítása nem lehetséges, a Fogadó Fél minden tőle telhető támogatást megad a Küldő Félnek a Kulturális Központok és fiókintézeteik számára megfelelő ingatlan felkutatásához.

(2) A Fogadó Fél saját hatályos jogszabályainak keretei között minden tőle telhető támogatást megad a Kulturális Központnak és fiókintézeteinek a szükséges engedélyek beszerzéséhez és a jogi követelmények mielőbbi teljesítéséhez. A Fogadó Fél minden tőle telhető támogatást megad a Kulturális Központ és fiókintézetei által használandó ingatlan megvásárlásához, kibérléséhez vagy kijelöléséhez, felépítéséhez, felújításához vagy átépítéséhez szükséges ügyintézés megkönnyítéséhez.

7. cikk

A Kulturális Központok feladataik ellátása érdekében, a Fogadó Fél hatályos jogszabályaival összhangban telephelyükön kívül is végezhetik tevékenységüket vagy szervezhetnek rendezvényeket.

8. cikk

A Fogadó Fél lehetőség szerint minden tőle telhető támogatást megad a Kulturális Központ által szervezendő kulturális rendezvényekre olyan térítésmentesen igénybe vehető helyszínek felkutatásához, amelyek a kultúráért felelős minisztérium, vagy más központi vagy helyi közintézmény kezelésében állnak, feltéve, hogy a Kulturális Központ az eseményt megelőzően legalább 3 hónappal ezirányú írásbeli kérelmet nyújt be, továbbá hogy a helyszín az adott időpontban rendelkezésre áll.

9. cikk

(1) A Kulturális Központok feladataik ellátása érdekében, továbbá a jelen Egyezményben felsorolt programok szervezése során közvetlen kapcsolatba léphetnek a Fogadó Fél állami szerveivel, helyi önkormányzataival, társadalmi szervezeteivel, valamint jogi és természetes személyeivel.

(2) A Kulturális Központok feladataik ellátása érdekében, továbbá a Fogadó Fél hatályos jogszabályaival összhangban bármely társadalmi szervezettől, természetes és jogi személytől természetbeni és pénzbeli hozzájárulást kaphatnak, illetve számukra ilyet juttathatnak.

10. cikk

(1) A Fogadó Fél – biztonsági fenyegetettség fennállása kivételével – a nyilvánosság számára szabad és akadálytalan hozzáférést biztosít a Kulturális Központ székhelyéhez, valamint a Kulturális Központ által a székhelyén kívül szervezett rendezvényekhez. E rendelkezés nem zárja ki a Kulturális Központok 14. cikkben foglalt jogainak gyakorlását.

(2) A Kulturális Központ a Fogadó fél hatályos jogszabályaival összhangban minden rendelkezésre álló kommunikációs csatornát és eszközt – beleértve a tömegtájékoztatást, újságokat, folyóiratokat, rádió- és televízió-csatornákat és az internetet – igénybe vehet a közönség tájékoztatása céljából.

11. cikk

A Kulturális Központ és fiókintézetei, valamint a személyzet biztonságáról kérelemre a Fogadó Fél gondoskodik. A Fogadó Fél megteszi továbbá a megfelelő biztonsági intézkedéseket a Kulturális Központ és fiókintézetei által külső helyszínen szervezendő tevékenységek esetében is.

12. cikk

(1) A Fogadó Fél hatályos jogszabályainak keretei között, a kölcsönösség és viszonosság elve alapján a Kulturális Központ és fiókintézetei számára a fentieken túl minden egyéb, a rendes működéshez és a feladataik ellátásához szükséges feltételt és támogatást megad.

(2) A Fogadó Fél ennek megfelelően megkönnyíti a Küldő Fél állampolgárai számára a vízumok kiadását a Kulturális Központ által szervezett rendezvényeken való részvétel céljából.

II. Fejezet

A Kulurális Központok tevékenységei

13. cikk

(1) A Kulturális Központok feladataik ellátása érdekében, a Fogadó Fél hatályos jogszabályaival összhangban az alábbi tevékenységeket végezhetik:

1. Konferenciák és egyéb találkozók, valamint kulturális események – koncertek, színházi előadások és kiállítások – szervezése;

2. Fórumok és fesztiválok, valamint ünnepségek szervezése, beleértve a nemzeti ünnepi megemlékezéseket is;

3. A Felek vagy egy harmadik ország által szervezett rendezvényeken, programokon és projektekben való részvétel és közreműködés;

4. Filmek és más audiovizuális anyag vetítése;

5. A Felek országai közötti látogatások és csereprogramok szervezése, ideértve a művészek, írók, tudósok, kutatók, oktatók, hallgatók, újságírók és köztisztviselők látogatásait, valamint az egyetemi oktatók és hallgatók csereprogramját;

6. Külföldi személyek (ideértve művészek, írók, tudósok, oktatók, újságírók és köztisztviselők) fogadása a Kulturális Központ eseményein való részvétel céljából;

7. A közönség tájékoztatása a Küldő Fél országának különböző aspektusairól (ideértve népét, kultúráját, történelmét, nyelvét és képzőművészetét);

8. Kulturális adatbázisok létrehozása információ-megosztási céllal;

9. Közhasználatú könyvtárak, film- és audiovizuális forrástárak, vetítőtermek és információs pultok kialakítása;

10. Nyomtatott és audiovizuális anyagok (ideértve könyvek, brosúrák, katalógusok, újságok, folyóiratok és digitális médiaeszközök) térítésmentes terjesztése és kölcsönzése;

11. Nyomtatott, audiovizuális és digitális anyagok, kulturális, oktatási és tudományos jellegű tartalmak (ideértve könyvek, brosúrák, katalógusok, újságok, folyóiratok, digitális médiaeszközök, televízió- és rádióprogramok, internetes tartalom) létrehozása, kiadása, vagy a létrehozásban, illetve a kiadásban való közreműködés;

12. Nyelvtanfolyamok, szemináriumok, versenyek szervezése, a Küldő Fél nyelvéből nyelvvizsga-bizonyítványok kiállítása, nyelvvizsgák szervezése;

13. Tanfolyamok, szemináriumok, versenyek szervezése a Küldő Fél országának különböző aspektusairól (ideértve a nyelvet, az irodalmat, a kultúrát, a történelmet, a gasztronómiát és a kézművességet), továbbá oklevelek és díjak kiadása a szervezett tanfolyamok, szemináriumok és versenyek kapcsán;

14. A Küldő Félnek a Fogadó Fél országában található kulturális öröksége védelmét, kutatását és népszerűsítését célzó munka és tevékenységek végzése, vagy ennek támogatása, kiemelve, hogy a Kulturális Központok a Felek kultúrája, nemzetközi kulturális kapcsolatai és a kapcsolattörténete tárgykörében tudományos kutatásokat és tanulmányokat folytathatnak és koordinálhatnak;

15. A Kulturális Központok programjain keresztül ösztöndíjak odaítélése és tanulmányutak szervezése; anyagi támogatás, tanárok, könyvek és egyéb oktatási anyagok biztosítása a Fogadó Fél országa iskoláinak, egyetemeinek és kutatóintézeteinek szervezeti egységei és programjai részére, amelyek célja a Küldő Fél országa különböző aspektusainak (ideértve kultúráját, történelmét, nyelvét és irodalmát) oktatása és kutatása;

16. A Fogadó Fél diplomáciai úton megadott előzetes hozzájárulásának függvényében a Kulturális Központ feladataival összhangban álló más jellegű tevékenységek és rendezvények szervezése;

17. A Felek általános történelme, művelődés- és tudománytörténete szempontjából releváns, a Fogadó Fél országában található levéltári, könyvtári és közgyűjteményi adatok felkutatásának támogatása.

(2) A Kulturális Központok fenti oktatási tevékenységeinek tartalma, programja és időtartama, valamint az alkalmazandó oktatók szakmai képesítése és az ezekhez a tevékenységekhez felhasznált tananyag vonatkozásában a Küldő Fél hatályos jogszabályai az irányadók.

14. cikk

(1) A Kulturális Központok nem végezhetnek profitorientált tevékenységet.

(2) A Kulturális Központok ugyanakkor, feladataik ellátása érdekében, és a Fogadó Fél hatályos jogszabályaival összhangban nonprofit alapon bevételszerző tevékenységet folytathatnak az alábbi területeken:

1. díjak szedése a tevékenységeiken és rendezvényeiken résztvevőktől vagy a szolgáltatásaik kedvezményezettjeitől (jegyeladás a kulturális rendezvényeikre, díjak felszámítása a könyvtári és információs pulti szolgáltatásokért), és díjak szedése a tanfolyamokért és a vizsgákért;

2. bármilyen nyomtatott vagy audiovizuális anyag, valamint kulturális és folklórcikkek (könyvek, katalógusok, folyóiratok, CD/CD-ROM, oktatási anyagok, poszterek és kézműves termékek) forgalmazása, feltéve, hogy az értékesítést maga a Kulturális Központ végzi;

3. a tevékenységek és rendezvények résztvevőinek és látogatóinak kiszolgálása céljából az adott ország hagyományos kultúráját és életmódját képviselő teázó vagy kávézó létrehozása és üzemeltetése, illetve természetes személy vagy jogi személy üzemeltetésébe adása a saját helyiségekben vagy ezeken kívül;

4. jótékonysági vásárok és hasonló jótékonysági események szervezése saját helyiségeikben vagy azokon kívül.

III. Fejezet

A Kulturális Központok személyzete

15. cikk

Mindkét Szerződő Fél maga választja saját Kulturális Központja személyzetének tagjait (a továbbiakban: „Személyzet”). A Személyzet kizárólag a Küldő Fél, a Fogadó Fél és – a Fogadó Fél diplomáciai úton megadott előzetes jóváhagyásával – harmadik országok állampolgáraiból állhat.

16. cikk

(1) Mindkét Szerződő Fél maga gondoskodik saját Kulturális Központja személyzetének alkalmazásáról.

(2) A kinevezést a Felek kötelesek egyeztetni a Fogadó Fél illetékes hatóságaival és a kinevezésre vonatkozóan kötelesek betartani a lakóhely szerinti országban hatályos munkajogi rendelkezéseket.

(3) A Kulturális Központok Igazgatóját és Igazgatóhelyettesét a Küldő Fél illetékes hatóságai nevezik ki. Az Igazgató és az Igazgatóhelyettes viszonossági alapon diplomata státuszt kap, feltéve, hogy nem a Fogadó Fél állampolgára. A Felek a kinevezésekről és a státuszról diplomáciai levélváltás útján értesítik egymást.

17. cikk

A Küldő Fél diplomáciai úton tájékoztatja a Fogadó Felet a Személyzet valamennyi tagjának a Fogadó Fél országában való munkavállalásának kezdő és záró időpontjáról, valamint az országba való első belépése és végleges távozása időpontjáról, állampolgárságtól függetlenül.

18. cikk

(1) A Fogadó Fél országa hatályos jogszabályainak keretei között a lehető legrövidebb idő alatt, díjmentesen többszöri be- és kiutazásra jogosító vízumot és tartózkodási engedélyt állít ki a kinevezés időtartamára a Küldő Fél, valamint az előzetesen jóváhagyott harmadik ország állampolgárságával rendelkező kinevezett személyzet és eltartott családtagjaik részére.

(2) A Fogadó Fél mentesíti a munkavállalási engedély követelménye alól a Küldő Fél, valamint az előzetesen jóváhagyott harmadik ország állampolgárságával rendelkező személyzetet, feltéve, hogy őt a Kulturális Központ adminisztratív részlege alkalmazza, vagy a jelen Egyezmény 13. cikkében meghatározott tevékenységeket végzi.

(3) A jelen Egyezmény 13. cikkében meghatározott tevékenységekhez megadott mentesség a munkavállalással összefüggő tevékenységek időtartamára korlátozódik.

19. cikk

(1) Amennyiben a Felek között nincs hatályban munkaügyi és társadalombiztosítási megállapodás, a Küldő Fél állampolgárságával rendelkező Személyzetre és eltartott családtagjaikra a Küldő Fél hatályos munkaügyi és társadalombiztosítási jogszabályai vonatkoznak, feltéve, hogy nem rendelkeznek egyidejűleg a Fogadó Fél állampolgárságával is, és a Kulturális Központban való alkalmazásukat megelőzően nem tartózkodtak állandó jelleggel a Fogadó Fél országában.

(2) Amennyiben a Felek között hatályban van munkaügyi és társadalombiztosítási megállapodás, úgy e cikk alkalmazásában ennek a megállapodásnak a rendelkezései irányadók a Személyzet tagjaira és eltartott családtagjaikra.

20. cikk

(1) A Személyzetre a Felek között hatályban lévő, „A Magyar Köztársaság és a Török Köztársaság között a kettős adóztatás elkerülésére a jövedelemadók területén” Budapesten, 1993. március 10-én aláírt Egyezmény rendelkezéseit kell alkalmazni a jövedelemadó és a tőkejövedelmek tekintetében.

(2) A Központ harmadik országbeli illetőséggel bíró Személyzetének jövedelemadójára vonatkozóan a Fogadó Fél és a harmadik ország között a jövedelem- és vagyonadók területén a kettős adóztatás elkerüléséről kötött egyezmény rendelkezései az irányadók.

21. cikk

A Kulturális Központok kötelesek a Fogadó Fél illetékes hatóságainak megadni az általuk a Fogadó Fél adóztatási gyakorlatának keretében kért szükséges tájékoztatást.

22. cikk

A Személyzet eltartott családtagjai közé tartozik a házastárs, a 18 év alatti egyedülálló gyermek, a középfokú vagy szakiskolában tanulmányokat folytató / programban résztvevő 20 év alatti egyedülálló gyermek, felsőfokú tanulmányokat folytató 25 év alatti egyedülálló gyermek, fogyatékkal élő, bármilyen életkorú egyedülálló gyermek, valamint a Személyzet tagja által eltartott szülő.

IV. Fejezet

A Kulturális Központok adómentessége

23. cikk

(1) A Fogadó Fél – hatályos jogszabályainak keretein belül – engedélyezi a Kulturális Központ működtetéséhez és felszereléséhez szükséges valamennyi berendezés, bútor és anyag vámterhektől, egyéb adóktól és a vámterhekhez hasonló hatályú pénzügyi terhektől mentes behozatalát, ideértve a jelen Egyezmény 13. és 14. cikke szerinti tevékenységek végzéséhez szükséges valamennyi írásos és digitális médiaeszközt is.

(2) A fent említett ingóságok kizárólag a Fogadó Fél illetékes hatóságai által meghatározott feltételekkel értékesíthetők, adhatók bérbe, adhatók térítésmentesen kölcsön, adhatók ingyenesen át és zálogosíthatók el.

(3) A Fogadó Fél – hatályos jogszabályainak keretein belül – engedélyezi a Kulturális Központok számára a konferenciákhoz és hasonló rendezvényekhez, illetve kulturális tevékenységekhez (nevezetesen: színházi előadás, fesztivál és kiállítás, tudományos kutatási projektek és sporttevékenységek) szükséges ingóságok vámterhektől, egyéb adóktól és a vámterhekhez hasonló hatályú pénzügyi terhektől mentes ideiglenes behozatalát.

24. cikk

(1) A Kulturális Központok mentesek valamennyi adó alól, beleértve az alábbiakat:

a. A Kulturális Központ tulajdonában álló és általa a tevékenységi körében használt földtulajdonra, építési telkekre és épületekre kivetett ingatlanadó;

b. Földterület, építési telek vagy épületek Kulturális Központok általi visszterhes megvásárlásához, térítésmentes megszerzéséhez vagy eladásához kapcsolódó illetékek, díjak és más hasonló adók;

(2) A 14. cikkben említett tevékenységek esetében az (1) bekezdésben foglalt mentesség az általános forgalmi adóra nem vonatkozik.

V. Fejezet

Záró rendelkezések

25. cikk

A jelen Egyezmény értelmezésével és végrehajtásával kapcsolatos nézeteltéréseket a Felek diplomáciai úton rendezik.

26. cikk

A jelen Egyezmény azon utolsó írásbeli értesítés kézhezvételét követő harmincadik napon lép hatályba, amelyben a Felek diplomáciai úton tájékoztatják egymást, hogy lefolytatták a ratifikációhoz szükséges nemzeti jogi eljárásokat. Az Egyezmény attól a naptól számított 6 hónapig marad hatályban, amikor valamelyik Fél írásban értesíti a másik Felet felmondási szándékáról.

27. cikk

A jelen Egyezmény rendelkezései a megszűnésének időpontjában még folyamatban lévő projektekre és tevékenységekre külön megállapodás megkötését követően érvényesek maradnak.

28. cikk

(1) A jelen Egyezmény nem befolyásolja Magyarország Európai Uniós tagságából fakadó kötelezettségeket.

(2) Magyarország az Európai Unió tagállamaként kizárólag az uniós joggal összhangban biztosíthat vámpreferenciákat.

(3) Törökország az ezen Egyezmény preambulumában megfogalmazott reciprocitás elve alapján alkalmazza ezen Egyezmény cikkelyeit.

29. cikk

(1) A jelen Egyezmény a Felek közös megállapodása alapján bármikor módosítható. A módosítások az Egyezmény 26. cikkében rögzített eljárás szerint lépnek hatályba.

(2) A jelen Egyezmény Isztambulban, 2013. november 15-én került aláírásra két példányban, magyar, török és angol nyelven, amely szövegek mindegyike egyaránt hiteles. A jelen Egyezmény értelmezésével kapcsolatos eltérések esetén az angol nyelvű szöveg az irányadó.

AGREEMENT BETWEEN THE GOVERNMENT OF HUNGARY
AND THE GOVERNMENT OF THE REPUBLIC OF TURKEY ON THE ESTABLISHMENT, FUNCTIONING AND ACTIVITIES OF CULTURAL CENTRES

The Government of Hungary and the Government of the Republic of Turkey (hereinafter referred to as the „Parties”);

With the purpose of strengthening friendship and cooperation between the Parties;

Based on the principles of mutuality and reciprocity;

Concerning the reciprocal establishment of cultural centres and their functioning and activities have agreed on the following:

Section I

Basic Provisions

Article 1

(1) The Hungarian Party shall establish a cultural centre in Istanbul and the Turkish Party shall establish a cultural centre in Budapest (hereinafter referred to as the „Cultural Centres”),

(2) The Cultural Centres are established as the Cultural Sections of the Embassy of Hungary in the Republic of Turkey and the Embassy of the Republic of Turkey in Hungary.

(3) The Cultural Centres shall engage in activities of cultural diplomacy in accordance with the laws and regulations of the Receiving Party and the Sending Party.

(4) The establishment, functioning and activities of the Cultural Centres shall be subject to the provisions of this Agreement. Concerning matters which are not foreseen in this Agreement, the laws and regulations of the Receiving Party shall apply.

(5) For the purposes of this Agreement the „Receiving Party” shall mean the country on the territory of which the cultural centre is established; the „Sending Party” shall mean the country which establishes a cultural centre on the territory of the other country.

(6) The establishment and closing, the drafting of the statutes, the selection of the personnel, the composition of the organisation, as well as the decision making and correspondence procedures of the Cultural Centres shall be subject to the laws and regulations of the Sending Party. The Cultural Centres will have the authority to determine the rules and procedures on the said matters without being subject to any requirement of authorization or approval by the authorities of the Receiving Party.

(7) The Cultural Centres shall not have any purpose nor engage in any activity that is not foreseen in articles 5, 13 and 14 of this Agreement or which differs from the activities foreseen in these articles. Furthermore, they shall not be engaged in any activities explicitly forbidden by the laws and regulations of the Receiving Party.

(8) The Cultural Centres and their personnel, regardless of their status and nationality, without prejudice to the privileges and immunities foreseen in this Agreement, in case they engage in an activity or commit an act that constitutes an offence under the laws and regulations of the Receiving Party shall be subject to the legal procedure foreseen in the laws and regulations of the Receiving Party.

Article 2

(1) The Cultural Centre of the Hungarian Party shall bear the name of „Hungarian Institute in Istanbul”. The Hungarian Institute in Istanbul shall be administered and supervised by the Balassi Institute, the administrative headquarters of which are located in Budapest.

(2) The Cultural Centre of the Turkish Party shall bear the name of „Yunus Emre Turkish Cultural Centre”. Yunus Emre Cultural Centre shall be established and administered by the „Yunus Emre Foundation”, which has foundation status under the legislation of the Turkish Party and the administrative headquarters of which are located in Ankara.

Article 3

Each Party shall allow, based on mutual consent of the Parties to be reached by means of diplomatic correspondence, the establishment of branches of the Cultural Centre on its territory in cities other than the ones mentioned in Article 1 of this Agreement. The establishment of branches shall be subject to a separate agreement, which cannot contradict the provisions of this Agreement. Such branches of the Cultural Centre shall also be subject to the provisions foreseen for the Cultural Centres in this Agreement.

Article 4

(1) The Cultural Centres shall enjoy legal personality and capacity under the laws and regulations of the Receiving Party.

(2) The Cultural Centres, accordingly, for the fulfilment of their purposes and in compliance with the laws and regulations of the Receiving Party, shall be able to conclude contracts with all state organs, local governments, civil society organisations, natural and legal persons, residing/registered in the country of the Receiving Party.

Article 5

The Cultural Centres shall serve the below purposes:

1. To promote mutual understanding and friendship between the peoples of the Parties;

2. To contribute to the development of relations and co-operation between the Parties in the fields of culture, education and science;

3. To organize educational events in order to spread and promote the language, culture, history and art of the Sending Party;

4. To assist the implementation of this Agreement as well as of other agreements, protocols or programmes/projects in the field of cultural, educational and scientific cooperation between the Parties.

Article 6

(1) Based on the principles of reciprocity, the Parties shall explore the possibilities of allocating suitable premises or land for the Cultural Centres and to their branches. Whereas the reciprocal allocation of premises or land shall not be possible, the Receiving Party shall make all efforts to assist the Sending Party in finding suitable premises or land for the Cultural Centre and its branches.

(2) The Receiving Party, within the framework of its own laws and regulations, shall make all efforts to assist the Cultural Centre and its branches in obtaining necessary permits and completion of necessary legal requirements at the briefest delay possible. The Receiving Party shall make all efforts to facilitate the administrative process related to the buying, renting or allocation, construction and renovation or rearrangement of the premises to be used by the Cultural Centre and its branches.

Article 7

The Cultural Centres, for the fulfilment of their purposes and in compliance with the laws and regulations of the Receiving Party, may also perform activities or organize events outside their premises.

Article 8

For the cultural events to be organized by the Cultural Centre, the Receiving Party shall, if possible, make all efforts in identifying venues available free of charge which are under the authority of its Ministry responsible for culture or other central or local public institutions, provided that at least 3 months prior to the beginning of the event a written request is submitted by the Cultural Centre and that the venue is available for the date/s requested.

Article 9

(1) The Cultural Centres, for the fulfilment of their purposes, as well as during the organisation of the programmes listed in this Agreement may enter into direct contact with all state organs, local governments, civil society organisations, natural and legal persons, residing/registered in the country of the Receiving Party.

(2) The Cultural Centres, for the fulfilment of their purposes and in compliance with the laws and regulations of the Receiving Party, may receive from and provide to all civil society organisations, natural and legal persons, in kind and financial contributions.

Article 10

(1) The Receiving Party shall, unless there is a threat to the security, provide free and unhindered public access to the Cultural Centre’s premises and similarly free and unhindered participation to the events organized by the Cultural Centre outside its premises. This provision shall be without prejudice to the rights of the Cultural Centres foreseen by Article 14.

(2) The Cultural Centre, in compliance with laws and regulations of the Receiving Party may also make use of all available methods and means of communication, including mass media, newspapers, periodicals, radio and television channels and the Internet, for providing information to the public.

Article 11

Security of the Cultural Centre and its branches as well as of their personnel shall be ensured by the Receiving Party if so requested. The Receiving Party shall also take the adequate security measures for the activities to be organised by the Cultural Centre and its branches outside their premises.

Article 12

(1) The Receiving Party, within the framework of its own laws and regulations and the principle of mutuality and reciprocity, shall provide to the Cultural Centre and its branches, in addition to those stated above, all other conditions and convenience necessary for their proper functioning and the fulfilment of their purposes.

(2) The Receiving Party shall accordingly also facilitate the issuance of entry visas to the nationals of the Sending Party for their participation in the events organized by the Cultural Centre.

Section II

Activities of the Cultural Centres

Article 13

(1) The Cultural Centres, for the fulfilment of their purposes and in compliance with the laws and regulations of the Receiving Party, may perform the below mentioned activities:

1. Organising conferences and other similar meetings as well as cultural events such as concerts, theatre performances and exhibitions;

2. Organising forums and festivals as well as ceremonies, including commemorations of national days,

3. Participation in and contributing to the events, programmes and projects undertaken by the Parties or by a third country;

4. Screening of movies and other audio-visual material;

5. Organising visits and exchanges programs between the countries of the Parties, including visit of artists, writers, scientists, researchers, academicians, students, journalists and public officials as well as exchange of academicians and students;

6. Receiving from abroad persons, such as artists, writers, scientists, academicians, journalists and public officials, for participation in the events of the Cultural Centre;

7. Presentation to the public information on diverse aspects of the country of the Sending Party, such as its people, culture, history, language and fine arts;

8. Creation of cultural databases for information sharing;

9. Establishment for public use of libraries, film and audio-visual resources centres and screening halls and information desks;

10. Distribution and lending free of charge of any kind of printed and audio-visual material, including books, brochures, catalogues, newspapers, periodicals and digital media means;

11. Production or publishing or contributing to the production or publishing of any kind of printed, audio-visual and digital material and content of cultural, educational and scientific nature, including books, brochures, catalogues, newspapers, periodicals, digital media means, TV/radio programmes and Internet content;

12. Holding of language courses, seminars, contests and issuance of proficiency certificates on the language of the Sending Party through organisation of examinations;

13. Organising courses, seminars or contests on various aspects of the country of the Sending Party, including the language, literature, culture, history, gastronomy and handicrafts and issuance of certificates and prizes in connection with such courses, seminars or contests;

14. Realisation or supporting the realisation of works and activities aimed for protection, research and promotion of the cultural heritage of the Sending Party located in the country of the Receiving Party; stressing that the Cultural Centres may conduct and coordinate scientific research concerning the Parties’ culture, international cultural relations and studies as well as the history of relations;

15. Granting scholarships and research trips through the programmes of the Cultural Centres; supporting by means of providing financial assistance, teaching staff, books and other educational material, the departments and programs in schools, universities and research organizations in the country of the Receiving Party aiming at teaching and holding researches on various aspects of the country of the Sending Party, as its culture, history, language and literature;

16. Subject to prior consent of the Receiving Party through diplomatic channels, realisation of other kinds of activities and events which are compatible with the purposes of the Cultural Centre;

17. Support for the location of data concerning the general history of the Parties, as well as their history of education and science kept in the archives, libraries and public collections in the country of the Receiving Party.

(2) The content, program and duration of the above stated educational activities of the Cultural Centres as well as the professional qualifications of the teaching personnel to be employed and the educational material to be used for such activities shall be subject to the laws and regulations of the Sending Party.

Article 14

(1) The Cultural Centres shall not engage in profit seeking activities.

(2) The Cultural Centres, on the other hand, for the fulfilment of their purposes and in compliance with the laws and regulations of the Receiving Party, may engage in income generating activities on a not-for-profit basis in the following areas:

1. collect fees from those participating in their activities and events, or from those benefiting from their services, including selling tickets for cultural events, charging fees for library and information desk services and collecting fees for courses and examinations; .

2. sell any kind of printed and audio-visual material as well as cultural and folkloric items, including books, catalogues, periodicals, CD/CD-ROM, educational materials, posters and handicrafts, provided that the sale is carried out by the Cultural Centre itself;

3. set up and manage or give to the management of a person or private company, tea or coffee shops representing the traditional culture and lifestyle of the country, inside or outside of their premises in order to provide services to the participants in their activities and events as well as to visitors;

4. organize charity bazaars and similar charity events inside or outside their premises.

Section III

Personnel of the Cultural Centres

Article 15

Each Party shall appoint the personnel to be employed in its own Cultural Centre (hereinafter referred to as the „Personnel”). The Personnel may be composed of nationals of the Sending Party, nationals of the Receiving Party and, if previously approved by the Receiving Party, of nationals of a third country. The consent of the Receiving Party for the employment of a national of a third country shall be requested through diplomatic channels by the Sending Party.

Article 16

(1) Each Party deals with the employment of the Personnel of its own Cultural Centre.

(2) The appointment shall be agreed with the competent bodies of the Receiving Party and shall be made in keeping with the provisions of the regulations on the employment on the territory of the Party of residence.

(3) The Director and the Assistant Director of the Cultural Centre are appointed by the authorities of the Sending Party and enjoy diplomatic status, on a reciprocal basis, provided that they are not citizens of the Receiving Party. The Parties notify accordingly their appointment and status through diplomatic channels.

Article 17

The Sending Party shall, through diplomatic channels, provide information to the Receiving Party, regarding dates of beginning and termination of employment as well as of first entry to and definitive exit from the country of the Receiving Party of each member of its Personnel, regardless of her/his nationality.

Article 18

(1) The Receiving Party, within the framework of its laws and regulations, shall provide to the appointed Personnel who are nationals of the Sending Party, the previously approved nationals of a third country and to their dependent family members, for the period of the appointment, multiple entry/exit visas and residence permits, at the briefest delay possible and free of charge.

(2) The Receiving Party shall also exempt the Personnel who are nationals of the Sending Party and the previously approved nationals of a third country from the requirement of obtaining a working permit, provided that such Personnel are employed in the administration of the Cultural Centre or for the accomplishment of the activities stated in article 13 of this Agreement.

(3) Such exemption to be granted for the realisation of the activities stated in article 13 of this Agreement shall be limited to the duration of the activities subject to the employment.

Article 19

(1) In case an agreement on labour and social security between the Parties is not in force, the Personnel and their dependent family members who are nationals of the Sending Party shall be subject to the labour and social security laws and regulations of the Sending Party, provided that such Personnel and dependent family members do not possess at the same time the nationality of the Receiving Party and have not been residing in the Receiving Party’s country on a permanent basis prior to employment at the Cultural Centre.

(2) In the case an agreement on labour and social security is in force between the Parties, then the provisions of such agreement shall be applicable to the Personnel and dependent family members under the scope of this article.

Article 20

(1) The provisions of the Agreement between the Republic of Hungary and the Republic of Turkey for the avoidance of double taxation with respect to taxes on income signed in Budapest on 10 March 1993 in force between the Parties shall be applicable to the taxes on income and capital gains of the Personnel.

(2) The taxes on income of the Centre’s Personnel resident of a third country shall be regulated by the agreement on the avoidance of double taxation with respect to taxes on income and capital between the Receiving Party and the third country.

Article 21

The Cultural Centres shall provide necessary information requested by the relevant authorities of the Receiving Party in the framework of the taxation practices of the Receiving Party.

Article 22

Dependent family members of the Personnel shall comprise their spouse, unmarried children who have not completed the age of 18, unmarried children pursuing secondary or vocational level studies/programmes who have not completed the age of 20, unmarried children pursuing higher education studies who have not completed the age of 25, unmarried disabled children of any age as well as mother and father of the Personnel whose living are provided by the Personnel.

Section IV

Tax Immunities of the Cultural Centres

Article 23

(1) The Receiving Party, within the framework of its laws and regulations, shall allow all kinds of equipment, furniture, and material required to operate and equip the Cultural Centre, including all kinds of written or digital media means for the accomplishment of the activities stated in Articles 13 and 14 of this Agreement, to be imported by the Cultural Centre exempt from customs duties and other taxes or financial burdens having the same effect as customs duties.

(2) The above-mentioned goods shall not be sold, hired, lent for free, gratuitously transferred and collateralised, except under the conditions established by the competent authorities of the Receiving Party.

(3) The Receiving Party, within the framework of its laws and regulations, shall allow the Cultural Centres to temporarily import the goods related to the conferences and other similar meetings, cultural activities such as theatre performance, festival and exhibition, scientific research projects and sport activities exempt from customs duties and other taxes or financial burdens having the same effect as customs duties.

Article 24

(1) Cultural Centres have exemption from all taxes including the following:

a. Real-estate taxes on the land, building plots and buildings in the possession of and used by the Cultural Centre within the framework of its activities;

b. Stamp duty, fees and similar taxes related to the purchasing and selling by the Cultural Centres, for money or free of charge, of land, building plots and buildings;

(2) In the case of the activities mentioned in Article 14, the exemption mentioned in paragraph (1) does not cover value added tax.

Section V

Final Provisions

Article 25

Disagreements that may arise on the interpretation and implementation of this Agreement shall be settled through diplomatic channels.

Article 26

This Agreement shall enter into force on the thirtieth day following the receipt of the last written notification by which the Parties inform each other, through diplomatic channels, that they have fulfilled their national legal procedures for ratification, and shall remain in force unless one of the Parties notifies the other in writing at least 6 months in advance of its intention to terminate it.

Article 27

Provisions of this Agreement shall continue to be valid for projects and activities not yet completed on the date of its termination for the period for which it was concluded.

Article 28

(1) This Agreement shall not affect any obligations originating from the European Union membership of Hungary.

(2) Hungary as member state of the European Union can only provide custom preferences as far as it is allowed by the law of the European Union.

(3) Turkey can apply the Articles of this Agreement on the basis of reciprocity as stated in the Preamble of this Agreement.

Article 29

(1) This Agreement may be amended at any moment through mutual consent of the Parties and such changes shall come into force according to the procedure stipulated in the Article 26 of this Agreement.

(2) Done on November 15, 2013, in Istanbul, in duplicate, in the Hungarian, Turkish and English languages, all texts being equally authentic. In case of difference of interpretation the English text shall prevail.

4. § (1) E törvény – a (2) bekezdésben meghatározott kivétellel – a kihirdetését követő napon lép hatályba.

(2) A 2. § és a 3. § az Egyezmény 26. cikkében meghatározott időpontban lép hatályba. * 

(3) Az Egyezmény, illetve a 2. § és a 3. § hatálybalépésének naptári napját a külpolitikáért felelős miniszter – annak ismertté válását követően – a Magyar Közlönyben haladéktalanul közzétett közleményével állapítja meg. * 

(4) *  E törvény végrehajtásához szükséges intézkedésekről a külpolitikáért felelős miniszter gondoskodik.
