2015. évi CXCVIII. törvény

a Magyarország és a Kazah Köztársaság között a kölcsönös bűnügyi jogsegélyről szóló egyezmény kihirdetéséről * 

1. § Az Országgyűlés e törvénnyel felhatalmazást ad a Magyarország és a Kazah Köztársaság között a kölcsönös bűnügyi jogsegélyről szóló egyezmény (a továbbiakban: Egyezmény) kötelező hatályának elismerésére.

2. § Az Országgyűlés az Egyezményt e törvénnyel kihirdeti.

3. § Az Egyezmény hiteles angol és magyar nyelvű szövege a következő:

„TREATY BETWEEN HUNGARY AND THE REPUBLIC OF KAZAKHSTAN ON MUTUAL LEGAL ASSISTANCE IN CRIMINAL MATTERS

Hungary and the Republic of Kazakhstan, hereinafter referred to as the „Parties”,

Desiring to promote an effective cooperation between the two States in combating crime on the basis of mutual respect for sovereignty and equality,

Considering that this purpose can be achieved through the conclusion of a bilateral Treaty, which establishes the procedure for provision of legal assistance in criminal matters,

Have agreed as follows:

Article 1

Scope

1. In accordance with the provisions of this Treaty, the Parties undertake, upon requests, to afford one another mutual legal assistance in criminal proceedings in respect of offences the punishment of which, at the time of the request for assistance, falls within the jurisdiction of the competent judicial authorities of the Requesting Party.

2. Such legal assistance shall include:

a) locating and identifying persons or items;

b) serving documents and records relating to criminal proceedings;

c) summoning witnesses, victims, suspects, accused persons and experts to appear voluntarily before the competent judicial authority of the Requesting Party;

d) obtaining and providing documents, records and evidence;

e) carrying out hearings and taking evidence;

f) temporary transferring persons in custody for their testimony, or taking part in other procedural activities;

g) carrying out judicial expertise, examining documents or items;

h) search, seizure of evidence and confiscation of assets;

i) exchanging information on national law;

j) without prejudice to paragraph 3 of this Article, any other legal assistance, which is not contrary to the national law of the Requested Party.

3. This Treaty shall not apply to:

a) the execution of judicial decisions on the arrest of a person, or any other measure restricting the freedom of a person;

b) the extradition of a person;

c) the execution of criminal judgments, with the exception of decisions on confiscation;

d) the transfer of a sentenced person for the purpose of serving sentence; and

e) the transfer of criminal proceedings.

Article 2

Double criminality

Legal assistance shall be afforded in proceedings initiated in respect of such offences, which are also punishable under the national law of the Requested Party.

Article 3

Refusal or postponement of legal assistance

1. The Requested Party shall refuse entirely or in part the requested legal assistance if:

a) the execution of the request is contrary to its national law or to the provisions of this Treaty;

b) there are reasonable grounds to believe that the request for legal assistance is made in order to prosecute, punish or be otherwise detrimental to a person on account of his religion, sex, race, nationality or political opinion, or that such person’s position may be prejudiced by any of those reasons;

c) in the Requested Party criminal proceedings are already initiated or final judgment is already rendered with respect to the same person for the same offence as indicated in the request;

d) the execution of the request is likely to prejudice the sovereignty, security, public order or other essential interests of the Requested Party or its consequences would be contrary to the fundamental principles of its national law;

e) the investigation or criminal proceedings are related to:

i. an offence which the Requested Party considers to be a political offence or an offence in connection with a political offence; or

ii. a purely military offence which does not constitute an offence under ordinary criminal law.

2. The Requested Party may postpone the execution of the request if it interferes with ongoing criminal proceedings in its territory.

3. Before refusing a request or postponing its execution, the Requested Party shall consider whether the legal assistance may be granted upon specific conditions. To this end, the central authorities of the Parties, designated pursuant to Article 4 of this Treaty, shall consult with each other, and if the Requesting Party consents, the legal assistance shall be granted with the agreed conditions.

4. When the Requested Party refuses the legal assistance or postpones its execution, it shall inform the Requesting Party in writing on the reasons for such refusal or postponement.

Article 4

Central authorities

1. For the purposes of this Treaty, requests for legal assistance shall be submitted through the central authorities designated by the Parties.

The central authorities are:

- for Hungary: the Minister responsible for justice and the Prosecutor General;

- for the Republic of Kazakhstan: the Prosecutor General’s Office.

2. The Parties shall inform each other on any changes of central authorities through diplomatic channels.

3. For the purposes of this Treaty, the central authorities shall communicate directly with each other.

Article 5

Form and content of the requests

1. The request shall be made in writing, and be signed and stamped by the competent judicial authority of the Requesting Party.

2. The request for legal assistance shall include the following:

a) the name of the competent judicial authority of the Requesting Party;

b) a description of the facts of the offence including the time and place of its commission and the damage caused, if any;

c) indication of the applicable national law provisions, including the provisions of the statute of limitations and the extract from the criminal law, stipulating responsibility for an offence for which the legal assistance is requested;

d) description of the requested activities;

e) in cases of proven urgency, an indication of time limit within which the request should be executed;

f) indication of the persons whose presence is necessary at the execution of the request, in compliance with paragraph 3 of Article 6 of this Treaty;

g) information as to the allowance and reimbursements to which the person who is summoned to appear in the Requesting Party, is entitled to;

h) information necessary for taking evidence via videoconference, in compliance with Article 12 of this Treaty.

3. The request - to the necessary extent - shall also include the following:

a) information on the person under investigation;

b) information on the person, whose identity or location is to be determined;

c) information on the identity and residence of the person to whom the service shall be made, as well as the way it should be made;

d) information on the identity and residence of the person who has to give evidence;

e) the location and description of the place or item to be examined;

f) the location and description of the place to be searched, and the indication of the items to be seized or confiscated;

g) the indication of any special procedure sought for giving execution to the request, and the relevant reasons for that;

h) the level of confidentiality, which is required to comply with, and its reasons;

i) any other information which may facilitate the execution of the request.

4. If the Requested Party considers that the content of the request is not sufficient for its execution, it may require further information.

5. The request and the supporting documents submitted pursuant to this Article shall be written in the official language of the Requesting Party, and accompanied by a translation into the official language of the Requested Party or English.

6. Requests for legal assistance and communications related thereto may be made and responded to by expedited means of communications, including fax or e-mail, with subsequent transmission of the original request where required by the Requested Party.

Article 6

Execution of the request

1. The Requested Party shall execute the requests addressed to it by the Requesting Party in accordance with the procedure and in the manner provided for by its national law.

2. When providing legal assistance, the Requested Party may apply, upon request, a particular procedure required by the Requesting Party, to the extent that such procedure is compatible with its national law.

3. Officials of the Requesting Party may be present at the execution of the request, if the Requested Party consents thereto. To this end, the Requested Party shall promptly inform the Requesting Party on the date and place of execution of the request.

4. The Requested Party shall promptly inform the Requesting Party on the results of the execution of the request.

5. If a person, in respect of whom the request is to be executed, before the execution invokes any immunity, privilege or incapacity in accordance with national law of the Requested Party, its competent authority shall make the relevant decision, and communicate it to the Requesting Party.

6. Documents submitted as the execution of the request, shall be made in the official language of the Requested Party and stamped by the competent judicial authority of the Requested Party, which has executed the request.

Article 7

Locating and identifying persons or items

The Requested Party - in compliance with its national law - shall make all efforts to locate the person or item indicated in the request and presumably found in its territory, and inform the Requesting Party on the results.

Article 8

Service of summons and documents

1. The Requested Party - in compliance with its national law - shall use its best efforts to serve the summons and other documents sent by the Requesting Party.

2. The Requested Party after having served the summons and other documents, shall provide the Requesting Party with an attestation of proof of service bearing the signature of the official or stamp of the authority that effected service, and indicating the date, place and method of delivery, as well as information on the person, to whom the documents have been delivered. If the service is not effected, the Requested Party shall promptly inform the Requesting Party and communicate the reasons of failure of service.

3. The request to serve summons to appear before the competent judicial authority of the Requesting Party shall be made within the time limit set in paragraph 2 of Article 10 of this Treaty.

4. The summons to the competent judicial authority of the Requesting Party and the documents to be served shall not be accompanied by any threat of measures compelling appearance in case of failure to appear.

Article 9

Taking of evidence in the Requested Party

1. The Requested Party, in compliance with its national law, shall use its best efforts to take evidence from witnesses, victims, suspects, accused persons, experts or other persons found in the Requested Party, and shall also obtain records, documents and any other evidence indicated in the request, and transmit them to the Requesting Party.

2. The Requested Party shall inform the Requesting Party promptly of the date, place and time where the evidence is taken from persons indicated in paragraph 1 of this Article, also for the purposes of paragraph 3 of Article 6 of this Treaty.

3. The person summoned to give evidence, has the right to refuse to provide it, if the national law of the either Party allows it. To this end, the Requesting Party shall indicate such rights in the request.

4. The Requested Party shall allow the presence of the legal counsel of the summoned person to give evidence, whenever this is provided by the national law of the Requesting Party.

Article 10

Taking of evidence in the Requesting Party

1. The Requested Party, upon request, shall summon persons indicated in subparagraph c) of paragraph 2 of Article 1. The Requested Party shall promptly inform the Requesting Party on the reply of the summoned person.

2. The Requesting Party shall transmit to the Requested Party a request of service of summons to appear before the competent judicial authority of the Requesting Party, not later than sixty days before the date set for appearance, except for urgent cases, when the Requested Party agreed on a shorter period.

3. In its request, the Requesting Party shall indicate the amount of any allowance and reimbursement of expenses the person summoned to appear in the territory of the Requesting Party is entitled to.

Article 11

Guarantees and rule of specialty

1. During the period in which the person stays in the Requesting Party pursuant to Article 10 of this Treaty, he or she

a) shall not be, regardless of his or her nationality, prosecuted or detained or subjected to any other restriction of his or her personal liberty in the territory of that Party in respect of acts committed prior to entering the territory of the Requesting Party;

b) shall not be obliged to give evidence or to participate in any activity relevant to a proceeding different from the one indicated in the request for legal assistance, unless the person concerned gave his or her consent.

2. Paragraph 1 of this Article shall cease to have effect, if the person indicated therein:

a) does not leave the territory of the Requesting Party within forty-five days from the date when he or she has been officially informed that his or her presence is no longer necessary. Such time limit shall not include the period during which the said person has not left the territory of the Requesting Party, for reasons beyond his or her control;

b) after having left the territory of the Requesting Party, voluntarily returns to it.

3. The victim, witness or expert, whose examination is carried out in compliance with Articles 9 and 10 of this Treaty, is responsible for the content of the testimonial evidence or expert report while appearing before the competent judicial authority, in compliance with the respective national laws of the Parties, and is subject to the respective jurisdiction of each Party regarding the committed offence.

Article 12

Hearing by videoconference

1. If a person is in the other Party’s territory and has to be heard as a witness, victim, suspect, accused person or expert, by the competent judicial authorities of the Requesting Party, the latter may request that the hearing take place by videoconference. In addition to the grounds for refusal of legal assistance referred to in Article 3, the hearing by videoconference may also be refused if:

a) the suspect or accused person does not consent; or

b) the execution of such a measure in a particular case would be contrary to the national law of the Requested Party.

2. The practical arrangements regarding the hearing shall be agreed on by the Parties, and the Requested Party shall:

a) summon the person mentioned in paragraph 1 of this Article, to appear for the hearing in accordance with its national law and inform the summoned person about his or her rights under the national law of the Requesting Party;

b) ensure the identification of the person to be heard.

3. During the hearing by videoconference, the following rules shall apply:

a) an official of the competent judicial authority of the Requested Party shall be present and also be responsible for ensuring both the identification of the person to be heard and the respect for the fundamental principles of the national law of the Requested Party. If the Requested Party is of the view that during the hearing the fundamental principles of its national law are being infringed, it shall immediately take the necessary measures to ensure that the hearing continues in accordance with the said principles;

b) where necessary, measures for the protection of the person to be heard shall be agreed on by the Parties;

c) the hearing shall be conducted directly by, or under the direction of, the competent judicial authority of the Requesting Party in accordance with its national law;

d) at the request of the Requesting Party or the person to be heard, the Requested Party shall ensure that the person to be heard is assisted by an interpreter;

e) the person to be heard may claim the right not to testify, in case this right is conferred upon him or her under the national law of either of the Parties; the person concerned shall be informed about this right prior to the hearing;

f) the Requested Party shall allow the presence of the legal counsel of the person to be heard.

4. The Requested Party shall on the conclusion of the hearing draw up minutes indicating the date and place of the hearing, the identity of the person heard, the identities and functions of all other persons in the Requested Party participating in the hearing, any oaths taken and the technical conditions under which the hearing took place. The original of the minutes shall be forwarded to the Requesting Party.

5. Where a witness, victim or expert is being heard by videoconference, in accordance with this Article, and refuses to testify when under an obligation to testify or does not testify according to the truth, the Requested Party shall apply its national law in the same way as if the hearing took place in a domestic procedure.

6. The expenses incurred by the Requested Party in connection with carrying out the videoconference shall be reimbursed by the Requesting Party, unless the Parties agreed otherwise.

7. The Requested Party may allow the use of videoconference technologies also for purposes different from those specified in paragraph 1 of this Article, including to carry out the recognition of persons and items or for confrontations.

Article 13

Temporary transfer of detained persons to appear as witnesses before the competent judicial authorities of the Requesting Party

1. A person in custody whose personal appearance as a witness is requested by the Requesting Party, shall be temporarily transferred to its territory, provided that he or she shall be transferred back within the period stipulated by the Requested Party.

2. Transfer may be refused if:

a) the person in custody does not consent to his or her transfer;

b) his or her presence is necessary at criminal proceedings pending in the Requested Party;

c) the transfer is likely to prolong his or her detention; or

d) there are other overriding grounds for not transferring him or her to the territory of the Requesting Party.

3. The transferred person shall remain in custody in the territory of the Requesting Party and, where applicable, in the territory of the third state through which transit is requested, unless the Requested Party applies for his or her release.

Article 14

Providing official or public documents

1. Upon request, the Requested Party shall provide the Requesting Party with the copies of records or documents which are available to the public, from government agencies or public organizations.

2. The Requested Party may provide copies of records or documents which are not available to the public, from government agencies or public organizations to the extent and under the conditions as such copies would be available to the judicial or law enforcement authorities of the Requested Party. Such copies shall be certified by the competent authority of the Requested Party according to its national law.

Article 15

Providing documents, records or items

1. When the request is related to the transmission of documents or records other than specified in Article 14 of this Treaty, the Requested Party may transmit their copies. If the Requesting Party expressly requests for the transmission of the originals, the Requested Party shall execute the request insofar as possible.

2. The originals of the documents and records, as well as items, transmitted to the Requesting Party, shall be returned to the Requested Party, at the first opportunity, unless the Requested Party waives their return.

Article 16

Search, seizure and security measures

1. The Requested Party, upon request, shall take measures to ascertain the location of the proceeds of crime or items related to the offence on its territory, and communicate the results to the Requesting Party.

2. In case proceeds of crime or items related to the offence are detected, the Requested Party shall upon request adopt any measures provided for by its national law, in order to seize or secure proceeds of crime or items related to the offence.

3. Upon request, the Requested Party shall transfer in whole or in part any of the proceeds of crime or items related to the offence, as well as any sums obtained by the sale of the latter, in accordance with the conditions agreed upon by the Parties.

4. The Requested Party may postpone the handing over of proceeds of crime or items related to the offence, if those are needed in connection with pending domestic proceedings.

5. In the application of this Article, any rights of the Requested Party or third parties with regard to said proceeds from crime or items related to the offence shall be safeguarded.

Article 17

Identification of bank and financial information

1. Upon request, the Requested Party shall in compliance with its national law ascertain whether a person who is suspected of or charged with committing a crime, is the holder of a bank account or accounts at any banks or other financial institutions located in its territory and shall provide the Requesting Party with the relevant information, including information on the identity of the persons authorized to access such accounts, the latter’s locations and any transactions related to them.

2. In addition to the provisions of Article 5 of this Treaty, a request for information specified in paragraph 1 of this Article shall include:

a) the identity of the natural or legal person relevant to locating such accounts or transactions;

b) sufficient information to enable the competent judicial authority of the Requested Party to:

i. reasonably suspect that the natural or legal person concerned has engaged in an offence and that banks or non-bank financial institutions in the territory of the Requested Party may have the information requested;

ii. conclude that the information sought relates to the criminal investigation or proceedings;

c) to the extent possible, any other information which may simplify the execution of the request.

3. The legal assistance referred to in this Article may not be refused on the grounds of bank secrecy.

4. The Requesting Party shall undertake the guarantee that the information received under this Article will be used solely for the purposes of the criminal procedure specified in the request.

Article 18

Exchange of information on criminal proceedings and criminal records

1. Upon request and for the purposes of criminal proceedings, the Requested Party shall transmit to the Requesting Party information on criminal proceedings, previous convictions and sentences imposed against citizens of the Requesting Party in compliance with Article 19 of this Treaty.

2. Information on criminal records, which are necessary to the competent judicial authority of the Requesting Party for the purposes of criminal proceedings, shall be transmitted, if under the same circumstances they could be issued to the competent judicial authority of the Requested Party.

Article 19

Personal data protection

1. Without prejudice to paragraph 2 of this Article, personal data may be gathered and transmitted only if it is necessary and proportionate for the purposes indicated in the request for legal assistance.

2. Personal data transferred to the other Party as a result of the execution of a request made under this Treaty, may be used by the Party to which such data have been transferred for the following purposes exclusively:

a) for the purpose of the criminal proceedings in which the legal assistance was requested under this Treaty;

b) for other judicial and administrative proceedings directly related to the proceedings mentioned under subparagraph a) of this paragraph;

c) for preventing an immediate and serious threat to public security.

3. Such data may also be used for any other purpose if prior consent to that effect has been given by either the Party which transferred the personal data, or by the person who is the subject of the data. The consent shall be given in accordance with the national law of the Party which transmitted the personal data.

4. Any Party may refuse to transfer personal data where such data are protected under its national law, and the same level of data protection cannot be provided by the other Party.

5. Any Party that transfers personal data may require the Party to which the data have been transferred to, give information on the use made with such data.

6. Personal data transferred under this Treaty shall be processed and deleted in line with the national law of the Party which received such data. Irrespective of these limits, the data transferred shall be deleted as soon as they are no longer required for the purpose for which they were transferred.

7. This Article shall not prejudice the ability of the Party which transmits the personal data to impose additional conditions in a particular case when the request for legal assistance could not be executed in the absence of such conditions. Where additional conditions have been imposed in accordance with this paragraph, the Party to which the personal data have been transmitted shall process the received data according to those conditions.

8. Where, following the transmission of personal data, the Party which transmitted them becomes aware of circumstances that would have caused it to impose an additional condition in a particular case, the Parties may consult with each other to determine the extent to which the personal data can be protected.

Article 20

Information on national law

Upon request, the Parties shall exchange information on their respective national laws in effect or which were in effect, and on their respective judicial practice.

Article 21

Exemption from legalization

Documents and records submitted in compliance with this Treaty shall not require any legalization, certification or authentication.

Article 22

Confidentiality

1. The Requested Party shall keep a request and its contents confidential if such confidentiality is requested by the Requesting Party. If the request cannot be executed without breaching the requested confidentiality, the Requested Party shall so inform the Requesting Party, which shall then determine whether the request should nevertheless be executed.

2. Upon the appropriate request of the Requested Party the Requesting Party shall treat any evidence and information obtained during the execution of the request for legal assistance as confidential, except for the cases of the use of evidence and information in the investigation and criminal proceedings.

Article 23

Costs

1. The Parties shall bear the costs associated with the application of this Treaty, in accordance with their national laws.

2. Without prejudice to paragraph 3 of this Article the Requested Party shall bear the costs of the execution of the request.

3. The Requesting Party shall bear the following expenses:

a) travel and accommodation expenses in the Requested Party of the persons indicated in paragraph 3 of Article 6 of this Treaty;

b) travel and accommodation expenses in the Requesting Party of the persons indicated in Article 10 of this Treaty;

c) expenses for videoconference, without prejudice to paragraph 6 of Article 12 of this Treaty;

d) expenses arising from the execution of the request in accordance with Article 13 of this Treaty;

e) expenses and fees of experts;

f) expenses and fees of translation and interpretation and the cost of transcription;

g) expenses of the storage and handing over of the items seized.

4. In the case when the execution of a request entails the expenses of an extraordinary nature, the Parties shall consult with a view to agree the conditions under which the request shall be executed, and the criteria for sharing the relevant costs.

Article 24

Compatibility with international treaties

This Treaty does not affect the rights and obligations of the Parties assumed under any international treaty the Parties are part of and, for Hungary, those assumed as a Member State of the European Union.

Article 25

Settlement of disputes

Any dispute arising during the application or the interpretation of this Treaty, shall be settled by negotiations or diplomatic consultation between the Parties.

Article 26

Entry into force, amendments and termination of the Treaty

1. This Treaty is concluded for an indefinite period of time and shall enter into force on the thirtieth day from the date of receiving the last written notification through diplomatic channels in which the Parties notify each other of the completion of the internal legal procedures necessary for the entry into force of the Treaty.

2. This Treaty may be amended with the consent of the Parties. The changes and amendments shall be made in separate protocols that become integral parts of the Treaty and shall enter into force in accordance with paragraph 1 of this Article.

3. Either Party may terminate this Treaty at any time by written notification to the other Party through diplomatic channels. Termination shall take effect one hundred and eighty days from the date of reception of the notification.

4. In case of termination of this Treaty, requests for legal assistance received during its validity shall be executed in compliance with the provisions of this Treaty.

5. This Treaty shall apply to any request submitted after its entry into force, also if the relevant criminal offences were committed before the entry into force of this Treaty.

IN WITNESS WHEREOF, the undersigned, being duly authorized, have signed this Treaty.

DONE in Astana on 1 April, 2015, in two originals, each in Hungarian, Kazakh and English languages, all texts being equally authentic and have the same legal force.

In case of any divergence in interpretation of this Treaty, the English text shall prevail.

„EGYEZMÉNY MAGYARORSZÁG ÉS A KAZAH KÖZTÁRSASÁG KÖZÖTT A KÖLCSÖNÖS BŰNÜGYI JOGSEGÉLYRŐL

Magyarország és a Kazah Köztársaság, a továbbiakban „a Felek”

Attól az óhajtól vezérelve, hogy hatékony együttműködést alakítsanak ki a két állam között a bűnüldözés terén, szuverenitását és egyenlőségét tiszteletben tartva;

Annak tudatában, hogy e célkitűzés egy olyan kétoldalú egyezmény megkötésén keresztül valósítható meg, amely rögzíti a bűnügyi jogsegély nyújtásával kapcsolatos eljárást;

A következőkben állapodtak meg:

1. cikk

Hatály

1. A Felek kötelezik magukat arra, hogy jelen Egyezmény rendelkezéseinek megfelelően megkeresés alapján jogsegélyt nyújtanak egymásnak az olyan bűncselekményekkel összefüggő büntetőeljárásokban, amelyek büntetése a jogsegélykérelem előterjesztése idején a Megkereső Fél illetékes igazságügyi hatóságainak a joghatósága alá tartozik.

2. Az ilyen jogsegély az alábbiakat foglalja magában:

a) személyek vagy tárgyak felkutatása és azonosítása;

b) a büntetőeljárásokkal kapcsolatos iratok és jegyzőkönyvek kézbesítése;

c) tanúk, sértettek, gyanúsítottak, vádlottak és szakértők idézése, hogy önként jelenjenek meg a Megkeresett Fél illetékes igazságügyi hatósága előtt;

d) iratok, jegyzőkönyvek és bizonyítékok beszerzése és rendelkezésre bocsátása;

e) meghallgatások tartása és bizonyítás felvétele;

f) fogvatartott személyek ideiglenes átadása vallomástétel, illetve más eljárási cselekményben történő részvétel céljából;

g) igazságügyi szakértői vélemény nyújtása, iratok vagy tárgyak megvizsgálása;

h) tárgyak felkutatása, bizonyítékként történő lefoglalása és vagyontárgyak elkobzása;

i) a nemzeti jogszabályokkal kapcsolatos információ cseréje;

j) jelen cikk 3. bekezdését nem érintve, bármely egyéb jogsegély, amely nem ellentétes a Megkeresett Fél nemzeti jogával.

3. Jelen Egyezmény nem alkalmazható az alábbiakra:

a) személy letartóztatását elrendelő bírósági határozat, vagy bármely más, személyi szabadságot korlátozó intézkedés végrehajtása;

b) kiadatás;

c) büntetőítéletek végrehajtása, kivéve az elkobzással kapcsolatos határozatokat;

d) elítélt személyek átadása büntetés végrehajtása céljából;

e) büntetőeljárás átadása.

2. cikk

Kettős büntethetőség

Jogsegély olyan eljárások vonatkozásában nyújtható, amelyek alapjául szolgáló bűncselekmények a Megkeresett Fél nemzeti joga alapján is büntetendők.

3. cikk

A jogsegélykérelem teljesítésének megtagadása vagy elhalasztása

1. A Megkeresett Fél egészben vagy részben megtagadhatja a kérelmezett jogsegély teljesítését, amennyiben:

a) a megkeresés teljesítése nemzeti jogával vagy jelen Egyezmény rendelkezéseivel ellentétes;

b) megalapozottan feltehető, hogy a jogsegélykérelem előterjesztésére azért került sor, hogy a személy ellen a személy faja, neme, vallása, állampolgársága vagy politikai meggyőződése miatt folytassanak le büntetőeljárást, szabjanak ki büntetést, vagy más hátrányos jogkövetkezményt alkalmazzanak, illetve az eljárásban érintett személy helyzete ilyen okból sérülhet;

c) a Megkeresett Fél már büntetőeljárást indított vagy jogerős ítéletet hozott a megkeresésben szereplő ugyanazon személyre vonatkozóan, ugyanazon bűncselekmény vonatkozásában, amelyre vonatkozik;

d) a megkeresés teljesítése sértené a Megkeresett Fél szuverenitását, nemzetbiztonságát, közrendjét vagy egyéb jelentős érdekét, illetve a teljesítés következményei ellentétesek lennének a Megkeresett Fél nemzeti jogának alapelveivel;

e) a nyomozás vagy a büntetőeljárás

i. olyan bűncselekményre vonatkozik, amelyet a Megkeresett Fél politikai bűncselekménynek vagy politikai bűncselekménnyel összefüggő bűncselekménynek tekint; vagy

ii. olyan katonai bűncselekményre vonatkozik, amely nem képez köztörvényes bűncselekményt.

2. A Megkeresett Fél elhalaszthatja a megkeresés teljesítését, amennyiben az a területén folyamatban lévő büntetőeljárásba ütközik.

3. A megkeresés teljesítésének megtagadását vagy elhalasztását megelőzően a Megkeresett Fél mérlegeli, hogy meghatározott feltételek mellett a jogsegély teljesíthető-e. E célból a Felek jelen Egyezmény 4. cikkének megfelelően kijelölt központi hatóságai egyeztetnek egy mással, és amennyiben a Megkereső Fél egyetért, a Megkeresett Fél a jogsegélyt az elfogadott feltételek mellett teljesíti.

4. Amennyiben a Megkeresett Fél megtagadja vagy elhalasztja a megkeresés teljesítését, úgy írásban tájékoztatja a Megkereső Felet a megtagadás vagy elhalasztás okairól.

4. cikk

Központi hatóságok

1. Jelen Egyezmény alkalmazása során a jogsegélykérelmeket a Felek által kijelölt központi hatóságon keresztül kell előterjeszteni.

Központi hatóságok a következők:

- Magyarország részéről: az igazságügyért felelős miniszter és a legfőbb ügyész;

- a Kazah Köztársaság részéről: a Legfőbb Ügyészség.

2. A Felek a központi hatóságok tekintetében bekövetkezett bármiféle változásról diplomáciai úton tájékoztatják egymást.

3. Jelen Egyezmény alkalmazása során a központi hatóságok közvetlenül érintkeznek egymással.

5. cikk

A megkeresés formája és tartalma

1. A megkeresést írásban, a Megkereső Fél illetékes igazságügyi hatóságának aláírásával és pecsétjével ellátva kell elkészíteni.

2. A jogsegélykérelem az alábbiakat tartalmazza:

a) a Megkereső Fél illetékes igazságügyi hatóságának nevét;

b) a bűncselekmény történeti tényállásának leírását, beleértve az elkövetés idejét, helyét és az okozott kárt, ha ilyen keletkezett;

c) az alkalmazandó nemzeti jog rendelkezéseit, amely meghatározza a felelősséget azon bűncselekményre vonatkozóan, amellyel kapcsolatban a jogsegélykérelmet előterjesztették, ideértve az elévülésre vonatkozó szabályokat és a büntető jogszabály kivonatát;

d) a kért eljárási cselekmények leírását;

e) indokolt sürgősség esetén, azon határidőt, amelyen belül a kérelem teljesítendő;

f) azon személyek felsorolását, akiknek jelenléte a kérelem teljesítésekor szükséges, figyelemmel a jelen Egyezmény 6. cikke 3. bekezdésére;

g) azon juttatásokra és költségtérítésekre vonatkozó információkat, amelyekre a Megkereső Fél területén való megjelenésre idézett személy jogosult;

h) a videokonferencián keresztül történő vallomástételhez szükséges információkat, jelen Egyezmény 12. cikkével összhangban.

3. A megkeresésnek - a szükséges mértékben - tartalmaznia kell az alábbiakat is:

a) azzal a személlyel kapcsolatos információkat, aki ellen a nyomozás folyik;

b) információkat azon személyről, akinek a és tartózkodási helye megállapítását kérik;

c) információkat azon személy személyazonosságáról és tartózkodási helyéről, aki számára a kézbesítést kell teljesíteni, valamint a kézbesítés módjáról;

d) információkat azon személy azonosításáról és tartózkodási helyéről, akinek vallomást kell tennie;

e) a megvizsgálandó helyszín vagy tárgyak feltalálási helyét és leírását;

f) az átkutatandó helyszín elhelyezkedését és leírását, és a lefoglalandó vagy elkobzandó tárgyak feltüntetetését;

g) olyan különleges eljárások és az indokok megjelölését, amelyek végrehajtását a megkeresés teljesítése során;

h) a kért bizalmas kezelés szintjét, és annak indokait;

i) bármilyen egyéb információt, amely elősegítheti a megkeresés teljesítését.

4. Amennyiben a Megkeresett Fél úgy véli, hogy a megkeresés tartalma nem elegendő annak teljesítéséhez, úgy további információkat kérhet.

5. A jelen cikk rendelkezése szerint előterjesztett megkeresés és a kísérődokumentumok a Megkereső Fél hivatalos nyelvén készülnek, és azokhoz a Megkeresett Fél hivatalos nyelvén vagy angol nyelven készült fordítást kell csatolni.

6. A jogsegélykérelem előterjesztése, megválaszolása és az ezekkel kapcsolatos kapcsolattartás történhet a gyors tájékoztatást lehetővé kommunikációs eszköz - ideértve a faxot vagy e-mailt is - útján is, amelyet követően a Megkeresett Fél kérelmére a megkeresés eredeti példányát is meg kell küldeni.

6. cikk

Megkeresés teljesítése

1. A Megkeresett Fél a nemzeti joga által meghatározott eljárási szabályok és módszerek szerint teljesíti azokat a megkereséseket, amelyeket a Megkereső Fél intézett hozzá.

2. A megkeresés teljesítése során a Megkeresett Fél - kérelemre - a Megkereső Fél által előírt külön eljárást alkalmazhat, amennyiben az ilyen eljárás összhangban van a nemzeti jogával.

3. A Megkereső Fél hivatalos képviselői jelen lehetnek a megkeresés teljesítése során, amennyiben a Megkeresett Fél ehhez hozzájárul. Ennek érdekében a Megkeresett Fél haladéktalanul tájékoztatja a Megkereső Felet a megkeresés teljesítésének idejéről és helyéről.

4. A Megkeresett Fél haladéktalanul tájékoztatja a Megkereső Felet a megkeresés teljesítésének eredményeiről.

5. Amennyiben az a személy, akire vonatkozóan a megkeresést előterjesztették, a teljesítést megelőzően bármilyen mentességre, kiváltságra vagy cselekvőképtelenségre hivatkozik a Megkeresett Fél nemzeti jogával összhangban, az utóbbi illetékes hatósága határozatot hoz erre vonatkozóan és tájékoztatja arról a Megkereső Felet.

6. A megkeresés teljesítéseként megküldött iratok a Megkeresett Fél hivatalos nyelvén készülnek, és azokat a Megkeresett Fél azon illetékes igazságügyi hatósága, amely a megkeresést teljesítette, ellátja bélyegzőjével.

7. cikk

Személyek vagy tárgyak felkutatása és azonosítása

A Megkeresett Fél - nemzeti jogával összhangban - mindent megtesz a megkeresésben megjelölt és feltehetően területén tartózkodó személy vagy tárgyak felkutatása érdekében, és az eredményről tájékoztatja a Megkereső Felet.

8. cikk

Idézések és iratok kézbesítése

1. A Megkeresett Fél - nemzeti jogával összhangban - megtesz minden tőle telhetőt a Megkereső Fél által küldött idézések és egyéb iratok kézbesítése érdekében.

2. A Megkeresett Fél az idézések és más iratok kézbesítését követően a kézbesítést teljesítő hivatalos személy aláírásával vagy hatóság pecsétjével ellátva megküldi a kézbesítésről szóló igazolást a Megkereső Félnek, megjelöli az átadás időpontját, helyét és módját, valamint tájékoztatást ad azon személyről, akinek az iratokat átadták. Ha a kézbesítés nem volt lehetséges, erről és annak indokairól a Megkeresett Fél haladéktalanul tájékoztatja a Megkereső Felet.

3. A Megkereső Fél illetékes igazságügyi hatósága előtti megjelenésre vonatkozó idézését a jelen Egyezmény 10. cikk 2. bekezdésében megjelölt határidőn belül kell eljuttatni.

4. A Megkereső Fél illetékes igazságügyi hatósága elé történő idézések és kézbesítendő iratok nem tartalmazhatnak olyan fenyegetést, amely kényszerintézkedés alkalmazását helyezné kilátásba a megjelenés elmulasztása esetére.

9. cikk

Bizonyítás felvétele a Megkeresett Fél területén

1. A Megkeresett Fél - nemzeti jogával összhangban - megtesz mindent annak érdekében, hogy bizonyítást vegyen fel tanúktól, sértettektől, gyanúsítottaktól, vádlottaktól, szakértőktől vagy más, a Megkeresett Fél területén tartózkodó személyektől, beszerzi a jegyzőkönyveket, iratokat vagy bármilyen más, a megkeresés ben szereplő bizonyítékokat, és továbbítja őket a Megkereső Félnek.

2. A Megkeresett Fél haladéktalanul tájékoztatja a Megkereső Felet - a jelen Egyezmény 6. cikk 3. bekezdésében felsoroltak céljából is - a jelen cikk 1. bekezdésében felsorolt személyektől a beszerzett bizonyíték beszerzésének időpontjáról, helyéről és idejéről.

3. A bizonyítás felvétele céljából idézett személynek joga van a bizonyítás felvételét megtagadni, amennyiben valamelyik fél nemzeti joga ezt lehetővé teszi. A Megkereső Fél erre tekintettel megkeresésében az ilyen jogokat feltünteti.

4. A Megkeresett Fél engedélyezi a bizonyítás felvétele céljából idézett személy számára jogi képviselőjének jelenlétét mindazon esetekben, amikor ezt a Megkereső Fél nemzeti joga lehetővé teszi.

10. cikk

Bizonyítás felvétele a Megkereső Fél területén

1. A Megkeresett Fél kérelemre idézi az 1. cikk 2. bekezdés c) pontjában felsorolt személyeket. A Megkeresett Fél haladéktalanul tájékoztatja a Megkereső Felet a megidézett személy válaszáról.

2. A Megkereső Fél legalább 60 nappal a megjelenés kitűzött időpontját megelőzően megküldi a Megkeresett Fél részére a Megkereső Fél illetékes igazságügyi hatósága előtti megjelenésre vonatkozó idézés kézbesítésére vonatkozó megkeresést, kivéve sürgős esetekben, amennyiben a Megkeresett Fél az ennél rövidebb határidőhöz hozzájárult.

3. A Megkereső Fél megkeresésében megjelöli mindazon juttatás és költségtérítés összegét, amelyre a Megkereső Fél területén történő megjelenésre idézett személy jogosult.

11. cikk

Biztosítékok és speciális szabályok

1. A Megkereső Fél területén jelen Egyezmény 10. cikke értelmében tartózkodó személy ott tartózkodása alatt

a) állampolgárságától függetlenül nem helyezhető vád alá, nem vehető őrizetbe és semmilyen személyes szabadsága más módon nem korlátozható ezen Fél területén olyan cselekmények tekintetében, amelyeket a Megkereső Fél területére történő belépést megelőzően követett el;

b) nem kötelezhető tanúvallomásra vagy bármely más eljárási cselekményben történő részvételre, a jogsegélykérelemben szereplőtől eltérő eljárás vonatkozásában, kivéve, ha az érintett személy ehhez hozzájárul.

2. Jelen cikk 1. bekezdése nem alkalmazandó, amennyiben az abban megjelölt személy:

a) nem hagyja el a Megkereső Fél területét, attól az időponttól számított negyvenöt napon belül, amikor hivatalosan tájékoztatták arról, hogy jelenléte többé nem szükséges. Ebbe a határidőbe nem számít bele az az időszak, amely alatt az említett személy rajta kívülálló okokból nem hagyta el a Megkereső Fél területét;

b) a Megkereső Fél területének elhagyását követően oda önként visszatér.

3. A sértett, a tanú vagy a szakértő, akinek meghallgatására jelen Egyezmény 9. és 10. cikke alapján kerül sor, a Felek nemzeti joga szerint felel az illetékes igazságügyi hatóság előtti megjelenés során tett vallomásának vagy szakértői véleményének tartalmáért, és az elkövetett cselekmény vonatkozásában mindegyik Fél joghatósága alá tartozik.

12. cikk

Videokonferencia útján történő meghallgatás

1. Amennyiben egy személy a másik Fél területén tartózkodik és tanúként, sértettként, gyanúsítottként, vádlottként vagy szakértőként történő meghallgatására szükség van a Megkereső Fél illetékes igazságügyi hatósága által, úgy utóbbi kérheti, hogy a meghallgatásra videokonferencia útján kerüljön sor. A jogsegély nyújtásának jelen Egyezmény 3. cikkében szereplő megtagadási okai mellett, a videokonferencia útján történő meghallgatás akkor is megtagadható, ha:

a) a gyanúsított vagy vádlott ehhez nem járul hozzá; vagy

b) egy ilyen intézkedés végrehajtása adott esetben ellentétes lenne a Megkeresett Fél nemzeti jogával.

2. A meghallgatással kapcsolatos gyakorlati intézkedésekről a Felek megállapodnak, és a Megkeresett Fél:

a) nemzeti jogával összhangban idézi a jelen cikk 1. bekezdésében említett személyt a meghallgatáson történő megjelenésre és tájékoztatja őt a Megkereső Fél nemzeti joga alapján megillető jogokról;

b) biztosítja a meghallgatandó személy személyazonosságának megállapítását.

3. A videokonferencia útján történő meghallgatás során a következő szabályok alkalmazandók:

a) a Megkeresett Fél illetékes igazságügyi hatóságának tisztviselője jelen van a meghallgatáson, és felel a meghallgatandó személyazonosságának megállapításáért és a Megkeresett Fél nemzeti joga alapelveinek tiszteletben tartásáért. Amennyiben a Megkeresett Fél úgy véli, hogy a meghallgatás során nemzeti jogának alapelvei sérülnek, haladéktalanul megteszi a szükséges intézkedéseket annak biztosítása érdekében, hogy a meghallgatás az említett alapelvek tiszteletben tartása mellett folytatódjék;

b) amennyiben szükséges, a Felek megállapodnak a meghallgatandó személy védelme érdekében szükséges intézkedésekről;

c) a meghallgatást a Megkereső Fél illetékes igazságügyi hatósága a nemzeti jogával összhangban közvetlenül vezeti, vagy irányítja azt;

d) a Megkereső Fél, illetve a meghallgatandó személy kérésére, a Megkeresett Félnek gondoskodnia kell arról, hogy a meghallgatandó személyt tolmács segítse;

e) a meghallgatandó személy jogosult a vallomástétel megtagadására, amennyiben ezt a jogot számára bármelyik Fél nemzeti joga számára biztosítja; az érintett személyt e jogáról a meghallgatást megelőzően tájékoztatni kell;

f) a Megkeresett Fél lehetővé teszi a meghallgatandó személy részére jogi képviselő jelenlétét.

4. A Megkeresett Fél a meghallgatás befejezését követően jegyzőkönyvet készít, amely tartalmazza a meghallgatás idejét és helyét, a meghallgatott személy személyazonosságát, a Megkeresett Fél területén a meghallgatásban részt vevő többi személy személyazonosságát és funkcióját, bármely letett esküt és mindazon technikai feltételeket, amelyek mellett a meghallgatásra sor került. A jegyzőkönyv eredeti példányát továbbítani kell a Megkereső Félnek.

5. Amennyiben a tanú, a sértett vagy a szakértő meghallgatására videokonferencia útján kerül sor jelen cikkel összhangban, és az érintett megtagadja a vallomástételt, miközben vallomástételi kötelezettsége áll fenn vagy vallomása nem felel meg a valóságnak, úgy a Megkeresett Fél ugyanúgy alkalmazhatja nemzeti jogát, mintha a meghallgatásra hazai eljárás keretében került volna sor.

6. A videokonferencia lebonyolításával kapcsolatban a Megkeresett Félnél felmerülő költségeket a Megkereső Fél megtéríti, kivéve, ha a Felek másként állapodnak meg.

7. A Megkeresett Fél engedélyezheti videókonferencia-technológiák alkalmazását a jelen cikk 1. bekezdésében meghatározottaktól eltérő célokra is, ideértve személyek vagy tárgyak felismerését, illetve a szembesítést.

13. cikk

Fogvatartott személyek ideiglenes átszállítása tanúként való megjelenés céljából a Megkereső Fél illetékes igazságügyi hatósága előtt

1. Az olyan fogva tartott személy, akinek tanúként történő személyes megjelenését a Megkereső Fél kérelmezi, ideiglenesen átszállítható utóbbi területére azzal a feltétellel, hogy visszaszállítására a Megkeresett Fél által meghatározott időn belül sor kerül.

2. Az átszállítás megtagadható abban az esetben ha:

a) az őrizetben lévő személy nem egyezik bele az átszállításába;

b) jelenléte a Megkeresett Fél területén folyamatban lévő büntetőeljárás során szükséges;

c) az átszállítás valószínűsíthetően meghosszabbítja fogva tartását;

d) egyéb jelentős indok áll fenn a Megkereső Fél területére történő átszállítás ellen.

3. Az átszállított személyt a Megkereső Fél területén - és amennyiben szükséges, olyan harmadik fél területén is, amelyen keresztül átmenő szállítását kérik - őrizetben kell tartani, kivéve, ha a Megkeresett Fél szabadon bocsátását kéri.

14. cikk

Hivatalos vagy nyilvános dokumentumok rendelkezésre bocsátása

1. A Megkeresett Fél kérelemre a Megkereső Fél rendelkezésére bocsátja a kormányzati szervek vagy a társadalmi szervezetek birtokában lévő a nyilvánosság számára hozzáférhető jegyzőkönyvek vagy dokumentumok másolatát.

2. A Megkeresett Fél rendelkezésre bocsáthatja a kormányzati szervek vagy a társadalmi szervezetek birtokában lévő a nyilvánosság számára hozzá nem férhető jegyzőkönyvek vagy dokumentumok másolatát, ugyanolyan mértékben és ugyanolyan feltételek mellett, amelyek mellett azok a Megkeresett Fél igazságügyi vagy rendvédelmi szervei számára hozzáférhetők. Az ilyen másolatokat a Megkeresett Fél illetékes hatósága a nemzeti joga szerint hitelesíti.

15. cikk

Dokumentumok, jegyzőkönyvek vagy tárgyak átadása

1. Amennyiben a megkeresés a jelen Egyezmény 14. cikkében meghatározottaktól eltérő dokumentumok vagy jegyzőkönyvek átadására vonatkozik, a Megkeresett Fél rendelkezésre bocsáthatja azok másolatát. Amennyiben a Megkereső Fél kifejezetten kérelmezi az eredeti példányok átadását, a Megkeresett Fél a lehetséges mértékben teljesíti a kérést.

2. A Megkereső Félnek átadott dokumentumok és jegyzőkönyvek eredeti példányait, valamint tárgyakat az első adandó alkalommal vissza kell szolgáltatni a Megkeresett Félnek, kivéve, ha a Megkeresett Fél lemond azok visszaszolgáltatásáról.

16. cikk

Házkutatás, lefoglalás és biztosítási intézkedések

1. A Megkeresett Fél kérelemre intézkedéseket tesz a területén elkövetett bűncselekményből származó jövedelem, vagy bűncselekményhez kapcsolódó tárgyak felkutatása érdekében, és ennek eredményről tájékoztatja a Megkereső Felet.

2. A bűncselekményből származó jövedelmek és a bűncselekményhez kapcsolódó tárgyak megtalálása esetén a Megkeresett Fél kérelemre megtesz minden, a saját nemzeti joga által lehetővé tett intézkedést a bűncselekményből származó jövedelmek vagy a bűncselekményhez kapcsolódó tárgyak lefoglalása vagy biztosítása érdekében.

3. A Megkeresett Fél kérelemre, a Felek megállapodása alapján egészben vagy részben átadja a bűncselekményből származó jövedelmeket vagy a bűncselekményhez kapcsolódó tárgyakat, valamint az utóbbiak eladása révén keletkezett bevételt.

4. A Megkeresett Fél elhalaszthatja a bűncselekményből származó jövedelmek és a bűncselekményhez kapcsolódó tárgyak átadását, amennyiben ezekre folyamatban lévő hazai eljárással összhangban szükség van.

5. Jelen cikk alkalmazása során biztosítani kell a Megkeresett Félnek vagy harmadik feleknek a bűncselekményből származó jövedelmekkel és a bűncselekményhez kapcsolódó tárgyakkal kapcsolatos jogainak érvényesülését.

17. cikk

Banki és pénzügyi információk beazonosítása

1. A Megkeresett Fél - nemzeti jogával összhangban - kérelemre megállapítja, hogy egy bűncselekmény elkövetésével gyanúsított vagy vádolt személy rendelkezik-e bankszámlával vagy bankszámlákkal bármilyen, a területén található bármely bankban vagy más pénzügyi intézményben és az ezzel kapcsolatos információkat a Megkereső Fél rendelkezésére bocsátja, ideértve az olyan személyek személyazonosságával kapcsolatos információkat is, akik jogosultak az e számlákhoz való hozzáférésre, valamint a számlák helyével és a velük kapcsolatos bármely tranzakcióra vonatkozó információkat.

2. Jelen Egyezmény 5. cikkében foglaltak mellett, a jelen cikk 1. bekezdésében meghatározott információ átadására vonatkozó megkeresésnek tartalmaznia kell az alábbiakat is:

a) az ilyen számlák vagy tranzakciók beazonosításához szükséges természetes vagy jogi személy azonosító adatait;

b) valamennyi ahhoz szükséges információt, hogy a Megkeresett Fél illetékes igazságügyi hatósága megállapíthassa, hogy

i. megalapozott gyanú áll fenn, hogy az érintett természetes vagy jogi személy bűncselekmény elkövetésében vett részt és a Megkeresett Fél területén lévő bankok vagy más pénzintézetek rendelkezhetnek a kért információkkal;

ii. a keresett információ összefügg a nyomozással vagy a büntetőeljárással;

c) a szükséges mértékben minden egyéb információt, amely megkönnyítheti a megkeresés teljesítését.

3. A jelen cikkben hivatkozott jogsegély nem tagadható meg a banktitokra való hivatkozással.

4. A Megkereső Fél garantálja, hogy az e cikk alapján szerzett információk csak és kizárólag a megkeresésben meghatározott büntetőeljárás céljából kerülnek felhasználásra.

18. cikk

Büntetőeljárásokkal és büntetett előéletre vonatkozó információk cseréje

1. A Megkeresett Fél kérelemre és büntetőeljárás céljából átadja a Megkereső Félnek a Megkereső Fél állampolgárai ellen folytatott büntetőeljárással és elítélésekkel kapcsolatos információkat jelen Egyezmény 19. cikkével összhangban.

2. A Megkereső Fél illetékes igazságügyi hatósága által lefolytatandó büntetőeljárás lefolytatásához szükséges, bűnügyi nyilvántartásban szereplő adatok abban az esetben kerülnek átadásra, ha hasonló esetben ezek az adatok a Megkeresett Fél illetékes igazságügyi hatóságai számára is hozzáférhetőek.

19. cikk

Személyes adatok védelme

1. A jelen cikk 2. bekezdésének sérelme nélkül, személyes adat kizárólag akkor gyűjthető és továbbítható, ha ez a jogsegélykérelemben megjelölt célok tekintetében szükséges és arányos.

2. A jelen Egyezmény szerint teljesített megkeresés eredményeként továbbított személyes adatot az a Fél, amely részére a személyes adat átadásra került, kizárólag az alábbi célokra használhatja fel:

a) azon büntetőeljárás lefolytatása érdekében, amelyben a jogsegélykérelmet a jelen Egyezmény alapján előterjesztették;

b) egyéb igazságügyi és közigazgatási eljárásban, amely közvetlenül összefügg az a) pontban említett eljárással;

c) a közbiztonságot közvetlenül és súlyosan fenyegető veszély elhárítása érdekében.

3. A személyes adat az adatot továbbító Fél vagy a személyes adattal érintett személy előzetes hozzájárulásával egyéb célra is felhasználható. A hozzájárulást az adatot továbbító Fél a nemzeti jogával összhangban adja meg.

4. Bármelyik Fél jogosult megtagadni személyes adat továbbítását abban az esetben, ha az ilyen adat nemzeti joga szerint minősített adatnak minősül és a másik Fél nem képes azonos szintű adatvédelmet biztosítani.

5. Bármely személyes adatot továbbító Fél kérheti az adatot fogadó Felet, hogy adjon tájékoztatást a személyes adat kezeléséről.

6. A jelen Egyezmény alapján továbbított személyes adatot az adatot fogadó Fél nemzeti joga szerint kell kezelni, illetve törölni. A fenti korlátozásoktól függetlenül törölni kell az adatot, amint annak kezelése már nem szükséges az átadás alapjául szolgáló célból.

7. E cikk nem érinti az adatot átadó Fél jogosultságát arra, hogy egyes esetekben további feltételeket szabjon, ha az adott jogsegélykérelmet ilyen feltételek hiányában nem lehetne teljesíteni. Amennyiben e bekezdés alapján további feltételek megjelölésére sor kerül, az adatot átvevő Fél köteles a fogadott adatot e feltételeknek megfelelően kezelni.

8. Amennyiben az adatszolgáltatást követően az adatot átadó Félnek olyan körülmények jutnak a tudomására, amelyek következtében az adott esetben további feltételt kell kikötnie, a Felek egyeztethetnek annak meghatározása érdekében, hogy a személyes adat védelme milyen mértékben lehetséges.

20. cikk

Nemzeti joggal kapcsolatos tájékoztatás

A Felek kérelemre információt cserélnek a hatályos vagy korábban hatályban lévő nemzeti jogszabályaikról, és az ezzel kapcsolatos joggyakorlatról.

21. cikk

Hitelesítés alóli mentesülés

A jelen Egyezménnyel összefüggésben átadott iratok és jegyzőkönyvek nem igényelnek semmilyen további (felül)hitelesítést.

22. cikk

Titoktartás

1. A Megkeresett Fél bizalmasan kezeli a megkeresést és annak tartalmát, amennyiben a Megkereső Fél a bizalmas kezelést kéri. Amennyiben a megkeresés nem teljesíthető a kért titoktartás megsértése nélkül, a Megkeresett Fél tájékoztatja erről a Megkereső Felet, amely ezt követően megállapítja, hogy a megkeresés ennek ellenére is teljesítendő-e.

2. A Megkeresett Fél megfelelő kérelme esetén a Megkereső Fél a jogsegélykérelem teljesítése során szerzett bármely bizonyítékot és információt bizalmasan kezel, kivéve a bizonyíték és információ nyomozás és büntetőeljárás során történő felhasználásának eseteit.

23. cikk

Költségek

1. A Felek a jelen Egyezmény alkalmazásából származó költségeket nemzeti jogukkal összhangban viselik.

2. A jelen cikk 3. bekezdésének sérelme nélkül, a megkeresés teljesítéséből származó költségeket a Megkeresett Fél viseli.

3. A Megkereső Fél a következő költségeket viseli:

a) jelen Egyezmény 6. cikk 3. bekezdésében felsorolt személyek utazási és elhelyezési költségeit a Megkeresett Fél területén;

b) jelen Egyezmény 10. cikkében felsorolt személyek utazási és elhelyezési költségeit a Megkereső Fél területén;

c) a videokonferenciával kapcsolatos költségeket, a jelen Egyezmény 12. cikk 6. bekezdésének sérelme nélkül;

d) a jelen Egyezmény 13. cikke alapján előterjesztett megkeresés teljesítéséből eredő kiadásokat;

e) szakértők kiadásait és díjazását;

f) a fordításból, tolmácsolásból, és leírásból származó kiadásokat és díjakat;

g) a lefoglalt tárgyak tárolásából és átadásából származó kiadásokat.

4. Amennyiben a megkeresés teljesítése rendkívüli kiadásokat von maga után, a Felek egyeztetnek a megkeresés teljesítésének feltételeiről, valamint a felmerülő költségek megosztásának feltételeiről.

24. cikk

Nemzetközi egyezményekkel való összeegyeztethetőség

Jelen Egyezmény nem érinti a Felekre bármiféle nemzetközi egyezmény értelmében vonatkozó jogokat és kötelezettségeket, amelynek részesei, illetve Magyarország vonatkozásában azokat, amelyek az Európai Unió tagállamaként ráhárulnak.

25. cikk

Viták rendezése

A jelen Egyezmény értelmezésével vagy végrehajtásával kapcsolatosan felmerülő bármilyen vitát tárgyalások útján vagy diplomáciai úton kell rendezni.

26. cikk

Az Egyezmény hatályba lépése, módosítása és felmondása

1. Jelen Egyezményt a Felek határozatlan időre kötik. A jelen Egyezmény a diplomáciai úton érkezett azon utolsó írásbeli értesítés kézhezvételétől számított harmincadik (30.) napon lép hatályba, amelyben a Felek a jelen Egyezmény hatálybalépéséhez szükséges belső jogi eljárások lezárulásáról értesítik egymást.

2. Jelen Egyezményt a Felek közös megegyezéssel módosíthatják. A változtatásokat és módosításokat külön jegyzőkönyvbe kell foglalni, mely a jelen Egyezmény szerves részévé válik és a jelen cikk 1. bekezdése szerint lép hatályba.

3. A jelen Egyezményt bármely Fél bármikor felbonthatja a másik Fél részére diplomáciai úton megküldött írásbeli közléssel. A felmondás a kézhezvétel napjától számított száznyolcvan (180) nap elteltével lép hatályba.

4. A jelen Egyezmény - a felmondás ellenére - az eljárás befejezéséig alkalmazandó marad azokra a jogsegélykérelmekre nézve, amelyeket a hatálya alatt terjesztettek elő.

5. Jelen Egyezmény alkalmazandó minden, a hatályba lépését követően előterjesztett megkeresésre vonatkozóan abban az esetben is, ha az alapul szolgáló bűncselekmények elkövetésére még jelen Egyezmény hatályba lépését megelőzően került sor.

A FENTIEK HITELÉÜL, az aláírók megfelelő felhatalmazás birtokában, aláírták jelen Egyezményt

KÉSZÜLT Asztanában, 2015. április 1-jén, két eredeti példányban magyar, kazah és angol nyelven, amelyek mindegyike egyaránt hiteles és hatályos. Jelen Egyezmény értelmezésével kapcsolatos bármiféle nézetkülönbség esetén az angol nyelvű szöveg érvényes.

4. § (1) Ez a törvény - a (2) bekezdésben meghatározott kivétellel - a kihirdetését követő napon lép hatályba.

(2) A 2. § és 3. § az Egyezmény 26. cikk 1. bekezdésében meghatározott időpontban lép hatályba. * 

(3) Az Egyezmény, illetve a 2. § és 3. § hatálybalépésének naptári napját a külpolitikáért felelős miniszter - annak ismertté válását követően - a Magyar Közlönyben haladéktalanul közzétett közleményével állapítja meg. * 

(4) Az e törvény végrehajtásához szükséges intézkedésekről az igazságügyért felelős miniszter gondoskodik.
