2015. évi CXCIX. törvény

a Magyarország és a Kazah Köztársaság között létrejött kiadatási egyezmény kihirdetéséről * 

1. § Az Országgyűlés e törvénnyel felhatalmazást ad Magyarország és a Kazah Köztársaság között létrejött kiadatási egyezmény (a továbbiakban: Egyezmény) kötelező hatályának elismerésére.

2. § Az Országgyűlés az Egyezményt e törvénnyel kihirdeti.

3. § Az Egyezmény hiteles angol és magyar nyelvű szövege a következő:

Treaty between Hungary and the Republic of Kazakhstan on extradition

Hungary and the Republic of Kazakhstan, hereinafter referred to as the “Parties”,

Desiring to contribute to effective judicial cooperation between the two States with the aim of preventing crime on the basis of mutual respect for sovereignty and equality,

Desiring to improve the cooperation between the two States in the field of extradition;

Taking into account that the goal can be achieved through a bilateral agreement establishing joint action in matters of extradition,

Have agreed as follows:

Article 1.

Obligation to extradite

Each Party shall, in accordance with the terms of this Treaty, extradite individuals within its territory who are sought by the Requesting Party with a view to criminal prosecution or enforcement of a final court decision for extraditable offences.

Article 2.

Extraditable offences

1. Extradition shall be granted in respect of offences punishable under the national laws of both Parties by deprivation of liberty of at least one year or more severe penalty.

2. Extradition for the purpose of enforcement of a court decision shall be granted if at the moment of sending the extradition request a period of at least six months of the penalty remains to be served by the person whose extradition is sought.

3. For the purposes of paragraph 1 of this Article, an offence shall be an extraditable offence whether or not the national laws of the Parties place the offence within the same category of offences or describe the offence by the same or different terminology.

4. In respect of the crimes related to violation of customs, tax laws and legislation in the sphere of currency regulation, extradition may not be refused on the grounds that the national law of the Requested Party does not envisage the tax and customs rules or norms in the sphere of currency regulation, similar to the national legislation of the Requesting Party.

5. Extradition shall be granted if the offence has been committed outside the territory of the Requesting Party, provided that national law of the Requested Party stipulates the punishment for crimes committed outside its territory under the same conditions.

6. If the request for extradition includes several separate offences each of which is punishable under the national laws of both Parties by deprivation of liberty, but of which some do not fulfill the conditions set out in paragraph 1 and 2 of this Article, the requested Party shall also have the right to grant extradition for all the offences.

Article 3.

Mandatory grounds for refusal of extradition

Extradition shall be denied if:

a) The Requested Party has reasonable grounds to believe that the extradition request was presented with the aim of prosecuting or punishing the person sought on account of that person’s race, sex, religion, nationality or political opinions, or that the situation of the person involved in the judicial procedure could be jeopardised for one of these reasons;

b) The offence for which the extradition request is submitted may be punished in the Requesting Party in a manner not allowed by the national legislation of the Requested Party;

c) The Requested Party has reasonable grounds to believe that the person sought for an offence might be subjected to punishment or any other act or omission which does not ensure respect for fundamental human rights, including protection from cruel, inhuman, or degrading treatment in the Requesting Party;

d) Criminal prosecution under the national law of the Requested Party may not be initiated or a sentence may not be enforced because of lapse of time;

e) A final judgment has been passed by the competent authorities of the requested Party upon the person claimed in respect of the offence or offences for which extradition is requested. Extradition may be denied if the competent authorities of the Requested Party have decided either not to institute or to terminate proceedings in respect of the same offence or offences.

f) The person whose extradition is requested has been granted asylum by the Requested Party;

g) The Requested Party considers that the extradition could harm its sovereignty, national security, public order or other interests or would be contrary to its constitution;

h) The offence for which extradition is sought is punishable by death penalty under the national laws in the Requesting Party, the Requested Party may refuse extradition unless the Requesting Party provides assurances that the capital punishment will not be imposed or, if imposed, will not be carried out;

i) Extradition was requested for military offences which are not offences under ordinary criminal law;

j) The offence in respect of which it is requested is regarded by the requested Party as a political offence or as an offence connected with a political offence. To this end the following shall not be considered as offences of a political nature:

I. homicide or any other offence against the life, physical integrity or freedom of a Head of State, members of the government and their family members.

II. terrorist offences or any other offences which are not considered as political offences under any international treaty, which both Parties adhered to.

Article 4.

Optional grounds for refusal of extradition

Extradition may be refused in any of the following circumstances:

a) If the offence for which extradition is requested is subject to the jurisdiction of the Requested Party in accordance with its national law, and the person claimed is under investigation or will be prosecuted by the competent authorities of the Requested Party for the same offence.

b) If the Requested Party - taking into account the gravity of the offence and the interests of both Parties - considers that the extradition would be incompatible with humanitarian considerations, in view of the person’s age, health, or any other personal circumstances.

Article 5.

Extradition of own citizens

1. Each Party shall have the right to refuse the extradition of its own citizens.

2. In case of refusal, the Requested Party shall prosecute the person under its national law. For this purpose the Requesting Party through the Central Authorities referred to in Article 6 of this Treaty, provides to the Requested Party the criminal case files, required documents and any other information at its disposal.

3. The Requested Party shall inform the Requesting Party in due time of the measures taken according to the request, and the eventual court procedure.

Article 6.

Central Authorities of the Parties

1. For purposes of this Treaty, the Central Authorities designated by the Parties, shall interact directly.

2. Central Authorities are:

for Hungary - the Minister responsible for justice;

for the Republic of Kazakhstan - Prosecutor General’s Office of the Republic of Kazakhstan.

3. Each Party shall inform the other Party of any changes and amendments related to the Central Authorities through diplomatic channels.

Article 7.

Extradition request and supporting documents

1. The extradition request and the accompanying documents shall be submitted in writing through the Central Authorities, and shall include:

a) the name of the requesting authority;

b) name and family name, date of birth, gender, nationality, identity document data of the person sought and any other information that may facilitate the identification of the requested person or his or her residence, as well as identification data, photographs and fingerprints if available;

c) summary of the facts comprising the offence for which extradition is requested, together with the date and place of its commitment;

d) the text of the relevant legal provisions regarding the establishment of criminal jurisdiction, determination of the offence, and the punishment which could be imposed for that offence;

e) the text of the relevant legal provisions related to the statute of limitation for the criminal act or for the execution of the sentence;

f) if the offence for which extradition is requested was committed outside the territory of the Requesting Party, extract from the law providing jurisdiction of the Requesting Party on this offence.

2. In addition to the provisions of paragraph 1 of this Article, the extradition request shall be accompanied by:

a) if the extradition request relates to a criminal prosecution, a copy of the arrest warrant;

b) if the extradition request is aimed at the execution of a sentence imposed on the person sought, it should also be accompanied by a copy of the court decision and a description of the period of the sentence already served.

3. The document is considered certified for purposes of this Treaty if it is signed or certified by a judge or other authorized person of the Requesting Party and affixed by an official seal of the Central Authority of the Requesting Party. All submitted documents shall be accompanied by translation into the official language of the Requested Party or into English.

Article 8.

Additional information

1. If the information submitted by the Requesting Party, which accompanies an extradition request, is not sufficient to ensure the decision of the Requested Party in accordance with this Treaty, the Requested Party may request additional information. The requested additional information must be submitted within thirty (30) days of receipt of the request.

2. If the person whose extradition is requested is arrested and the requested additional information has not been received within the period specified in paragraph 1 of this Article, the person may be released. Such release shall not prevent the Requesting Party to submit a new extradition request.

3. If the person is released from custody pursuant to paragraph 2 of this Article, the Requested Party shall notify the Requesting Party about this within two (2) days.

Article 9.

Decision on the extradition request

1. The Requested Party shall decide on the extradition request in accordance with the provisions of this Treaty and its national law, and shall promptly inform about its decision the Requesting Party.

2. If the Requested Party denies, completely or partially, the extradition of the person, the reasons for denial shall be communicated to the Requesting Party.

Article 10.

Simplified extradition

1. When the person whose extradition is requested consents to it, extradition may be granted on the sole basis of the request for extradition without being necessary to submit the documents indicated in Article 7 of this Treaty. However, the Requested Party may request any further information it deems necessary to grant the extradition.

2. The declaration of consent by the person sought shall be valid if made with the assistance of a defence counsel, before a competent authority of the Requested Party, which has the obligation to inform the person sought of the right to avail himself or herself of a formal extradition procedure conferred by the rule of specialty laid down in Article 11 of this Treaty and of the irrevocability of such declaration.

3. The declaration shall be recorded in a judicial document in which it is acknowledged that the conditions for its validity have been complied with.

Article 11.

The rule of specialty

A person extraditable pursuant to this Treaty cannot be detained, accused, punished or subjected to any other measure restricting personal liberty, for any offence different from the one for which he or she was extradited, except for the following cases:

a) The offence is committed after the extradition;

b) The extradited person leaves the territory of the Requesting Party after extradition and voluntarily returns;

c) The extradited person does not leave the territory of the Requesting Party within forty-five (45) days from the time when he or she had the opportunity to do so. However, this period does not include the time period during which the aforesaid person fails to leave the Requesting Party for reasons beyond his control;

d) The Requested Party consents to it. In case of obtaining the request of the Requesting Party for such consent, the Requested Party in accordance with this Treaty can agree to prosecute the extradited person or enforce a sentence for an offence other than that for which he or she was extradited. In this case:

I) The Requested Party shall submit a request to the Requesting Party about transfer of documents and information referred to in Article 7 of this Treaty;

II) During wait time for a decision on the request, the extradited person may be held in custody in the Requesting Party in accordance with its national law.

e) The requested person consents to be extradited and at the same time renounces the use of the rule of specialty.

Article 12.

Re-extradition to a third state

The Requesting Party may not re-extradite a person to a third state without the prior consent of the Requested Party in respect of offences committed prior to his or her extradition. The Requested Party may require the submission of the documents and information referred to in Article 7 of this Treaty to render such consent.

Article 13.

Provisional arrest

1. In case of urgency, the Requesting Party may request the provisional arrest of the person sought, pending receipt of the extradition request.

The request for provisional arrest shall contain reference to the arrest warrant of a competent authority of the Requesting Party or to the judgment that entered into force and indication of the fact that the extradition request will be presented additionally. The request for provisional arrest before receipt of an extradition request may be sent through expedited means of communication and originals simultaneously sent by post or via the International Criminal Police Organization (Interpol) to the Central Authority of the Requested Party.

2. The Requested Party shall immediately inform the Requesting Party about its decision on the request for provisional arrest.

3. The provisional arrest shall be terminated if, within a period of 40 days following the arrest of the person sought, the Central Authority of the Requested Party has not received the formal extradition request. This period may be extended by 20 days, at the duly justified request of the Requesting Party.

4. Release of a person according to the paragraph 3 of this Article shall be without prejudice to the extradition of the person sought if the Requested Party subsequently receives the formal extradition request.

Article 14.

Concurrent requests

If the extradition of the same person has been requested by one of the Parties and one or more third States, the Requested Party shall decide, at its discretion, to which one of them it will surrender the person sought, and shall notify the requesting States of its decision. In the event of concurrence between a request for extradition from the Republic of Kazakhstan and an European arrest warrant presented by a Member State of the European Union, Hungary shall determine to which State the person will be extradited.

The Requested Party shall consider the following circumstances to make a decision:

a) whether the requests were made in accordance with international treaties in force;

b) severity of the crime;

c) time and place of committing the offence;

d) nationality and permanent residence of the person sought;

e) time of submitting the requests;

f) possibility of subsequent criminal proceedings or execution of a sentence related to the sought person in the Requesting States.

Article 15.

Surrender of the person

1. If the Requested Party grants the extradition, the Parties shall promptly agree upon the time, place and any other relevant matter relating to the surrender of the person. The Requested Party shall inform the Requesting Party of the period of time during which the person has been under arrest prior to being surrendered for the purpose of extradition.

2. The time period for surrender of a person is forty (40) days from the date on which the Requesting Party was notified that the extradition was granted.

3. If the Requesting Party fails to receive the person within a period specified in paragraph 2 of this Article, the Requested Party shall immediately release the person and may reject a new extradition request from the Requesting Party referring to the same person and the same offences, unless paragraph 4 of this Article stipulates otherwise.

4. If a Party for reasons beyond its control cannot surrender, or receive a person whose extradition was granted, the Party concerned shall promptly notify the other Party, and they will agree on a new term for surrender.

5. The time period spent in detention for extradition purposes, including home detention, is deducted from the overall term of sentence awarded in the Requesting Party in accordance with its national law.

Article 16.

Postponement of the surrender of the person to be extradited or temporary extradition

1. If the person, whose extradition is granted, is being prosecuted or is serving a sentence in the Requested Party for committing an offence other than that for which the extradition is granted, the Requested Party may postpone his or her surrender until the end of the trial or until the full execution of the sentence. In case of such postponement, the Requested Party immediately notifies the Requesting Party.

2. At the request of the Requesting Party, the Requested Party may temporarily extradite the requested person to the Requesting Party to enable the completion of the ongoing criminal proceeding after agreeing on the time period of such a temporary extradition in accordance with its national law. The person extradited temporarily shall be detained during the period of stay in the territory of the Requesting Party and transferred to the Requested Party at an agreed time. The time spent in detention is deducted from the term of execution of the sentence awarded in the Requested Party.

3. Surrender may be also postponed when the transfer may endanger the person’s life or worsen the state of his or her health. In this case, the Requested Party shall provide a detailed medical report issued by the competent medical authority to the Requesting Party.

Article 17.

Seizure and surrender of property

1. If the Requesting Party so requests, the Requested Party shall, to the extent permitted by its national law, seize objects obtained or used in the offence, and any other property that may be found on its territory which could have evidential value, and if the extradition is granted, on the request of the Requesting Party, and surrender these objects to the Requesting Party.

2. In case the extradited person has not been surrendered, the object referred to in paragraph 1 of this Article may be surrendered on the request of the Requesting Party.

3. The Requested Party may, for the purpose of carrying out another pending criminal procedure, postpone the surrender of the objects referred to in paragraph 1 of this Article until the conclusion of this criminal procedure, or temporarily surrender those objects on the condition that they shall be returned by the Requesting Party.

4. In the process of surrendering the enumerated objects, the property rights of both Parties and third parties shall be duly respected. Should such rights exist, the objects surrendered shall be returned to their respective owners or to the Requested Party free of charge as soon as possible after the completion of the proceedings.

Article 18.

Transit

1. Each Party may, in accordance with its national law, authorize the transit through its territory of persons extradited to the other Party by a third State.

2. The Requesting Party shall send a request containing identity information of the person transited, information about his/her nationality and a brief summary of facts related to the offence to the Requested Party through the Central Authority or, in particularly urgent cases, through the International Criminal Police Organization (Interpol). The transit request shall be accompanied by a copy of the document confirming the extradition of the person.

3. The Requested Party shall detain the transited person in its territory.

4. Transit permission is not required if the transit is carried out by air and landing in the state of transit is not foreseen. In case of an unscheduled landing on the territory of the transit state, the State requesting transit shall promptly notify the transit state and the latter shall detain up to fifteen (15) days, pending the request for transit as provided by paragraph 2 of this Article.

Article 19.

Costs

1. The expenses derived from the extradition proceedings in the Requested Party shall be borne by the Requested Party, unless otherwise agreed by the Parties.

2. Transport and transit expenses related to the surrender or the reception of the extradited person and any objects referred to in Article 17 of this Treaty shall be borne by the Requesting Party.

Article 20.

Notification on the outcome

The Requesting Party shall provide information on the outcome of the court proceedings or the enforcement of judgment in respect of the extradited person or information about extradition of the extradited person to the third state.

Article 21.

Compatibility with international treaties

This Treaty shall not affect the rights and obligations assumed by each Party in accordance with any international treaty which they are party to.

Article 22.

Personal data protection

1. Without prejudice to paragraph 2 of this Article, personal data may be transmitted by the Parties, and may be processed by the Party to which the data have been transmitted only if it is necessary and proportionate for the purpose of

a) the criminal proceedings or execution of court decisions for which the extradition was requested under this Treaty;

b) other judicial and administrative proceedings directly related to the proceedings or court decisions mentioned under subparagraph a) of this paragraph

c) preventing an immediate and serious threat to public security.

2. Such data may however be processed for any other purpose if prior consent to that effect has been given by either the Party who transmitted the data, or by the person who is subject of the data. The consent shall be given in accordance with the national law of the Party transmitting personal data.

3. Any Party that transmits personal data as a result of the execution of the provisions of this Treaty may require the Party to which the data have been transmitted to give information on the processing of such data.

4. Without prejudice to paragraph 6 of this Article personal data transmitted under this Treaty shall be processed and deleted in line with the national laws of the Party to which the data have been transmitted. Irrespective of these limits the data received shall be deleted as soon as they are no longer required for the purpose for which they were transmitted.

5. The personal data subject shall be enabled in accordance with the national legislation of the Parties:

a) to request information regarding the processing of his/her personal data by the competent authorities;

b) to request rectification, erasure or blocking of his/her personal data;

c) to have remedy if his/her request is not complied with.

6. The Parties transmitting personal or other data may impose additional conditions in respect of the processing of the transmitted data. Where additional conditions have been imposed in accordance with this paragraph, the Party to which the data have been transmitted shall process the received data according to those conditions.

Article 23.

Settlement of disputes

Any dispute arising during the application or interpretation of this Treaty shall be settled by negotiations or diplomatic consultation between the Parties.

Article 24.

Entry into force, amendments and termination of the Treaty

1. This Treaty is concluded for an indefinite period of time and shall enter into force on the thirtieth (30) day from the date of receiving the last written notification through diplomatic channels in which the Parties notify each other of the completion of the internal legal procedures necessary for the entry into force of the Treaty.

2. This Treaty may be amended with the consent of the Parties. The changes and amendments shall be made in separate protocols that become integral parts of the Treaty and shall enter into force in accordance with paragraph 1 of this Article.

3. Either Party may terminate this Treaty at any time by written notification to the other Party through diplomatic channels. Termination shall take effect on expiry of one hundred and eighty (180) days from the date of reception of the notification.

4. In case this Treaty is terminated, it shall remain applicable to extradition procedures initiated during the period of its validity, until the completion of such procedures.

IN WITNESS WHEREOF, the undersigned, being duly authorized, have signed this Treaty.

DONE in Budapest on 3 June, 2014 in two originals each in Hungarian, Kazakh and English languages, all texts being equally authentic and have the same legal force.

In case of divergence in the interpretation of this Treaty the English text shall prevail.

MAGYARORSZÁG ÉS A KAZAH KÖZTÁRSASÁG KÖZÖTT LÉTREJÖTT KIADATÁSI EGYEZMÉNY

Magyarország és a Kazah Köztársaság (a továbbiakban együttesen: „a Felek”),

Attól az óhajtól vezérelve, hogy hatékonyabb együttműködést alakítsanak ki a két állam között a bűnüldözés és az ítéletek végrehajtása terén, a másik állam szuverenitását tiszteletben tartva;

Attól az óhajtól vezérelve, hogy megerősítsék a két állam közötti kapcsolatokat a kiadatás terén; Annak tudatában, hogy e cél kétoldalú kiadatási egyezmény keretében érhető el;

Az alábbiakban állapodtak meg:

1. Cikk

KIADATÁSI KÖTELEZETTSÉG

A jelen Egyezmény értelmében mindkét Fél kiadja a másik Fél kérelmére a területén tartózkodó azon személyeket, akiket a másik Fél büntetőeljárás lefolytatása, vagy bíróságai által kiszabott ítélet végrehajtása céljából kiadatási bűncselekmény miatt keres.

2. Cikk

KIADATÁSI BŰNCSELEKMÉNYEK

1. Kiadatásnak olyan bűncselekmény esetében van helye, amely mindkét Fél joga alapján legalább egy év szabadságvesztéssel büntetendő.

2. Ha a kiadatási kérelem célja szabadságvesztéssel járó ítélet végrehajtása, akkor a kérelem előterjesztésének időpontjában a kiadni kért személy által még letöltendő büntetésnek legalább hat hónapos időtartamúnak kell lennie.

3. A jelen cikk 1. bekezdésének alkalmazásában valamely bűncselekmény attól függetlenül kiadatási bűncselekmény, hogy a Felek joga azonos bűncselekmény-kategóriába sorolja-e, illetve azonos terminológiával írja-e le az adott bűncselekményt.

4. A vámmal, adóval és devizaszabályozással kapcsolatos jogszabályok megsértése esetében a kiadatás akkor sem tagadható meg, ha a megkeresett Fél nemzeti joga nem tartalmaz a megkereső Fél nemzeti jogához hasonló szabályozást.

5. Amennyiben a bűncselekményt a megkereső Fél területén kívül követték el, akkor van helye kiadatásnak, ha a megkeresett Fél nemzeti joga szerint hasonló esetben a területén kívül elkövetett bűncselekmények büntetésére is van joghatósága.

6. Ha a kiadatási kérelem több olyan bűncselekményre vonatkozik, melyek mindkét Fél nemzeti joga szerint szabadságvesztés büntetéssel büntetendők, de a bűncselekmények közül nem mindegyik tesz eleget a jelen cikk 1. és 2. bekezdésében foglaltaknak, a megkeresett Félnek joga van az összes bűncselekményre nézve teljesíteni a kiadatási kérelmet.

3. Cikk

KÖTELEZŐ MEGTAGADÁSI OKOK

A kiadatást meg kell tagadni ha:

a) a megkeresett Fél alapos okkal feltételezi, hogy a megkeresést azért terjesztették elő, hogy a keresett személy ellen a személy faja, neme, vallása, állampolgársága vagy politikai meggyőződése miatt folytassanak le büntetőeljárást vagy szabjanak ki büntetést, illetve a bírósági eljárással érintett személy helyzete ezen okok bármelyike miatt veszélyeztetetté válhat;

b) a bűncselekmény, melyre a kiadatást kérik, a megkereső Fél joga szerint olyan büntetéssel sújtható, melyet a megkeresett Fél nemzeti joga nem engedélyez;

c) a megkeresett Fél alapos okkal feltételezi, hogy a kiadni kért személy olyan büntetésnek, vagy más cselekménynek illetve mulasztásnak lenne kitéve, amely során a megkereső Fél nem biztosítja számára az alapvető emberi jogokat, beleértve a kegyetlen, embertelen vagy megalázó bánásmód elleni védelmet;

d) a megkeresett Fél joga szerint elévülés miatt büntetőeljárás már nem folytatható vagy a büntetést már nem lehet végrehajtani;

e) a megkeresett Fél illetékes hatóságai a kiadni kért személlyel szemben már jogerős ítéletet hoztak a kiadatási kérelem tárgyát képező bűncselekmény vagy bűncselekmények miatt. A kiadatást meg lehet tagadni, ha a megkeresett Fél illetékes hatóságai a kiadatással érintett ügyben olyan határozatot hoztak, hogy a keresett személy ellen nem indítanak büntetőeljárást, illetve a büntetőeljárást megszüntetik.

f) a megkeresett Fél menedékjogot biztosít a kiadni kért személynek;

g) a kiadatás sértené a megkeresett Fél szuverenitását, nemzetbiztonságát, közrendjét vagy egyéb érdekét, illetve a kiadatás a megkeresett Fél alkotmányába ütközne;

h) a bűncselekmény, amely miatt a kiadatást kérték, a megkereső Fél joga szerint halálbüntetéssel büntethető. A megkeresett Fél mindaddig megtagadhatja a kiadatást, amíg a megkereső Fél nem nyújt biztosítékot arra, hogy a halálbüntetést nem fogják kiszabni, vagy ha kiszabták, akkor azt nem hajtják végre;

i) a kiadatást olyan katonai bűncselekményre kérték, amely nem köztörvényes bűncselekmény;

j) a bűncselekmény, amely miatt a kiadatást kérik, a megkeresett Fél szerint politikai bűncselekmény, vagy azzal kapcsolatos bűncselekmény. Ennek értelmében nem tekinthetők politikai bűncselekménynek:

I. bármely Fél államfője, kormányának tagja vagy ezek családtagja ellen elkövetett emberölés vagy más az élet, testi épség vagy szabadság ellen irányuló bűncselekmény,

II. olyan terrorcselekmények vagy más bűncselekmények, melyek nem minősülnek politikai bűncselekménynek bármely olyan nemzetközi szerződés szerint, melynek mindkét Fél részese.

4. Cikk

MÉRLEGELHETŐ MEGTAGADÁSI OKOK

A kiadatást meg lehet tagadni, ha:

a) a megkeresett Fél nemzeti joga alapján joghatósággal rendelkezik a kiadatással érintett bűncselekményre és a kiadni kért személy ugyanezen bűncselekmény miatt nyomozás alatt áll vagy ellene büntetőeljárás van folyamatban;

b) bármely Fél a bűncselekmény tárgyi súlyának és mindkét Fél érdekeinek figyelembe vétele mellett úgy véli, hogy a kiadatás a kiadni kért személy korára, egészségi állapotára vagy bármely más személyes körülményére figyelemmel humanitárius megfontolásokkal összeegyeztethetetlen lenne.

5. Cikk

SAJÁT ÁLLAMPOLGÁR KIADATÁSA

1. Mindkét Félnek joga van megtagadni a saját állampolgáraira vonatkozó kiadatást.

2. Megtagadás esetén a megkeresett Fél kezdeményezi a büntetőeljárás megindítását nemzeti joga alapján. Ebből a célból a megkereső Fél - a jelen Egyezmény 6. cikkében foglalt központi hatóságain keresztül megküldi az ügy iratait, a kért dokumentumokat és az egyéb tájékoztatást.

3. A megkeresett Fél időben tájékoztatja a megkereső Felet a megtett intézkedésekről és az esetleges bírósági eljárásról.

6. Cikk

KÖZPONTI HATÓSÁGOK

1. A jelen Egyezmény végrehajtása során a Felek által kijelölt központi hatóságok közvetlenül lépnek kapcsolatba egymással.

2. Központi hatóságok a következők:

Magyarország részéről az igazságügyért felelős miniszter;

a Kazah Köztársaság részéről a Kazah Köztársaság Legfőbb Ügyészsége.

3. A központi hatóságokkal kapcsolatos változásokról a Felek diplomáciai úton értesítik egymást.

7. Cikk

A KIADATÁSI KÉRELEM ÉS A SZÜKSÉGES DOKUMENTUMOK

1. A kiadatási kérelmet a központi hatóságokon keresztül írásban kell benyújtani. A kérelem tartalmazza:

a) a megkereső hatóság nevét;

b) a kiadni kért személy családi- és utónevét, születési idejét, nemét, állampolgárságát, személyi azonosító iratainak adatait és bármely más olyan információt, amely segíthet meghatározni a személy személyazonosságát és lehetséges tartózkodási helyét, valamint - ha lehetséges - a személy leírását, fényképét és a személy ujjlenyomatait;

c) az ügy leírását, a kiadatással érintett bűncselekmény helyét és idejét;

d) a büntető joghatóság megállapítására, a bűncselekmény meghatározására, valamint a bűncselekményre kiszabható büntetésre vonatkozó releváns jogszabályi rendelkezések szövegét;

e) a bűncselekmény, valamint az ítélet végrehajtásának elévülési idejére vonatkozó releváns jogszabályi rendelkezések szövegét;

f) olyan bűncselekmény esetében, melyet a megkereső Fél területén kívül követtek el, a joghatóság megalapozására vonatkozó jogszabályi rendelkezést.

2. A jelen cikk 1. bekezdésében felsorolt követelményeken kívül csatolandó:

a) az elfogatóparancs egy példánya, ha a kiadatási kérelmet büntetőeljárás lefolytatása céljából terjesztik elő;

b) a bírósági határozat egy példánya, valamint a már letöltött büntetési idő ismertetése, amennyiben a személy kiadatását a kiszabott büntetés végrehajtása céljából kérik.

3. A jelen Egyezmény alkalmazásában egy dokumentum akkor minősül hitelesítettnek, ha azt a megkereső Fél valamely bírája vagy illetékes hivatalnoka aláírta, és a megkereső Fél központi hatósága hivatalos pecsétjével ellátta. Minden megküldött irathoz mellékelni kell azok fordítását a megkeresett Fél nyelvén vagy angol nyelven.

8. Cikk

KIEGÉSZÍTŐ ADATOK

1. Ha a megkeresett Fél úgy véli, hogy a kiadatási kérelem alátámasztására megküldött adatok nem elegendőek a jelen Egyezmény alapján előterjesztett kiadatási kérelemről szóló döntés meghozatalához, akkor kiegészítő adatokat kérhet. Ezen adatokat a kérés megérkezésétől számított harminc (30) napon belül kell megküldeni.

2. Ha a kiadni kért személy letartóztatásban van, és a megkeresett Fél a jelen Cikk 1. bekezdésében megszabott határidőn belül nem kapja meg a kért kiegészítő adatokat, akkor a személy szabadlábra helyezhető. Ez esetben a szabadlábra helyezés nem zárja ki, hogy a megkereső Fél újabb kiadatási kérelmet terjesszen elő a személy kiadatása iránt.

3. Ha a kiadni kért személyt a jelen Cikk 2. bekezdése alapján szabadlábra helyezték, a megkeresett Fél két (2) napon belül értesíti erről a megkereső Felet.

9. Cikk

A KIADATÁSI KÉRELEMRŐL HOZOTT DÖNTÉS

1. A megkeresett Fél a kiadatási kérelemről jelen Egyezmény és a nemzeti joga alapján dönt, és a döntésről haladéktalanul tájékoztatja a megkereső Felet.

2. Ha a megkeresett Fél a személy kiadatását részben vagy egészben megtagadja, a megtagadás okait közölnie kell a megkereső Féllel.

10. Cikk

EGYSZERŰSÍTETT KIADATÁS

1. Ha a kiadni kért személy hozzájárul a megkereső Fél részére történő kiadatásához, a kiadatási kérelem a jelen Egyezmény 7. cikkében foglalt dokumentumok előterjesztése nélkül engedélyezhető. A megkeresett Fél ilyen esetben is kérhet kiegészítő információt, ha ezt a kiadatás teljesítéséhez szükségesnek tartja.

2. A keresett személy kiadatáshoz történő hozzájárulása akkor tekinthető érvényesnek, ha azt védő közreműködésével, a megkeresett Fél illetékes hatósága előtt terjeszti elő. A megkeresett Fél köteles tájékoztatni a kiadni kért személyt, hogy hozzájáruló nyilatkozata visszavonhatatlan és hogy jogában áll a formális kiadatási eljárást kérni, amely biztosítja a jelen Egyezmény 11. cikkében foglalt specialitás elvét.

3. A nyilatkozatot igazságügyi okiratba kell foglalni, mely igazolja, hogy az érvényességi feltételek fennállnak.

11. Cikk

A SPECIALITÁS ELVE

A jelen Egyezmény alapján kiadott személy ellen a megkereső Félnél nem lehet eljárást lefolytatni, ítéletet végrehajtani, vagy egyéb személyes szabadság korlátozására irányuló intézkedést hozni olyan bűncselekmény miatt, amelyre kiadatását nem engedélyezték, kivéve ha:

a) a bűncselekményt a kiadatás után követték el;

b) a kiadott személy elhagyja a megkereső Fél területét és oda önként visszatér;

c) a kiadott személy negyvenöt (45) napon belül nem hagyja el a megkereső Fél területét, amikor lehetősége nyílik rá. Ez nem vonatkozik arra az esetre, ha a személy önhibáján kívüli okból nem képes elhagyni a megkereső Fél területét;

d) a megkeresett Fél ehhez hozzájárul. A jelen Egyezmény értelmében ilyen irányú megkeresés esetén a megkeresett Fél beleegyezhet, hogy büntetőeljárást folytassanak le a kiadott személy ellen, vagy ítéletet hajtsanak rajta végre olyan bűncselekmény miatt, amire a kiadatás nem vonatkozott. Ebben az esetben:

I) a megkeresett Fél a jelen Egyezmény 7. cikkének értelmében megkéri a szükséges dokumentumokat és tájékoztatást a megkereső Féltől;

II) az iratok megküldéséig a megkereső Fél nemzeti törvényei alapján őrizetbe veheti a kiadott személyt.

e) a kiadni kért személy beleegyezését adja a kiadatáshoz, és egyidejűleg lemond a specialitás elvének alkalmazásáról.

12. Cikk

KIADATÁS HARMADIK ÁLLAM RÉSZÉRE

Amennyiben a megkeresett Fél előzetesen nem járul hozzá, a megkereső Fél nem adhatja tovább harmadik államnak a kiadott személyt olyan bűncselekmény miatt, melyet az első kiadatás előtt követett el. A megkeresett Fél a hozzájárulás megadása előtt kérheti a jelen Egyezmény 7. cikke szerinti szükséges dokumentumok és tájékoztatás megküldését.

13. Cikk

IDEIGLENES KIADATÁSI LETARTÓZTATÁS

1. Sürgős esetben a megkereső Fél kérheti a kiadni kért személy ideiglenes, a kiadatási kérelem kézhezvételéig tartó letartóztatását.

Az ideiglenes letartóztatásra vonatkozó kérelemben utalni kell a megkereső Fél illetékes hatósága által kibocsátott elfogatóparancsra vagy a jogerős ítéletre és arra, hogy az ideiglenes letartóztatási kérelmet kiadatási kérelem fogja követni. Az ideiglenes letartóztatási kérelem a kiadatási kérelem kézhezvétele előtt gyorsított kommunikációs eszközön keresztül is továbbítható. Az eredeti példányt postai úton vagy a Nemzetközi Bűnügyi Rendőrség Szervezetén (Interpol) keresztül kell eljuttatni a megkeresett Fél központi hatóságához.

2. A megkeresett Fél haladéktalanul tájékoztatja a megkereső Felet az ideiglenes kiadatási letartóztatás iránti kérelemről hozott döntéséről.

3. Az ideiglenes letartóztatást meg kell szüntetni, ha a kiadni kért személy letartóztatásától számított 40 napon belül a megkeresett Fél központi hatósága nem kapja meg a szabályszerű kiadatási kérelmet. A megkereső Fél megfelelően indokolt kérelmére a határidő 20 nappal meghosszabbítható.

4. A kiadni kért személy szabadlábra helyezése a jelen cikk 3. bekezdése alapján nem gátolja meg későbbi kiadatását, ha a megkeresett Fél kézhez kapja a szabályszerű kiadatási kérelmet.

14. Cikk

EGYIDEJŰ KÉRELMEK

1. Ha ugyanazon személy kiadatását a másik Fél továbbá egy vagy több harmadik állam is kéri, akkor a megkeresett Fél saját belátása szerint dönt arról, hogy melyiknek adja át a kért személyt és döntéséről értesíti a megkereső államokat. Egy Kazah Köztársaság által előterjesztett kiadatási kérelem és egy európai uniós tagállam által kibocsátott európai elfogatóparancs közötti ütközés esetén Magyarország dönti el, hogy a személyt melyik államnak adja ki.

2. A döntésnél a megkeresett Fél figyelembe veszi az alábbi körülményeket:

a) azt, hogy a kérelmet hatályos nemzetközi egyezmény alapján terjesztették-e elő;

b) a bűncselekmények súlyát;

c) az egyes bűncselekmények elkövetési idejét és helyét;

d) a kiadni kért személy állampolgárságát és állandó lakóhelyét;

e) a kérelmek előterjesztésének időpontját;

f) annak lehetőségét, hogy a megkereső államokban egymást követően is lefolytathatják-e a büntetőeljárást vagy végrehajthatják-e az ítéletet.

15. Cikk

SZEMÉLYEK ÁTADÁSA

1. A kiadatás végrehajtásához a Felek illetékes hatóságai haladéktalanul megállapodnak a kiadni kért személy átadásának időpontjáról, helyszínéről és az egyéb fontos kérdésekről. A megkeresett Fél tájékoztatja a másik Felet a kiadni kért személy átadását megelőzően letartóztatásban töltött idejéről.

2. A személy kiadására negyven (40) nap áll rendelkezésre attól a naptól kezdve, amikor a megkereső Felet a kiadatás jóváhagyásáról értesítették.

3. Ha a megkereső Fél a jelen Cikk 2. bekezdésben lévő határidőn belül nem veszi át a kiadni kért személyt, a megkeresett Fél azonnal szabadlábra helyezi a személyt, és a megkereső Fél újabb, ugyanazon személyre, ugyanazon cselekményre vonatkozó kiadatási kérelmét elutasíthatja, kivéve, ha a jelen Cikk 4. bekezdése eltérően rendelkezik.

4. Ha a Felek valamelyike önhibáján kívüli körülmény miatt nem adja át, vagy nem veszi át a kiadni kért személyt a határidőn belül, akkor erről a másik Felet haladéktalanul értesíti, és a Felek megállapodnak a kiadatás új határnapjáról.

5. A kiadatás miatt fogságban töltött időt - beleértve a házi őrizetet - be kell számítani a megkereső Fél nemzeti joga szerint az általa kiszabott büntetésbe.

16. Cikk

A HALASZTOTT ÁTADÁS ÉS AZ IDEIGLENES KIADATÁS

1. Ha a kiadni kért személy ellen a megkeresett Fél büntetőeljárást folytat vagy ebben az államban büntetését tölti bűncselekmény miatt, amelyre kiadatását nem engedélyezték, a megkeresett Fél elhalaszthatja a kiadatást a büntetőeljárás befejezéséig vagy a büntetés kitöltéséig. Halasztás esetén a megkeresett Fél azonnal értesíti a megkereső Felet.

2. A megkeresett Fél a megkereső Fél külön kérésére ideiglenesen kiadhatja a kért személyt a megkereső Félnek büntetőeljárás lefolytatása céljából, miután nemzeti joguk szerint megegyeztek az ideiglenes kiadatás időtartamában. Az ideiglenesen átadott személyt a megkereső Fél területén őrizetben kell tartani és a meghatározott időben vissza kell őt szállítani a megkeresett Félhez.

3. Az átadást el lehet halasztani, ha az veszélyeztetné a kiadni kért személy életét, vagy rontana az egészségi állapotán. Ebben az esetben a megkeresett Fél illetékes orvosi hatósága részletes orvosi jelentést állít ki a megkereső Fél részére.

17. Cikk

TÁRGYAK LEFOGLALÁSA ÉS ÁTADÁSA

1. Amennyiben nemzeti joga lehetővé teszi, úgy a megkeresett Fél a megkereső Fél kérelmére lefoglalja a bűncselekmény elkövetéséhez használt vagy a bűncselekmény elkövetése során megszerzett tárgyakat, valamint a területén talált bármely más olyan tárgyat, amely bizonyító erővel rendelkezhet, és ha a kiadatást engedélyezik, akkor a megkereső Fél kérelmére átadja a tárgyakat a megkereső Félnek.

2. Ha a kért személy átadására nem kerül sor a jelen Cikk 1. bekezdése szerinti tárgy a megkereső Fél kérelmére átadható.

3. Egy már folyamatban lévő másik büntetőeljárás lefolytatása céljából a megkeresett Fél a büntetőeljárás befejezéséig elhalaszthatja a jelen Cikk 1. bekezdése szerinti tárgyak átadását, vagy a visszaadás feltételével ideiglenesen átadhatja azokat a megkereső Félnek.

4. A megkeresett Félnek vagy harmadik feleknek a felsorolt tárgyakon fennálló jogait tiszteletben kell tartani. Amennyiben ilyen jogok fennállnak, az eljárás befejezése után a Felek haladéktalanul és költségmentesen visszajuttatják az átadott tárgyakat jogos tulajdonosuknak vagy a megkeresett Félnek.

18. Cikk

ÁTMENŐ SZÁLLÍTÁS

1. Mindkét Fél nemzeti jogával összhangban engedélyezheti, hogy harmadik állam által a másik Félnek kiadott személyt területén átszállítsák.

2. A kérelemnek tartalmaznia kell az átszállítani kívánt személy leírását, állampolgárságát, valamint a bűncselekménnyel kapcsolatos tények rövid összefoglalását. A kérelmet a központi hatóságoknak kell megküldeni, illetve különösen sürgős ügyekben a Nemzetközi Bűnügyi Rendőrség Szervezetéhez (Interpol) kell eljuttatni. A kiadatás engedélyezését tartalmazó okirat másolata a kérelem mellékleteként csatolandó.

3. A megkeresett Fél saját területén az átszállítani kívánt személyt fogva tartja.

4. Az átmenő szállítás engedélyezése nem szükséges, ha az átszállítás légi úton történik és az érintett Fél területén nincs tervezett leszállás. Ha nem tervezett leszállás történik a tranzit Állam területén, az átmenő szállítást kérő Állam haladéktalanul értesíti az átmenő szállítással érintett Felet. A tranzit Állam legfeljebb tizenöt (15) napra őrizetbe veszi a kért személyt a jelen cikk 2. bekezdése szerinti kérelem megérkezéséig.

19. Cikk

KÖLTSÉGEK

1. A kiadatási eljárással kapcsolatos, a megkeresett Félnél felmerült költségeket - a Felek eltérő megállapodásának hiányában - a megkeresett Fél viseli.

2. A kiadott személy, valamint a jelen Egyezmény 17. cikke szerinti tárgyak átadásával, átvételével kapcsolatos szállítási és átszállítási költségeket a megkereső Fél viseli.

20. Cikk

AZ EREDMÉNY KÖZLÉSE

A megkereső Fél haladéktalanul tájékoztatja a másik Felet a kiadott személy elleni bírósági eljárás kimeneteléről, a kiadott személyre kiszabott ítélet végrehajtásáról, illetve a személy harmadik állam részére szóló kiadatásáról.

21. Cikk

NEMZETKÖZI EGYEZMÉNYEKHEZ VALÓ VISZONY

A jelen Egyezmény nem érinti a Felek más nemzetközi egyezmények alapján fennálló jogait és kötelezettségeit.

22. Cikk

SZEMÉLYES ADATOK VÉDELME

1. A jelen Cikk 2. bekezdésének sérelme nélkül, a Felek egymásnak személyes adatokat továbbíthatnak, és a Fél, amelynek az adatokat továbbították, kezelheti ezeket, amennyiben az alábbi célokból szükséges és arányos:

a) a jelen Egyezmény alapján kért kiadatás alapját képező büntetőeljárás lefolytatása vagy bírósági határozat végrehajtása érdekében;

b) más, a jelen bekezdés a) pontjában említett eljárásokhoz vagy bírósági határozatokhoz közvetlenül kapcsolódó jogi és közigazgatási eljárások lefolytatása érdekében;

c) a közbiztonságot fenyegető azonnali és súlyos veszély elhárítása érdekében.

2. A fent említett adatok bármilyen egyéb célból kezelhetőek, amennyiben ahhoz előzetesen az adatot továbbító Fél, vagy az érintett személy hozzájárult. A hozzájárulást az adatot továbbító Fél nemzeti joga szerint kell megadni.

3. A jelen Egyezmény rendelkezéseinek végrehajtása során személyes adatokat továbbító Fél kötelezheti az adatot fogadó Felet, hogy az ilyen adatok kezeléséről adjon tájékoztatást.

4. A jelen Cikk 6. bekezdésének sérelme nélkül, a jelen Egyezmény alapján továbbított adatokat annak a Félnek a nemzeti joga szerint kell kezelni és törölni, amelynek az adatokat továbbították. A fenti korlátozásoktól függetlenül az adatokat törölni kell, amint továbbításuk célja érdekében kezelésük szükségtelenné válik.

5. Az érintett személy jogosult arra, hogy a Felek nemzeti jogszabályaival összhangban

a) tájékoztatást kérjen személyes adatainak kezeléséről;

b) kérelmezze személyes adatainak helyesbítését, törlését vagy zárolását;

c) jogorvoslattal éljen, ha kérelmét nem teljesítik.

6. A személyes vagy más adatokat továbbító Felek további feltételeket szabhatnak meg a továbbított adatok kezelésére vonatkozóan. Amennyiben, a jelen bekezdés alapján további feltételeket állapítottak meg, a Fél, amelynek az adatokat továbbították, köteles ezen feltételek szerint kezelni a továbbított adatokat.

23. Cikk

VITÁK RENDEZÉSE

A jelen Egyezmény értelmezésével vagy végrehajtásával kapcsolatosan felmerülő bármilyen vitát tárgyalások vagy diplomáciai konzultáció útján kell rendezni.

24. Cikk

AZ EGYEZMÉNY HATÁLYBALÉPÉSE, MÓDOSÍTÁSA ÉS FELBONTÁSA

1. Jelen Egyezményt a Felek határozatlan időre kötik. A jelen Egyezmény a diplomáciai úton érkezett azon utolsó írásbeli értesítés kézhezvételétől számított harmincadik (30.) napon lép hatályba, amelyben a Felek a jelen Egyezmény hatálybalépéséhez szükséges belső jogi eljárások lezárulásáról értesítik egymást.

2. Jelen Egyezményt a Felek közös megegyezéssel módosíthatják. A változtatásokat és módosításokat külön jegyzőkönyvbe kell foglalni, mely a jelen Egyezmény szerves részévé válik és a jelen Cikk 1. bekezdése szerint lép hatályba.

3. A jelen Egyezményt a Felek a másik Fél részére diplomáciai úton megküldött írásbeli felmondással bármikor felbonthatják. A felmondás a kézhezvétel napjától számított száznyolcvan (180) nap elteltével lép hatályba.

4. A jelen Egyezmény - a felmondás ellenére - az eljárás befejezéséig alkalmazandó marad azokra a kiadatási eljárásokra nézve, amelyek a hatálya alatt indultak.

FENTIEK HITELÉÜL, a saját nemzeti joguk szerint kellően meghatalmazott alulírottak aláírják a jelen Egyezményt.

KÉSZÜLT Budapesten, 2014. év június hó 3. napján, két eredeti példányban magyar, kazah és angol nyelven, amelyek mindegyike egyaránt hiteles és hatályos. Eltérő értelmezés esetén az angol szöveg az irányadó.

MAGYARORSZÁG RÉSZÉRŐL A KAZAH KÖZTÁRSASÁG RÉSZÉRŐL”

4. § (1) Ez a törvény - a (2) bekezdésben meghatározott kivétellel - a kihirdetését követő napon lép hatályba.

(2) A 2. § és a 3. § az Egyezmény 24. cikk 1. bekezdésében meghatározott időpontban lép hatályba. * 

(3) Az Egyezmény, illetve a 2. § és a 3. § hatálybalépésének naptári napját a külpolitikáért felelős miniszter - annak ismertté válását követően - a Magyar Közlönyben haladéktalanul közzétett közleményével állapítja meg. * 

(4) Az e törvény végrehajtásához szükséges intézkedésekről az igazságügyért felelős miniszter gondoskodik.
