az Európa Tanács terrorizmus megelőzéséről szóló Egyezménye Kiegészítő Jegyzőkönyvének kihirdetéséről * 

1. § Az Országgyűlés e törvénnyel felhatalmazást ad az Európa Tanács terrorizmus megelőzéséről szóló Egyezménye Kiegészítő Jegyzőkönyve (a továbbiakban: Kiegészítő Jegyzőkönyv) kötelező hatályának elismerésére.

2. § Az Országgyűlés a Kiegészítő Jegyzőkönyvet e törvénnyel kihirdeti.

3. § A Kiegészítő Jegyzőkönyv hiteles angol nyelvű szövege és annak hivatalos magyar nyelvű fordítása a következő:

Additional Protocol to the Council of Europe Convention on the Prevention of Terrorism

The member States of the Council of Europe and the other Parties to the Council of Europe Convention on the Prevention of Terrorism (CETS No. 196), signatory to this Protocol,

Considering that the aim of the Council of Europe is to achieve greater unity between its members;

Desiring to further strengthen the efforts to prevent and suppress terrorism in all its forms, both in Europe and globally, while respecting human rights and the rule of law;

Recalling human rights and fundamental freedoms enshrined, in particular, in the Convention for the Protection of Human Rights and Fundamental Freedoms (ETS No. 5) and its protocols, as well as in the International Covenant on Civil and Political Rights;

Expressing their grave concern about the threat posed by persons travelling abroad for the purpose of committing, contributing to or participating in terrorist offences, or the providing or receiving of training for terrorism in the territory of another State;

Having regard in this respect to Resolution 2178 (2014) adopted by the Security Council of the United Nations at its 7272nd meeting on 24 September 2014, in particular paragraphs 4 to 6 thereof;

Considering it desirable to supplement the Council of Europe Convention on the Prevention of Terrorism in certain respects,

Have agreed as follows:

Article 1

Purpose

The purpose of this Protocol is to supplement the provisions of the Council of Europe Convention on the Prevention of Terrorism, opened for signature in Warsaw on 16 May 2005 (hereinafter referred to as “the Convention”) as regards the criminalisation of the acts described in Articles 2 to 6 of this Protocol, thereby enhancing the efforts of Parties in preventing terrorism and its negative effects on the full enjoyment of human rights, in particular the right to life, both by measures to be taken at national level and through international co-operation, with due regard to the existing applicable multilateral or bilateral treaties or agreements between the Parties.

Article 2

Participating in an association or group for the purpose of terrorism

1 For the purpose of this Protocol, “participating in an association or group for the purpose of terrorism” means to participate in the activities of an association or group for the purpose of committing or contributing to the commission of one or more terrorist offences by the association or the group.

2 Each Party shall adopt such measures as may be necessary to establish “participating in an association or group for the purpose of terrorism”, as defined in paragraph 1, when committed unlawfully and intentionally, as a criminal offence under its domestic law.

Article 3

Receiving training for terrorism

1 For the purpose of this Protocol, “receiving training for terrorism” means to receive instruction, including obtaining knowledge or practical skills, from another person in the making or use of explosives, firearms or other weapons or noxious or hazardous substances, or in other specific methods or techniques, for the purpose of carrying out or contributing to the commission of a terrorist offence.

2 Each Party shall adopt such measures as may be necessary to establish “receiving training for terrorism”, as defined in paragraph 1, when committed unlawfully and intentionally, as a criminal offence under its domestic law.

Article 4

Travelling abroad for the purpose of terrorism

1 For the purpose of this Protocol, “travelling abroad for the purpose of terrorism” means travelling to a State, which is not that of the traveller’s nationality or residence, for the purpose of the commission of, contribution to or participation in a terrorist offence, or the providing or receiving of training for terrorism.

2 Each Party shall adopt such measures as may be necessary to establish “travelling abroad for the purpose of terrorism”, as defined in paragraph 1, from its territory or by its nationals, when committed unlawfully and intentionally, as a criminal offence under its domestic law. In doing so, each Party may establish conditions required by and in line with its constitutional principles.

3 Each Party shall also adopt such measures as may be necessary to establish as a criminal offence under, and in accordance with, its domestic law the attempt to commit an offence as set forth in this article.

Article 5

Funding travelling abroad for the purpose of terrorism

1 For the purpose of this Protocol, “funding travelling abroad for the purpose of terrorism” means providing or collecting, by any means, directly or indirectly, funds fully or partially enabling any person to travel abroad for the purpose of terrorism, as defined in Article 4, paragraph 1, of this Protocol, knowing that the funds are fully or partially intended to be used for this purpose.

2 Each Party shall adopt such measures as may be necessary to establish the “funding of travelling abroad for the purpose of terrorism”, as defined in paragraph 1, when committed unlawfully and intentionally, as a criminal offence under its domestic law.

Article 6

Organising or otherwise facilitating travelling abroad for the purpose of terrorism

1 For the purpose of this Protocol, “organising or otherwise facilitating travelling abroad for the purpose of terrorism” means any act of organisation or facilitation that assists any person in travelling abroad for the purpose of terrorism, as defined in Article 4, paragraph 1, of this Protocol, knowing that the assistance thus rendered is for the purpose of terrorism.

2 Each Party shall adopt such measures as may be necessary to establish “organising or otherwise facilitating travelling abroad for the purpose of terrorism”, as defined in paragraph 1, when committed unlawfully and intentionally, as a criminal offence under its domestic law.

Article 7

Exchange of information

1 Without prejudice to Article 3, paragraph 2, sub-paragraph a, of the Convention and in accordance with its domestic law and existing international obligations, each Party shall take such measures as may be necessary in order to strengthen the timely exchange between Parties of any available relevant information concerning persons travelling abroad for the purpose of terrorism, as defined in Article 4. For that purpose, each Party shall designate a point of contact available on a 24-hour, seven-days-a-week basis.

2 A Party may choose to designate an already existing point of contact under paragraph 1.

3 A Party’s point of contact shall have the capacity to carry out communications with the point of contact of another Party on an expedited basis.

Article 8

Conditions and safeguards

1 Each Party shall ensure that the implementation of this Protocol, including the establishment, implementation and application of the criminalisation under Articles 2 to 6, is carried out while respecting human rights obligations, in particular the right to freedom of movement, freedom of expression, freedom of association and freedom of religion, as set forth in, where applicable to that Party, the Convention for the Protection of Human Rights and Fundamental Freedoms, the International Covenant on Civil and Political Rights and other obligations under international law.

2 The establishment, implementation and application of the criminalisation under Articles 2 to 6 of this Protocol should furthermore be subject to the principle of proportionality, with respect to the legitimate aims pursued and to their necessity in a democratic society, and should exclude any form of arbitrariness or discriminatory or racist treatment.

Article 9

Relation between this Protocol and the Convention

The words and expressions used in this Protocol shall be interpreted within the meaning of the Convention. As between the Parties, all the provisions of the Convention shall apply accordingly, with the exception of Article 9.

Article 10

Signature and entry into force

1 This Protocol shall be open for signature by Signatories to the Convention. It shall be subject to ratification, acceptance or approval. A Signatory may not ratify, accept or approve this Protocol unless it has previously ratified, accepted or approved the Convention, or does so simultaneously. Instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe.

2 This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the deposit of the sixth instrument of ratification, acceptance or approval, including at least four member States of the Council of Europe.

3 In respect of any Signatory which subsequently deposits its instrument of ratification, acceptance or approval, this Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of the instrument of ratification, acceptance or approval.

Article 11

Accession to the Protocol

1 After the entry into force of this Protocol, any State, which has acceded to the Convention, may also accede to this Protocol or do so simultaneously.

2 In respect of any State acceding to the Protocol under paragraph 1 above, the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of the deposit of the instrument of accession with the Secretary General of the Council of Europe.

Article 12

Territorial application

1 Any State or the European Union may, at the time of signature or when depositing its instrument of ratification, acceptance, approval or accession, specify the territory or territories to which this Protocol shall apply.

2 Any Party may, at any later time, by declaration addressed to the Secretary General of the Council of Europe, extend the application of this Protocol to any other territory specified in the declaration. In respect of such territory the Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date of receipt of the declaration by the Secretary General.

3 Any declaration made under the two preceding paragraphs may, in respect of any territory specified in such declaration, be withdrawn by a notification addressed to the Secretary General of the Council of Europe. The withdrawal shall become effective on the first day of the month following the expiration of a period of three months after the date of receipt of such notification by the Secretary General.

Article 13

Denunciation

1 Any Party may, at any time, denounce this Protocol by means of a notification addressed to the Secretary General of the Council of Europe.

2 Such denunciation shall become effective on the first day of the month following the expiration of a period of three months after the date of receipt of the notification by the Secretary General of the Council of Europe.

3 Denunciation of the Convention automatically entails denunciation of this Protocol.

Article 14

Notifications

The Secretary General of the Council of Europe shall notify the member States of the Council of Europe, the European Union, the non-member States which have participated in the elaboration of this Protocol as well as any State which has acceded to, or has been invited to accede to, this Protocol of:

a any signature;

b the deposit of any instrument of ratification, acceptance, approval or accession;

c any date of entry into force of this Protocol in accordance with Articles 10 and 11;

d any other act, declaration, notification or communication relating to this Protocol.

In witness whereof the undersigned, being duly authorised thereto, have signed this Protocol.

Done at Riga, this 22nd day of October 2015, in English and in French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe, to the European Union, to the non-member States which have participated in the elaboration of this Protocol, and to any State invited to accede to it.”

Az Európa Tanács terrorizmus megelőzéséről szóló Egyezmény Kiegészítő Jegyzőkönyve

Az Európa Tanács tagállamai és az Európa Tanács terrorizmus megelőzéséről szóló Egyezményében (CETS No. 196) részes egyéb államok, amelyek a jelen Jegyzőkönyvnek aláírói,

figyelembe véve, hogy az Európa Tanács célja a tagjai közötti nagyobb egység elérése;

azzal az óhajjal, hogy tovább fokozzák erőfeszítéseiket a terrorizmus valamennyi formájának a megelőzése és visszaszorítása terén mind Európában, mind globálisan, az emberi jogok és a jogállamiság tiszteletben tartása mellett;

szem előtt tartva különösen az Emberi Jogok és Alapvető Szabadságok Védelméről szóló Egyezményben (ETS No. 5) és kiegészítő jegyzőkönyveiben, illetve a Polgári és Politikai Jogok Nemzetközi Egyezségokmányában foglalt emberi jogokat és az alapvető szabadságokat;

kifejezve komoly aggodalmukat a terrorista bűncselekmények elkövetése, illetve az azokban való közreműködés vagy részvétel céljából külföldre utazók, illetve egy másik állam területén történő terrorista kiképzésben való részvétel vagy az abban való részesítés jelentette fenyegetés miatt;

figyelemmel az Egyesült Nemzetek Szervezete Biztonsági Tanácsának 7272. ülésén, 2014. szeptember 24-én hozott 2178. (2014) számú határozatára, különösen annak 4. és 6. cikkére;

kívánatosnak tartva az Európa Tanács terrorizmus megelőzéséről szóló Egyezménye egyes rendelkezéseinek kiegészítését,

a következőkben állapodtak meg:

1. cikk

Cél

Jelen Jegyzőkönyv célja az Európa Tanács terrorizmus megelőzéséről szóló, Varsóban 2005. május 16-án kelt Egyezménye (a továbbiakban: Egyezmény) rendelkezéseinek kiegészítése a jelen Jegyzőkönyv 2-6. cikkében foglalt cselekmények kriminalizálásával, ezáltal a Szerződő Felek erőfeszítéseinek növelése a terrorizmus és annak negatív hatásai megelőzése, az emberi jogok, különösen az élethez való jog teljes körű gyakorlásának biztosítása érdekében mind nemzeti szinten, mind a nemzetközi együttműködés keretében teendő intézkedések által, figyelemmel a Szerződő Felek között létrejött és hatályos két- vagy többoldalú szerződésekre vagy megállapodásokra.

2. cikk

Terrorcselekmény céljára szolgáló társaságban vagy csoportban való részvétel

(1) Jelen Jegyzőkönyv tekintetében a „terrorcselekmény céljára szolgáló társaságban vagy csoportban való részvétel” alatt kell érteni az olyan társaság vagy csoport tevékenységében való részvételt, amelynek célja egy vagy több terrorcselekmény elkövetése vagy elkövetésében való közreműködés.

(2) Minden Szerződő Fél megteszi a szükséges intézkedéseket, hogy az (1) bekezdésben hivatkozott terrorcselekmény céljára szolgáló társaságban vagy csoportban való részvétel, amennyiben azt jogellenesen és szándékosan követik el, a belső joga szerint bűncselekményként büntetendő legyen.

3. cikk

Terrorista kiképzésében való részvétel

(1) Jelen Jegyzőkönyv tekintetében a „terrorista kiképzésben való részvétel” alatt kell érteni egy másik személy által a robbanóanyagok, a lőfegyverek, más fegyverek, egyéb káros vagy veszélyes anyagok előállítására illetve használatára, továbbá más specifikus módszerekre vagy technikákra vonatkozóan nyújtott oktatásban való részvételt, beleértve a szükséges ismeretek vagy gyakorlati képességek megszerzését, amelynek célja terrorcselekmény elkövetése vagy elkövetésében való közreműködés.

(2) Minden Szerződő Fél megteszi a szükséges intézkedéseket, hogy az (1) bekezdésben hivatkozott terrorista kiképzésben való részvétel, amennyiben azt jogellenesen és szándékosan követik el, a belső joga szerint bűncselekményként büntetendő legyen.

4. cikk

Terrorcselekmény elkövetése céljából történő külföldre utazás

(1) Jelen Jegyzőkönyv tekintetében a „terrorcselekmény elkövetése céljából történő külföldre utazás” alatt az utazó állampolgársága vagy lakóhelye szerinti államtól eltérő államba történő utazást kell érteni, amelynek célja terrorcselekmény elkövetése, illetve elkövetésében való közreműködés, illetve részvétel, vagy terrorista kiképzésben való részvétel vagy részesítés.

(2) Minden Szerződő Fél megteszi a szükséges intézkedéseket, hogy az (1) bekezdésben hivatkozott terrorcselekmény elkövetése céljából történő külföldre utazás, amennyiben azt jogellenesen és szándékosan követik el, a belső joga szerint bűncselekményként legyen büntetendő. Ennek során minden Szerződő Fél meghatározhatja az alkotmányos alapelvei által megkövetelt, illetve azokkal összhangban álló feltételeket.

(3) Minden Szerződő Fél megteszi azokat az intézkedéseket is, amelyek szükségesek ahhoz, hogy az e cikkben meghatározott bűncselekmény elkövetésére irányuló kísérlet is bűncselekményként büntetendő legyen.

5. cikk

Terrorcselekmény elkövetése céljából történő külföldre utazás finanszírozása

(1) Jelen Jegyzőkönyv tekintetében a „terrorcselekmény elkövetése céljából történő külföldre utazás finanszírozása” alatt kell érteni anyagi eszközök közvetlenül vagy közvetetten, bármilyen módon történő szolgáltatását vagy gyűjtését, amely teljes egészében vagy részben lehetővé teszi valamely személy számára, hogy terrorcselekmény elkövetése céljából külföldre utazhasson a jelen Jegyzőkönyv 4. cikk (1) bekezdésében foglaltak szerint, annak tudatában, hogy az anyagi eszközöket teljes egészében vagy részben e célra szánták.

(2) Minden Szerződő Fél megteszi a szükséges intézkedéseket, hogy az (1) bekezdésben hivatkozott terrorcselekmény elkövetése céljából történő külföldre utazás finanszírozása, amennyiben azt jogellenesen és szándékosan követik el, a belső joga szerint bűncselekményként büntetendő legyen.

6. cikk

Terrorcselekmény elkövetése céljából történő külföldre utazás megszervezése vagy egyéb módon való elősegítése

(1) Jelen Jegyzőkönyv tekintetében „terrorcselekmény elkövetése céljából történő külföldre utazás megszervezése vagy egyéb módon való elősegítése” alatt minden olyan, a kiutazás megszervezésére vagy annak egyéb módon történő elősegítésére irányuló tevékenységet érteni kell, amely segítséget nyújt valamely személy terrorizmus céljából történő külföldre utazásához a jelen Jegyzőkönyv 4. cikk (1) bekezdésében foglaltak szerint, annak tudatában, hogy az így nyújtott segítség a terrorizmus célját szolgálja.

(2) Minden Szerződő Fél megteszi a szükséges intézkedéseket, hogy az (1) bekezdésben hivatkozott terrorcselekmény elkövetése céljából történő külföldre utazás megszervezése vagy egyéb módon való elősegítése, amennyiben azt jogellenesen és szándékosan követik el, a belső joga szerint bűncselekményként büntetendő legyen.

7. cikk

Információcsere

(1) Az Egyezmény 3. cikk (2) bekezdésének a) pontjának sérelme nélkül, a Szerződő Felek a nemzeti jogukkal és a vonatkozó nemzetközi kötelezettségeikkel összhangban minden szükséges intézkedést megtesznek annak érdekében, hogy megerősítsék a jelen Jegyzőkönyv 4. cikke szerinti, a terrorizmus céljából külföldre utazó személyekre vonatkozó releváns információk megfelelő időben történő cseréjét. E célból a Szerződő Felek kijelölnek egy, a hét minden napján 24 órában működő kapcsolattartó pontot.

(2) Bármely Szerződő Fél dönthet úgy, hogy az (1) bekezdés szerinti feladatra egy már kapcsolattartó pontként működő szervet jelöl ki.

(3) A Szerződő Fél által kijelölt kapcsolattartó pontnak képesnek kell lennie egy másik Szerződő Fél kapcsolattartó pontjával történő hatékony információcserére.

8. cikk

Feltételek és biztosítékok

(1) Minden Szerződő Fél biztosítja jelen Jegyzőkönyv 2-6. cikkei szerinti büntethetőség megteremtése, bevezetése és alkalmazása során az emberi jogi kötelezettségek, különösen a szabad mozgáshoz való jog, a véleménynyilvánítás szabadsága, az egyesülési és vallásszabadság tiszteletben tartását, amennyiben azok a Szerződő Félre alkalmazandóak, az emberi jogok és alapvető szabadságok védelméről szóló Egyezménnyel és a Polgári és Politikai Jogok Nemzetközi Egyezségokmányával, valamint más nemzetközi jogi kötelezettségekkel összhangban.

(2) A jelen Jegyzőkönyv 2-6. cikkei szerinti büntethetőség megteremtésének, bevezetésének és alkalmazásának meg kell felelnie továbbá az arányosság elvének, figyelemmel egy demokratikus társadalom legitim céljaira és azok szükségességére, továbbá mentesnek kell lennie az önkényesség, a diszkriminatív vagy a rasszista bánásmód bármely formájától.

9. cikk

Az Egyezmény és a Jegyzőkönyv közötti kapcsolat

A jelen Jegyzőkönyvben használt szavakat és kifejezéseket az Egyezménnyel összhangban kell értelmezni. A Szerződő Felek között a 9. cikk kivételével az Egyezmény valamennyi rendelkezése alkalmazandó.

10. cikk

Aláírás és hatálybalépés

(1) Jelen Jegyzőkönyv aláírásra nyitva áll az Egyezményt aláíró államok számára. Jelen Jegyzőkönyvet meg kell erősíteni, el kell fogadni vagy jóvá kell hagyni. Az aláíró nem erősítheti meg, nem fogadhatja el, vagy nem hagyhatja jóvá a jelen Jegyzőkönyvet anélkül, hogy előzetesen vagy egyidejűleg meg nem erősíti, el nem fogadja, vagy jóvá nem hagyja az Egyezményt. A megerősítő, elfogadási vagy jóváhagyási okiratokat az Európa Tanács Főtitkáránál kell letétbe helyezni.

(2) Jelen Jegyzőkönyv az azt követő harmadik hónap eltelte utáni hónap első napján lép hatályba, amikor a hatodik megerősítő, elfogadási vagy jóváhagyási okiratot letétbe helyezték, amelyek közül legalább négy az Európa Tanács tagjától származik.

(3) Jelen Jegyzőkönyv minden olyan aláíró tekintetében, amely a későbbiekben helyezi letétbe a megerősítő, elfogadó vagy jóváhagyási okiratát, az ezen okirat letétbe helyezését követő három hónapos időtartam elteltét követő hónap első napján lép hatályba.

11. cikk

Csatlakozás a Jegyzőkönyvhöz

(1) Jelen Jegyzőkönyv hatálybalépését követően bármely állam csatlakozhat, amely előzőleg csatlakozott vagy egyidejűleg csatlakozik az Egyezményhez.

(2) A jelen Jegyzőkönyvhöz az (1) bekezdés szerint csatlakozó állam tekintetében a Jegyzőkönyv a csatlakozási okiratoknak az Európa Tanács Főtitkáránál történő letétbe helyezésének napjától számított három hónap lejárta utáni hónap első napján lép hatályba.

12. cikk

Területi hatály

(1) A Jegyzőkönyv aláírásakor vagy a megerősítő, elfogadási, jóváhagyási vagy csatlakozási okiratok letétbe helyezésekor bármely állam vagy az Európai Unió meghatározhatja azt a területet vagy területeket, amelyeken jelen Jegyzőkönyvet alkalmazni kell.

(2) Bármely Szerződő Fél bármely későbbi időpontban az Európa Tanács Főtitkárához címzett nyilatkozatában kiterjesztheti jelen Jegyzőkönyv alkalmazását a nyilatkozatban meghatározott más területre. Ezen terület vonatkozásában a Jegyzőkönyv attól a naptól számított három hónapos időtartam lejártát követő hónap első napján lép hatályba, amelyen a Főtitkár átvette nyilatkozatot.

(3) Az előző két bekezdés értelmében tett bármely nyilatkozat az abban megjelölt bármely terület viszonylatában a Főtitkárhoz címzett értesítéssel visszavonható. A visszavonás az attól a naptól számított három hónapos időtartam lejáratát követő hónap első napján lép hatályba, amelyen a Főtitkár ezen értesítést átvette.

13. cikk

Felmondás

(1) Bármely Szerződő Fél bármikor felmondhatja a jelen Jegyzőkönyvet az Európa Tanács Főtitkárához címzett értesítéssel.

(2) Ezen felmondás az értesítésnek az Európa Tanács Főtitkára általi kézhezvételét követő három hónap letelte utáni hónap első napján lép hatályba.

(3) Az Egyezmény felmondása automatikusan maga után vonja a jelen Jegyzőkönyv felmondását.

14. cikk

Értesítés

Az Európa Tanács Főtitkára értesíti az Európa Tanács tagállamait, az Európai Uniót, azon nem tagállamokat, amelyek részt vettek a jelen Jegyzőkönyv kidolgozásában, valamint bármely, a jelen Jegyzőkönyvhöz csatlakozott vagy csatlakozásra meghívott államot:

a. bármely aláírásról;

b. bármilyen megerősítő, elfogadási, jóváhagyási vagy csatlakozási okirat letétbe helyezéséről;

c. a jelen Jegyzőkönyv bármely, 10. vagy 11. cikk szerinti hatálybalépési időpontjáról;

d. bármilyen egyéb, a jelen Jegyzőkönyvvel kapcsolatos intézkedésről, értesítésről vagy közleményről.

A fentiek hiteléül az alulírott, erre megfelelőképpen felhatalmazottak jelen Jegyzőkönyvet aláírták.

Készült Rigában, 2015. október 22. napján, angol és francia nyelven, mindkét nyelvű szöveg egyaránt hiteles; egyetlen példányban, amit az Európa Tanács levéltárában kell elhelyezni. Az Európa Tanács Főtitkára az Európa Tanács valamennyi tagállama, az Európai Unió, valamint minden olyan nem tagállam részére, amely részt vett a jelen Jegyzőkönyv kidolgozásában, és minden, a jelen Jegyzőkönyvhöz történő csatlakozásra felhívott állam számára hitelesített másolatot küld.”

4. § (1) Ez a törvény - a (2) bekezdésben foglalt kivétellel - a kihirdetését követő napon lép hatályba.

(2) A 2. § és a 3. § a Kiegészítő Jegyzőkönyv 10. cikk (3) bekezdésében meghatározott időpontban lép hatályba. * 

(3) A Kiegészítő Jegyzőkönyv, illetve a 2. § és a 3. § hatálybalépésének naptári napját a külpolitikáért felelős miniszter annak ismertté válását követően a Magyar Közlönyben haladéktalanul közzétett közleményével állapítja meg. * 

5. § Az e törvény végrehajtásához szükséges intézkedésekről a rendészetért felelős miniszter gondoskodik.
