2019. évi XLVI. törvény

a Magyarország és a Brazil Szövetségi Köztársaság között létrejött kiadatási egyezmény kihirdetéséről * 

1. § Az Országgyűlés e törvénnyel felhatalmazást ad a Magyarország és a Brazil Szövetségi Köztársaság között létrejött kiadatási egyezmény (a továbbiakban: Egyezmény) kötelező hatályának elismerésére.

2. § Az Országgyűlés az Egyezményt e törvénnyel kihirdeti.

3. § Az Egyezmény hiteles angol és magyar nyelvű szövege a következő:

TREATY BETWEEN HUNGARY AND THE FEDERATIVE REPUBLIC OF BRAZIL ON EXTRADITION

Hungary and the Federative Republic of Brazil, hereinafter referred to as the “Parties”,

Desiring to contribute to effective legal cooperation between the two States with the aim of preventing crime on the basis of mutual respect for sovereignty and equality,

Desiring to improve the cooperation between the two States in the field of criminal cooperation;

Taking into account that the goals can be achieved through a bilateral agreement establishing joint action in matters of extradition,

Have agreed as follows:

Article 1

Obligation to extradite

Each Party shall, in accordance with the provisions of this Treaty, extradite individuals found in its territory who are sought by judicial authorities of the requesting Party with a view to carry out criminal proceedings or to enforce a custodial sentence imposed by a final court judgement.

Article 2

Extraditable offences

(1) Extradition shall be granted in respect of offences punishable under the national laws of both Parties by imprisonment or other deprivation of liberty for a maximum period exceeding (1) one year.

(2) Extradition for the purpose of enforcement of a court judgment shall be granted if at the time of sending the extradition request a period of at least 6 (six) months of the custodial sentence remains to be served by the person sought.

(3) An offence shall also be an extraditable offence if it consists of an attempt to commit, or participation in the commission of an offence.

(4) For the purposes of this Article, an offence shall be an extraditable offence whether or not the laws of the Parties place the offence within the same category of offences or denominate the offence by the same terminology.

(5) When extradition has been granted with respect to an extraditable offence, it may also be granted in respect to any other offence specified in the extradition request that meets all other requirements for extradition except for periods of custodial sentence set forth in Paragraphs 1 and 2 of this Article.

(6) In respect of offences in connection with customs, taxes, duties and exchange, extradition may not be refused on the grounds that the national law of the requested Party does not envisage the tax and customs rules or norms in the sphere of currency regulation, similarly to the national legislation of the requesting Party.

Article 3

Mandatory grounds for refusal

Extradition shall be refused if:

a) the requested Party considers that the extradition could harm its sovereignty, national security, public order or would be contrary to its constitution;

b) the requested Party has reasonable grounds to believe that the person sought might be subjected to punishment or any other act or omission which does not ensure respect for fundamental human rights, including protection from cruel, inhuman, or degrading treatment in the requesting Party;

c) the requested Party has reasonable grounds to believe that the extradition request has been made with the object of persecuting or punishing the person sought for reasons of race, gender, religion, nationality or political opinion, or for supposing that the person’s position may be prejudiced for any of those reasons;

d) criminal proceedings under the national law of the requested Party may not be initiated or a custodial sentence may not be enforced because of the expiry of statute of limitations;

e) there has been a final judgment rendered against the person in the requested Party in respect of the offence for which the person’s extradition is requested;

f) the person sought has been granted asylum by the requested Party;

g) the person sought has received the benefit of pardon or amnesty from the requested Party;

h) extradition was requested for offences under military law which are not offences under ordinary criminal law;

i) the person sought was not criminally punishable on the basis of his or her age, according to the terms of the legislation of the requested Party, at the time the crime was committed;

j) the offence in respect of which extradition is requested is regarded by the requested Party as a political offence or as an offence connected with a political offence.

Offences shall not be considered as political offences if in the course of their perpetration, taking into account all the circumstances, including the purpose, motive, modus operandi and the instrumentalities used or intended to be used, the ordinary criminal law related aspects of the offences outweigh the political ones.

To this end, the following offences shall not be considered as offences of a political nature:

I. terrorist offences or any other offences which are not considered as political offences under any international treaty, which both Parties adhered to;

II. homicide or an offence involving homicide of a foreign Head of State or Head of Government or members of his or her family;

III. genocide, war crimes or crimes against the peace and security of humanity.

Article 4

Optional grounds for refusal

(1) Extradition may be refused if:

a) the offence for which extradition is requested is subject to the jurisdiction of the requested Party in accordance with its national law, and the person sought is under investigation or will be prosecuted by the competent authorities of the requested Party for the same offence;

b) the requested Party, taking into account the gravity of the offence and the interests of both Parties, considers that the extradition would be incompatible with humanitarian considerations, in view of the person’s age, health, or any other personal circumstances;

c) the person sought is a national of the requested Party. If the requested Party does not extradite its nationals, that Party shall, at the request of the requesting Party, submit the case to its competent authority for considering the institution of criminal proceedings. The requesting Party shall be informed of the result of its request;

d) the competent authorities of the requested Party have decided either not to institute or to terminate criminal proceedings in respect of the same offence or offences;

e) the offence for which extradition is requested has been committed outside the territory of the requesting Party and the law of the requested Party does not allow prosecution for the same category of offence when committed outside the latter Party’s territory or does not allow extradition for the offence concerned.

(2) For the purposes of the present Article, nationality shall be determined according to the legislation of the requested Party at the moment of the decision on extradition and provided that nationality has not been acquired for the purpose of impeding extradition.

Article 5

Central Authorities of the Parties

(1) For the purposes of this Treaty, the Central Authorities designated by the Parties, shall communicate directly.

(2) Central Authorities are:

for Hungary – the Ministry of Justice;

for the Federative Republic of Brazil – the Ministry of Justice.

(3) Each Party shall inform the other Party of any change related to the Central Authorities through diplomatic channels.

Article 6

Provisional arrest

(1) In case of urgency, the requesting Party may request the provisional arrest of the person sought, pending receipt of the extradition request. The request for provisional arrest shall contain reference to the arrest warrant of a competent authority of the requesting Party or to the final judgment and indication of the fact that the extradition request will be presented additionally. The request for provisional arrest may be sent by use of electronic means or via the International Criminal Police Organization (Interpol) to the Central Authority of the requested Party.

(2) The requested Party shall immediately inform the requesting Party about its decision on the request for provisional arrest.

(3) The provisional arrest shall be terminated if, within a period of sixty (60) days following the arrest of the person sought, the Central Authority of the requested Party has not received the formal extradition request and the documents mentioned in Article 7. This period may be extended by 20 (twenty) days, at the duly justified request of the requesting Party.

(4) Release of a person according to the Paragraph 3 of this Article shall be without prejudice to the re-arrest and extradition of the person sought if the requested Party subsequently receives the formal extradition request.

Article 7

Request for extradition and supporting documents

(1) A request for extradition and the accompanying documents shall be communicated in writing through the Central

Authorities, and shall include:

a) personal details of the person sought, including his or her first name and family name, date of birth, nationality and, whenever possible, fingerprints, photographs and any other information which will help to establish his or her identity or residence;

b) summary of the facts comprising the offence for which extradition is requested, together with the date and place of its commitment;

c) legal classification of the offence;

d) the text of the relevant legal provisions of the offence, the punishment which could be imposed for that offence and the jurisdiction for conducting the criminal proceedings;

e) text of the relevant legal provisions related to the statute of limitations for the offence or for the execution of the custodial sentence;

f) if the offence for which extradition is requested was committed outside the territory of the requesting Party, extract from the law providing jurisdiction of the requesting Party on this offence.

(2) In addition to the provisions of Paragraph (1) of this Article, the extradition request shall be accompanied by:

a) if the extradition request relates to criminal proceedings, a copy of the arrest warrant;

b) if the extradition request is aimed at the execution of a custodial sentence imposed on the person sought, it should also be accompanied by a copy of the court judgment and a description of the period of the custodial sentence already served.

(3) A request for extradition and the documents in support thereof, as well as documents or other material supplied in response to such a request, shall not require certification or authentication. All submitted documents shall be accompanied by translation into the official language of the requested Party.

(4) The Central Authorities may send and receive the documents referred to in Paragraphs 1 and 2 of this Article by use of electronic means.

Article 8

Supplementary information

(1) If the information submitted by the requesting Party, which accompanies an extradition request, is not sufficient to ensure the decision of the requested Party in accordance with this Treaty, the requested Party may request supplementary information. The requested supplementary information must be submitted within 60 (sixty) days of receipt of the request.

(2) If the person sought is arrested and the requested supplementary information has not been received within the period specified in Paragraph 1 of this Article, the person may be released. Such release shall not prevent the requesting Party to submit a new extradition request.

(3) If the person sought is released from custody pursuant to Paragraph 2 of this Article, the requested Party shall notify the requesting Party about this as soon as possible.

Article 9

Decision on the extradition request

(1) The requested Party shall decide on the extradition request in accordance with the provisions of this Treaty and its national law, and shall promptly inform about its decision the requesting Party.

(2) If the requested Party denies, completely or partially, the extradition of the person sought, the reasons for refusal shall be communicated to the requesting Party.

Article 10

Simplified extradition

(1) If the person sought irrevocably agrees, by his or her own free will, in writing to extradition after personally being advised by the competent authority of the requested Party of his or her right to formal extradition proceedings, the requested Party may grant extradition without being necessary to submit the documents indicated in Article 7 of this Treaty. However, the requested Party may request any further information it deems necessary to grant the extradition.

(2) The declaration of consent by the person sought shall be valid if made with the assistance of a defence counsel, before a competent judicial authority of the requested Party, which has the obligation to inform the person sought of the right to avail himself or herself of a formal extradition procedure and of the irrevocability of such declaration.

(3) The declaration shall be recorded in a judicial document in which it is acknowledged that the conditions for its validity have been complied with.

Article 11

The rule of specialty

(1) A person who has been extradited shall not be proceeded against, sentenced or detained with a view to the carrying out of a sentence or detention order for any offence committed prior to his or her surrender other than that for which he or she was extradited, nor shall he or she be for any other reason restricted in his or her personal freedom, except in the following cases:

a) when that person, having had an opportunity to leave the territory of the Party to which he or she has been surrendered, has not done so within 45 (forty-five) days of his or her final discharge, or has returned to that territory after leaving it. However, this period does not include the time period during which the aforesaid person fails to leave the requesting Party for reasons beyond his or her control;

b) when the Party which surrendered him or her consents. A request for consent shall be submitted, accompanied by the documents mentioned in Article 7 and a legal record of any statement made by the extradited person in respect of the offence concerned. Consent shall be given when the offence for which it is requested is itself subject to extradition in accordance with the provisions of this Treaty;

c) the person sought renounces the use of the rule of specialty.

(2) When the description of the offence charged is altered in the course of criminal proceedings, extradited person shall only be proceeded against or sentenced in so far as the offence under its new description is shown by its constituent elements to be an offence which would allow extradition.

Article 12

Re-extradition to a third State

The requesting Party may not re-extradite a person to a third State without the prior consent of the requested Party in respect of offences committed prior to the extradition. The requested Party may require the submission of the documents and information referred to in Article 7 of this Treaty to render such consent.

Article 13

Concurrent requests

(1) If the extradition of the same person has been requested by one of the Parties and one or more third States, the requested Party shall decide, at its discretion, to which one of them it will surrender the person sought, and shall notify the requesting States of its decision. In the event of concurrence between a request for extradition from the requesting Party and an arrest warrant presented to Hungary by a Member State of the European Union (European Arrest Warrant) or to Brazil, by a State party of the Mercosur convention on the matter, the Requested Party shall determine to which State the person sought will be surrendered.

(2) The requested Party shall consider the following circumstances to make a decision:

a) severity of the offence;

b) time and place of the commission of the offence;

c) nationality and permanent residence of the person sought;

d) time of submitting the requests;

e) possibility of subsequent criminal proceedings or execution of a custodial sentence related to the person sought in the requesting States.

Article 14

Surrender of the person to be extradited

(1) If the requested Party grants the extradition, the Parties shall promptly agree upon the time, place and any other relevant matter relating to the surrender of the person sought. The requested Party shall inform the requesting Party of the length of time for which the person sought was detained in connection with the extradition.

(2) The time period for surrender of a person is sixty (60) days from the date on which the requesting Party was notified that the extradition was granted.

(3) If the requesting Party fails to take over the person sought within a period specified in Paragraph 2 of this Article, the requested Party shall immediately release the person sought and may reject a new extradition request from the requesting Party referring to the same person and the same offences, unless Paragraph 4 of this Article stipulates otherwise.

(4) If a Party for reasons beyond its control cannot surrender or take over a person whose extradition was granted, the Party concerned shall promptly notify the other Party, and they shall agree on a new term for surrender.

(5) The time period spent in detention for extradition purposes, including house arrest, is deducted from the overall term of custodial sentence awarded in the requesting Party in accordance with its national law.

Article 15

Postponed or temporary surrender

(1) If the person, whose extradition is granted, is being prosecuted or is serving a sentence in the requested Party for committing an offence other than that for which the extradition is granted, the requested Party may postpone his or her surrender until the end of the trial or until the full execution of the sentence.

(2) Surrender may be also postponed when the transfer may endanger the life of the person sought or worsen the state of his or her health. In this case, the requested Party shall provide a detailed medical report issued by a competent medical authority as soon as possible.

(3) In the cases specified in Paragraphs 1 or 2 of this Article the requested Party shall immediately notify the requesting Party on any such postponements and, when the reason of such postponement ceases to exist, that the person is available to be surrendered and that the time period foreseen under Paragraph 2 Article 14 is starting.

(4) At the request of the requesting Party, the requested Party may temporarily extradite the person sought to enable to conclude the criminal proceedings in the requesting Party after agreeing on the time period of the temporary extradition. The person extradited temporarily shall be detained during the period of stay in the territory of the requesting Party and transferred back to the requested Party at an agreed time. The time spent in detention is deducted from the term of execution of the custodial sentence awarded in the requested Party.

Article 16

Seizure and surrender of property

(1) If the requesting Party so requests, the requested Party shall, to the extent permitted by its national law, seize objects obtained or used in connection with the offence and any other property that may be found on its territory which could have evidential value; and surrender these objects to the requesting Party if the extradition is granted.

(2) Objects mentioned in Paragraph 1 of this Article shall be handed over even if extradition, having been granted, cannot be carried out due to the death, disappearance or escape of the person sought.

(3) When the said object is liable to seizure or confiscation in the territory of the requested Party, the latter may, in connection with pending criminal proceedings, postpone its surrender to the requesting Party or hand it over temporarily on the condition that it shall be returned by the requesting Party.

(4) In the process of surrendering the enumerated objects, the property rights of both Parties and third parties shall be duly respected. Should such rights exist, the objects surrendered shall be returned to their respective owners or to the requested Party free of charge after the completion of the criminal proceedings, as soon as possible.

Article 17

Transit

(1) Each Party may, in accordance with its national law, authorize the transit through its territory of persons extradited to the other Party by a third State.

(2) The requesting Party shall send a request containing identity information of the person transited and a brief summary on the circumstances of the offence to the requested Party through the Central Authority, by use of electronic means or, in particularly urgent cases, through the International Criminal Police Organization (Interpol). The transit request shall be accompanied by a copy of the document confirming the extradition of the person and information on the identity of the escort agents in charge of the person transited.

(3) The requested Party shall keep in custody the transited person in its territory according to its national law.

(4) Transit permission is not required if the transit is carried out by air and no landing is scheduled on the territory of the other Party. If an unscheduled landing occurs on the territory of the other Party, that Party may require the request for transit as provided in Paragraph 1 of this Article. Custody of the extradited person is carried out by the competent authorities of the Party of transit.

(5) The request for transit permission and the documents that accompany it shall be translated into the language of the Party granting transit.

Article 18

Costs

The requesting Party shall bear the expenses related to the translation of documents and transportation of the person surrendered. The requested Party shall bear the costs incurred within its territory from the arrest of the person sought until the moment of surrender.

Article 19

Compatibility with international treaties

This Treaty does not affect the rights and obligations of the Parties assumed under any international treaty the Parties are part of and, for Hungary, those assumed as a Member State of the European Union.

Article 20

Data protection

(1) Without prejudice to Paragraph 2 of this Article, personal data may be transmitted by the Parties, and may be processed by the Party to which the data have been transmitted only if it is necessary and proportionate for the purpose of

a) the criminal proceedings or execution of court decisions for which the extradition was granted under this Treaty;

b) for other judicial and administrative proceedings directly related to the proceedings or court decisions mentioned under subparagraph (a);

c) for preventing an immediate and serious threat to public security.

(2) Such data may however be used for any other purpose if prior consent to that effect has been given by either the Party who transferred the data, or by the person subject of the data. The consent shall be given in accordance with the national law of the requested Party.

(3) Personal data shall be understood to be particulars on the personal and factual situation of an identified or identifiable natural person.

(4) Any Party may refuse to transfer personal data obtained as a result of the execution of a request made under this Treaty where such data are protected under its national legislation.

(5) At the request of the Party that transfers personal data as a result of the execution of the provisions of this Treaty, the Party to which the data have been transferred shall give information on the use made with such data.

(6) The personal data subject shall be enabled in accordance with the national legislation of the Parties:

a) to request information regarding the processing of his or her personal data by the competent authorities;

b) to request rectification, erasure or blocking of his or her personal data;

c) to have legal remedy, including judicial remedy, if his or her request is not complied with.

(7) Personal data transferred under this Treaty shall be processed and deleted in line with the national laws of the data-receiving Party.

(8) This Article shall not prejudice the ability of the requested Party to impose additional conditions in a particular case where the particular request for assistance could not be complied with in the absence of such conditions. Where additional conditions have been imposed in accordance with this paragraph, the requested Party may require the requesting Party to give information on the use made of the evidence or information.

(9) Where, following disclosure to the requesting Party, the requested Party becomes aware of circumstances that may cause it to seek an additional condition in a particular case, the requested Party may consult with the requesting Party to determine the extent to which the evidence and information can be protected.

Article 21

Settlement of disputes

Any dispute arising during the application or interpretation of this Treaty shall be settled between the Central Authorities or through diplomatic consultation between the Parties.

Article 22

Final provisions

(1) This Treaty shall enter into force on the 30th (thirtieth) day after the receipt of the last written notification by either Party, through diplomatic channels, about the completion of the domestic procedure necessary to its entry into force.

(2) This Treaty is concluded for an indefinite period.

(3) This Treaty shall apply to all requests for extradition submitted after the date of entry into force of this Treaty. Requests made under this Treaty shall apply to offences committed prior to its entry into force.

(4) This Treaty may be amended with the consent of the Parties. The changes and amendments shall be made in separate protocols that become integral parts of this Treaty and shall enter into force in accordance with Paragraph 1 of this Article.

(5) The force of this Treaty shall cease six (6) months after the date on which one Party receives the respective notification in writing through diplomatic channels about its intention to cease its validation.

(6) In case this Treaty is terminated, it shall remain applicable to extradition procedures initiated during the period of its validity, until the completion of such procedures.

IN WITNESS WHEREOF, the undersigned, being duly authorized, have signed this Treaty.

DONE in Budapest on 9 May, 2019 in two originals each in Hungarian, Portuguese and English languages, all texts being equally authentic.

In case of divergence in the interpretation of this Treaty, the English text shall prevail.

MAGYARORSZÁG ÉS A BRAZIL SZÖVETSÉGI KÖZTÁRSASÁG KÖZÖTT LÉTREJÖTT KIADATÁSI EGYEZMÉNY

Magyarország és a Brazil Szövetségi Köztársaság (a továbbiakban együttesen: „a Felek”),

Attól az óhajtól vezérelve, hogy hatékonyabb jogi együttműködést alakítsanak ki a két állam között a bűncselekmények megelőzése terén a szuverenitás és az egyenlőség kölcsönös tiszteletben tartása alapján;

Attól az óhajtól vezérelve, hogy megerősítsék a két állam közötti kapcsolatokat a bűnügyi együttműködés terén;

Annak tudatában, hogy e cél kétoldalú kiadatási egyezmény keretében érhető el a kiadatási ügyekben történő közös fellépés útján;

Az alábbiakban állapodtak meg:

1. cikk

KIADATÁSI KÖTELEZETTSÉG

A jelen Egyezmény rendelkezéseivel összhangban mindkét Fél kiadja a területén tartózkodó azon személyeket, akiket a másik Fél igazságügyi hatóságai büntetőeljárás lefolytatása vagy bíróság által kiszabott jogerős ítéletben szereplő szabadságelvonás végrehajtása céljából keresnek.

2. cikk

KIADATÁSI BŰNCSELEKMÉNYEK

(1) Kiadatásnak olyan bűncselekmény esetében van helye, amely mindkét Fél joga alapján egy (1) évet meghaladó szabadságvesztés büntetéssel vagy más szabadságelvonással büntetendő.

(2) Ha a kiadatási kérelem célja szabadságelvonással járó bírósági ítélet végrehajtása, kiadatásnak akkor van helye, ha a kiadatási kérelem előterjesztésekor a kiadni kért személy szabadságelvonásának végrehajtásából legalább hat (6) hónap van hátra.

(3) Bűncselekmény elkövetésének kísérlete, vagy a bűncselekmény elkövetésében való részvétel szintén kiadatási bűncselekménynek minősül.

(4) A jelen cikk alkalmazása során egy bűncselekmény attól függetlenül kiadatási bűncselekmény, hogy a Felek joga azonos módon minősíti-e az adott cselekményt, vagy azonos elnevezéssel látja-e el a bűncselekményt.

(5) Ha a kiadatást egy kiadatási bűncselekményre engedélyezték, engedélyezhetik a kérelemben megjelölt más cselekményre is, ha az a jelen cikk (1) és (2) bekezdésében megjelölt szabadságelvonás időtartamait kivéve megfelel a kiadatáshoz szükséges minden egyéb feltételnek.

(6) A vámmal, adóval és devizaszabályozással kapcsolatos jogszabályok megsértése esetében a kiadatás nem tagadható meg azon az alapon, hogy a megkeresett Fél nemzeti joga a valutaszabályozás terén nem irányoz elő a megkereső Fél nemzeti jogához hasonló adó vagy vám szabályokat.

3. cikk

KÖTELEZŐ MEGTAGADÁSI OKOK

A kiadatást meg kell tagadni, ha:

a) a megkeresett Fél úgy véli, hogy a kiadatás sértené a szuverenitását, nemzetbiztonságát, közrendjét, illetve a kiadatás a megkeresett Fél alkotmányába ütközne;

b) a megkeresett Fél alapos okkal feltételezi, hogy a kiadni kért személy olyan büntetésnek, más cselekménynek vagy mulasztásnak lenne kitéve a megkereső Félnél, amely nem tartja tiszteletben az alapvető emberi jogokat, beleértve a kegyetlen, embertelen vagy megalázó bánásmód elleni védelmet;

c) a megkeresett Fél alapos okkal feltételezi, hogy a megkeresést azért terjesztették elő, hogy a kiadni kért személy ellen a faji hovatartozása, neme, vallása, nemzetisége vagy politikai meggyőződése miatt folytassanak le büntetőeljárást vagy szabjanak ki büntetést, illetve a kiadni kért személy az említett okok miatt hátrányos helyzetbe kerülhet;

d) a megkeresett Fél nemzeti joga szerint elévülés miatt büntetőeljárás már nem folytatható vagy a szabadságelvonást már nem lehet végrehajtani;

e) a megkeresett Fél illetékes hatóságai a kiadni kért személlyel szemben már jogerős ítéletet hoztak a kiadatási kérelem tárgyát képező bűncselekmény miatt;

f) a megkeresett Fél menedékjogot biztosít a kiadni kért személynek;

g) a kiadni kért személyt a megkeresett Fél egyéni vagy közkegyelemben részesítette;

h) a kiadatást olyan katonai bűncselekményre kérték, amely nem köztörvényes bűncselekmény;

i) a kiadni kért személy a bűncselekmény elkövetésének időpontjában életkora miatt nem volt büntethető a megkeresett Fél joga szerint;

j) a kiadatási kérelem tárgyát képező bűncselekményt a megkeresett Fél politikai bűncselekménynek vagy azzal kapcsolatos bűncselekménynek tekinti.

A cselekmény nem tekinthető politikai bűncselekménynek, ha annak elkövetésénél – figyelemmel az összes körülményre, így a bűncselekmény által elérni kívánt célra, a bűncselekmény indítékára, az elkövetés módjára, a felhasznált vagy kilátásba helyezett eszközökre – a bűncselekmény köztörvényi jellege túlnyomó a politikaihoz képest.

Ennek értelmében nem tekinthetők politikai bűncselekménynek:

I. olyan terrorcselekmények vagy más bűncselekmények, melyek nem minősülnek politikai bűncselekménynek bármely olyan nemzetközi szerződés szerint, melynek mindkét Fél részese.

II. bármely Fél államfője, kormányának tagja vagy ezek családtagja ellen elkövetett emberölés vagy emberölést magában foglaló bűncselekmény;

III. népirtás, háborús bűncselekmények vagy az emberiség békéje és biztonsága elleni bűncselekmények.

4. cikk

MÉRLEGELHETŐ MEGTAGADÁSI OKOK

(1) A kiadatást meg lehet tagadni, ha:

a) a megkeresett Fél a nemzeti joga alapján joghatósággal rendelkezik a kiadatással érintett bűncselekményre, és a kiadni kért személy ugyanezen bűncselekmény miatt nyomozás alatt áll vagy ellene a megkeresett Fél illetékes hatóságai büntetőeljárást folytatnak;

b) a megkeresett Fél a bűncselekmény tárgyi súlyának és mindkét Fél érdekeinek figyelembe vétele mellett úgy véli, hogy a kiadatás a kiadni kért személy korára, egészségi állapotára vagy bármely más személyes körülményére figyelemmel humanitárius megfontolásokkal összeegyeztethetetlen lenne;

c) a kiadni kért személy a megkeresett Fél állampolgára. Ha a megkeresett Fél nem adja ki saját állampolgárát, ez a Fél a megkereső Fél kérelmére megküldi az ügyet az illetékes hatóságaihoz a büntetőeljárás megindításának megfontolása érdekében;

d) a megkeresett Fél illetékes hatóságai olyan döntést hoztak, hogy ugyanazon bűncselekmény vagy bűncselekmények miatt nem indítanak büntetőeljárást, vagy a büntetőeljárást megszüntették;

e) a kiadatási kérelemben szereplő bűncselekményt a megkereső Fél területén kívül követték el, és a megkeresett Fél joga nem engedi a büntetőeljárás megindítását ugyanezen bűncselekmény kategória miatt, ha azt az utóbbi Fél területén kívül követik el, vagy nem engedi a kiadatást a megjelölt bűncselekmény miatt;

(2) Jelen cikk alkalmazása során az állampolgárságot a megkeresett Félnek a kiadatásról hozott döntés időpontjában hatályos jogszabályai alapján kell meghatározni, kizárva azt az esetet, ha az állampolgárság megszerzésének célja a kiadatás megakadályozása volt.

5. cikk

A FELEK KÖZPONTI HATÓSÁGAI

(1) A jelen Egyezmény végrehajtása során a Felek által kijelölt központi hatóságok közvetlenül lépnek kapcsolatba egymással.

(2) Központi hatóságok a következők:

Magyarország részéről az Igazságügyi Minisztérium;

a Brazil Szövetségi Köztársaság részéről az Igazságügyi Minisztérium.

(3) A központi hatóságokkal kapcsolatos változásokról a Felek diplomáciai úton értesítik egymást.

6. cikk

IDEIGLENES KIADATÁSI LETARTÓZTATÁS

(1) Sürgős esetben a megkereső Fél kérheti a kiadni kért személy ideiglenes, a kiadatási kérelem kézhezvételéig tartó letartóztatását. Az ideiglenes letartóztatásra vonatkozó kérelemben utalni kell a megkereső Fél illetékes hatósága által kibocsátott elfogatóparancsra vagy a jogerős ítéletre és arra, hogy az ideiglenes letartóztatási kérelmet kiadatási kérelem fogja követni. Az ideiglenes letartóztatás iránti kérelem elektronikus úton vagy a Nemzetközi Bűnügyi Rendőrség Szervezetén (Interpol) keresztül is megküldhető a megkeresett Fél központi hatóságához.

(2) A megkeresett Fél haladéktalanul tájékoztatja a megkereső Felet az ideiglenes kiadatási letartóztatás iránti kérelemről hozott döntéséről.

(3) Az ideiglenes letartóztatást meg kell szüntetni, ha a kiadni kért személy letartóztatásától számított hatvan (60) napon belül a megkeresett Fél központi hatósága nem kapja meg a szabályszerű kiadatási kérelmet és a 7. cikkben említett dokumentumokat. A megkereső Fél megfelelően indokolt kérelmére a határidő húsz (20) nappal meghosszabbítható.

(4) A kiadni kért személy szabadlábra helyezése a jelen cikk (3) bekezdése alapján nem akadálya a keresett személy későbbi letartóztatásának és kiadatásának, ha a megkeresett Fél később kézhez kapja a szabályszerű kiadatási kérelmet.

7. cikk

A KIADATÁSI KÉRELEM ÉS A SZÜKSÉGES DOKUMENTUMOK

(1) A kiadatási kérelmet és a szükséges dokumentumokat írásban terjesztik elő egymásnak a központi hatóságok. A kérelem tartalmazza:

a) a kiadni kért személy személyes adatait, ideértve családi- és utónevét, születési idejét, állampolgárságát, és ha lehetséges, ujjlenyomatait, és fényképét, valamint bármely más olyan információt, amely segít meghatározni a személy személyazonosságát és lehetséges tartózkodási helyét;

b) a kiadatással érintett bűncselekmény összefoglalását, ideértve az elkövetés helyét és idejét;

c) a bűncselekmény jogi minősítését;

d) a bűncselekmény meghatározására, a bűncselekményre kiszabható büntetésre, valamint a büntető joghatóság megállapítására vonatkozó releváns jogszabályi rendelkezések szövegét;

e) a bűncselekmény, valamint a szabadságelvonást kiszabó ítélet végrehajtásának elévülési idejére vonatkozó releváns jogszabályi rendelkezések szövegét;

f) olyan bűncselekmény esetében, melyet a megkereső Fél területén kívül követtek el, a megkereső Fél joghatóságának megalapozására vonatkozó jogszabályi rendelkezést.

(2) A jelen cikk (1) bekezdésében felsorolt követelményeken kívül csatolandó:

a) az elfogatóparancs egy példánya, ha a kiadatási kérelmet büntetőeljárás lefolytatása céljából terjesztik elő;

b) a bírósági határozat egy példánya, valamint a már letöltött szabadságelvonás időtartamának ismertetése, amennyiben a kiadni kért személy kiadatását szabadságelvonás végrehajtása céljából kérik.

(3) A kiadatási kérelmet és a csatolt dokumentumokat, valamint a kérelemre adott válaszként megküldött dokumentumokat és más iratokat nem kell hitelesítéssel vagy felülhitelesítéssel ellátni. Minden megküldött dokumentumot a megkeresett Fél hivatalos nyelvére történő fordítással kell ellátni.

(4) A központi hatóságok e cikk (1) és (2) bekezdésében megjelölt dokumentumokat elektronikus úton is megküldhetik és fogadhatják.

8. cikk

KIEGÉSZÍTŐ ADATOK

(1) Ha a megkeresett Fél úgy véli, hogy a kiadatási kérelem alátámasztására a megkereső Fél által megküldött adatok nem elegendőek a jelen Egyezmény alapján előterjesztett kiadatási kérelemről szóló döntés meghozatalához, akkor kiegészítő információkat kérhet. Ezen adatokat a kérés megérkezésétől számított hatvan (60) napon belül kell megküldeni.

(2) Ha a kiadni kért személy letartóztatásban van, és a megkeresett Fél a jelen cikk (1) bekezdésében megszabott határidőn belül nem kapja meg a kért kiegészítő információkat, akkor a személy szabadlábra helyezhető. Ez esetben a szabadlábra helyezés nem zárja ki, hogy a megkereső Fél újabb kiadatási kérelmet terjesszen elő a személy kiadatása iránt.

(3) Ha a kiadni kért személyt a jelen cikk (2) bekezdése alapján szabadlábra helyezték, a megkeresett Fél haladéktalanul értesíti erről a megkereső Felet.

9. cikk

A KIADATÁSI KÉRELEMRŐL HOZOTT DÖNTÉS

(1) A megkeresett Fél a kiadatási kérelemről jelen Egyezmény és a nemzeti joga alapján dönt, és a döntésről haladéktalanul tájékoztatja a megkereső Felet.

(2) Ha a megkeresett Fél a kiadni kért személy kiadatását részben vagy egészben megtagadja, a megtagadás okait közölnie kell a megkereső Féllel.

10. cikk

EGYSZERŰSÍTETT KIADATÁS

(1) Ha a kiadni kért személy, miután a megkereső Fél illetékes hatóságai személyesen tájékoztatták őt, hogy joga van a szabályszerű kiadatási eljárás lefolytatásához, visszavonhatatlanul, szabad akaratából, írásban hozzájárul a megkereső Fél részére történő kiadatásához, akkor a kiadatási kérelem a jelen Egyezmény 7. cikkében foglalt dokumentumok előterjesztése nélkül engedélyezhető. A megkeresett Fél ilyen esetben is kérhet kiegészítő információt, ha ezt a kiadatás teljesítéséhez szükségesnek tartja.

(2) A kiadni kért személy kiadatáshoz történő hozzájárulása akkor tekinthető érvényesnek, ha azt védő közreműködésével, a megkeresett Fél illetékes hatósága előtt teszi. A megkeresett Fél köteles tájékoztatni a kiadni kért személyt, hogy jogában áll a szabályszerű kiadatási eljárást kérni, valamint arról, hogy a nyilatkozatát nem vonhatja vissza.

(3) A nyilatkozatot igazságügyi okiratba kell foglalni, mely igazolja, hogy az érvényességi feltételek fennállnak.

11. cikk

A SPECIALITÁS ELVE

(1) A kiadott személy ellen nem lehet büntetőeljárást folytatni, őt elítélni vagy fogva tartani szabadságvesztés büntetés vagy szabadságelvonással járó intézkedés végrehajtása céljából olyan bűncselekmény miatt, amelyet az átadása előtt követett el, és különbözik attól, amely miatt kiadták; nem korlátozható továbbá a személyes szabadsága semmilyen más okból, kivéve a következő eseteket:

a) ha a személy, bár lehetősége lett volna elhagyni annak a Félnek a területét, amelynek átadták, azt nem tette meg a végleges szabadon bocsátástól számított 45 napon belül, vagy miután elhagyta, oda visszatért. Ebbe az időszakba ugyanakkor nem számít bele az az időtartam, amíg a személy önhibáján kívüli okokból nem képes a megkereső Fél területének elhagyására.

b) ha az a Fél, amelyik a személyt átadta, ahhoz hozzájárul. A hozzájárulás iránti kérelmet a 7. cikkben felsorolt iratokkal, valamint a kiadott személynek az adott bűncselekményre vonatkozó nyilatkozatát tartalmazó jegyzőkönyvvel együtt kell megküldeni. A hozzájárulást meg kell adni, ha a bűncselekmény, amelyre vonatkozóan kérik, önmagában is kiadatási bűncselekmény jelen Egyezmény rendelkezéseinek értelmében;

c) ha a kiadni kért személy lemond a specialitás elvének alkalmazásáról.

(2) Ha a bűncselekmény minősítése a büntetőeljárás folyamán módosul, a kiadott személy ellen csak annyiban lehet az eljárást lefolytatni és vele szemben büntetést kiszabni, amennyiben az új minősítés szerinti bűncselekmény tekintetében is – alkotó elemeit tekintve – mód volna kiadatásra.

12. cikk

KIADATÁS HARMADIK ÁLLAM RÉSZÉRE

Amennyiben a megkeresett Fél előzetesen nem járul hozzá, a megkereső Fél nem adhatja tovább harmadik államnak a kiadott személyt olyan bűncselekmény miatt, melyet az első kiadatás előtt követett el. A megkeresett Fél a hozzájárulás megadása előtt kérheti a jelen Egyezmény 7. cikke szerinti szükséges dokumentumok és információk megküldését.

13. cikk

EGYIDEJŰ KÉRELMEK

(1) Ha ugyanazon személy kiadatását a másik Fél mellett egy vagy több harmadik állam is kéri, akkor a megkeresett Fél saját belátása szerint dönt arról, hogy melyiknek adja át a kiadni kért személyt, és döntéséről értesíti a megkereső államokat. A megkereső Fél által előterjesztett kiadatási kérelem és egy európai uniós tagállam által kibocsátott, Magyarországnak megküldött elfogatóparancs (európai elfogatóparancs), vagy egy Mercosur tagállam által kibocsátott, Brazíliának megküldött elfogatóparancs közötti ütközés esetén a megkeresett Fél dönti el, hogy a kiadni kért személyt melyik államnak adja át.

(2) A döntésnél a megkeresett Fél figyelembe veszi az alábbi körülményeket:

a) a bűncselekmények tárgyi súlyát;

b) az egyes bűncselekmények elkövetési idejét és helyét;

c) a kiadni kért személy állampolgárságát és állandó lakóhelyét;

d) a kérelmek előterjesztésének időpontját;

e) annak lehetőségét, hogy a megkereső államokban egymást követően is lefolytathatják-e a büntetőeljárást vagy végrehajthatják-e a szabadságelvonást.

14. cikk

A KIADOTT SZEMÉLY ÁTADÁSA

(1) Ha a megkeresett Fél a kiadatást engedélyezi, a Felek illetékes hatóságai haladéktalanul megállapodnak a kiadni kért személy átadásának időpontjáról, helyszínéről és az egyéb fontos kérdésekről. A megkeresett Fél tájékoztatja a másik Felet a kiadatási fogságban töltött időről.

(2) A személy átadására hatvan (60) nap áll rendelkezésre attól a naptól kezdve, amikor a megkereső Felet a kiadatás engedélyezéséről értesítették.

(3) Ha a megkereső Fél a jelen cikk (2) bekezdésben lévő határidőn belül nem veszi át a kiadni kért személyt, a megkeresett Fél azonnal szabadlábra helyezi a személyt, és a megkereső Fél újabb, ugyanazon személyre, ugyanazon cselekményre vonatkozó kiadatási kérelmét elutasíthatja, kivéve a jelen cikk (4) bekezdésében szereplő esetben.

(4) Ha a Felek valamelyike önhibáján kívüli körülmény miatt nem adja át, vagy nem veszi át azt a személyt, akinek a kiadatását engedélyezték, akkor erről a másik Felet haladéktalanul értesíti, és a Felek megállapodnak a kiadatás új határnapjáról.

(5) A kiadatás miatt fogságban töltött időt – beleértve a házi őrizetet – be kell számítani a megkereső Fél nemzeti joga szerint az általa kiszabott szabadságelvonás időtartamába.

15. cikk

HALASZTOTT VAGY IDEIGLENES ÁTADÁS

(1) Ha a személy ellen, akinek kiadatását engedélyezték, a megkeresett Fél büntetőeljárást folytat vagy ebben az államban büntetését tölti olyan bűncselekmény miatt, amely különbözik attól, amelyre a kiadatását engedélyezték, a megkeresett Fél elhalaszthatja az átadást a büntetőeljárás befejezéséig vagy a büntetés letöltéséig.

(2) Az átadást akkor is el lehet halasztani, ha az veszélyeztetné a kiadni kért személy életét, vagy rontana az egészségi állapotán. Ebben az esetben a megkeresett Fél az illetékes orvosi hatósága által kiállított részletes orvosi jelentést küld haladéktalanul a megkereső Fél részére.

(3) E cikk (1) és (2) bekezdésében meghatározott esetekben a megkeresett Fél haladéktalanul értesíti a megkereső Felet az átadás elhalasztásáról, valamint arról – ha a halasztás oka megszűnik – hogy a személy átadható és a 14. cikk (2) bekezdésében meghatározott időtartam mely napon kezdődik.

(4) A megkeresett Fél a megkereső Fél külön kérésére ideiglenesen átadhatja a kiadni kért személyt büntetőeljárás lefolytatása céljából, miután nemzeti joguk szerint megegyeztek az ideiglenes kiadatás időtartamában. Az ideiglenesen átadott személyt a megkereső Fél területén az ott tartózkodás ideje alatt fogva kell tartani, és a meghatározott időben vissza kell őt szállítani a megkeresett Félhez. A fogvatartásban töltött időt a megkeresett Fél által kiszabott szabadságelvonás végrehajtása során be kell számítani.

16. cikk

TÁRGYAK LEFOGLALÁSA ÉS ÁTADÁSA

(1) Amennyiben nemzeti joga lehetővé teszi, úgy a megkeresett Fél a megkereső Fél kérelmére lefoglalja a bűncselekmény elkövetéséhez használt vagy a bűncselekmény elkövetése során megszerzett tárgyakat, valamint a területén talált bármely más olyan tárgyat, amely bizonyító erővel rendelkezhet, és ha a kiadatást engedélyezik, akkor átadja a tárgyakat a megkereső Félnek.

(2) A jelen cikk (1) bekezdése szerinti tárgy átadható akkor is, ha – bár a kiadatást engedélyezték – a kiadni kért személy átadására halál, eltűnés vagy szökés miatt nem kerülhet sor.

(3) Ha a tárgyak lefoglalás vagy elkobzás alá eshetnek a megkeresett Fél területén, ez utóbbi a folyamatban lévő büntetőeljárásra hivatkozva elhalaszthatja a jelen cikk (1) bekezdése szerinti tárgyak átadását, vagy a visszaadás feltételével ideiglenesen átadhatja azokat a megkereső Félnek.

(4) A felsorolt tárgyak átadása során a megkeresett Félnek vagy harmadik feleknek a tárgyakon fennálló jogait tiszteletben kell tartani. Amennyiben ilyen jogok fennállnak, a büntetőeljárás befejezése után a Felek haladéktalanul és költségmentesen visszajuttatják az átadott tárgyakat jogos tulajdonosuknak vagy a megkeresett Félnek.

17. cikk

ÁTMENŐ SZÁLLÍTÁS

(1) Mindkét Fél a nemzeti jogával összhangban engedélyezheti, hogy harmadik állam által a másik Félnek kiadott személyt átszállítsák a területén.

(2) A megkereső Fél által előterjesztett kérelemnek tartalmaznia kell az átszállítandó személy azonosításához szükséges adatokat, valamint a bűncselekménnyel kapcsolatos tények rövid összefoglalását. A kérelmet a központi hatóságok küldik meg egymásnak elektronikus úton, illetve különösen sürgős ügyekben a Nemzetközi Bűnügyi Rendőrség Szervezetén (Interpol) keresztül. A kérelemhez csatolni kell a kiadatás engedélyezését tartalmazó okirat másolatát, valamint az átszállítandó személyt kísérő megbízottak azonosításához szükséges adatokat.

(3) A megkeresett Fél saját területén az átszállítani kívánt személyt a nemzeti jogával összhangban tartja fogva.

(4) Az átmenő szállítás engedélyezése nem szükséges, ha az átszállítás légi úton történik, és az érintett Fél területén nincs tervezett leszállás. Ha nem tervezett leszállás történik a másik Fél területén, ez a Fél kérheti a jelen cikk (1) bekezdése szerinti átszállítási kérelem megküldését. A kiadott személy fogva tartásáról a megkeresett Fél illetékes hatóságai gondoskodnak.

(5) Az átmenő átszállítás iránti kérelmet és az ahhoz mellékletként csatolandó dokumentumokat az átszállítást engedélyező Fél nyelvére le kell fordítani.

18. cikk

KÖLTSÉGEK

A megkereső Fél viseli az iratok fordításával és az átadott személy szállításával kapcsolatos költségeket. A megkeresett Fél viseli a területén a keresett személy elfogásától az átadásáig felmerült költségeket.

19. cikk

NEMZETKÖZI EGYEZMÉNYEKHEZ VALÓ VISZONY

A jelen Egyezmény nem érinti a Felek más nemzetközi egyezmények alapján fennálló jogait és kötelezettségeit, illetve Magyarország részéről az Európai Uniós tagságból eredő jogokat és kötelezettségeket.

20. cikk

SZEMÉLYES ADATOK VÉDELME

(1) A jelen cikk (2) bekezdésének sérelme nélkül, a Felek egymásnak személyes adatokat akkor továbbíthatnak, és az a Fél, amelynek az adatokat továbbították, akkor kezelheti ezeket, amennyiben az adatkezelés az alábbi célokból szükséges és arányos:

a) a jelen Egyezmény alapján engedélyezett kiadatás alapját képező büntetőeljárás lefolytatása vagy bírósági határozat végrehajtása érdekében;

b) egyéb igazságügyi és közigazgatási eljárásban, amely közvetlenül összefügg az a) pontban említett eljárással vagy bírósági határozattal;

c) a közbiztonságot közvetlenül és súlyosan fenyegető veszély elhárítása érdekében.

(2) Az ilyen adat más célból is használható, ha az adatot továbbító Fél vagy az adatalany ahhoz előzetesen hozzájárult.

A hozzájárulást a megkereső Fél nemzeti jogával összhangban kell megadni.

(3) Személyes adat az olyan adat, amely egy azonosított vagy azonosítható természetes személy személyes és ténybeli helyzetére vonatkozik.

(4) Bármelyik Fél jogosult megtagadni a jelen Egyezmény szerinti kérelem végrehajtása során beszerzett személyes adat továbbítását abban az esetben, ha az ilyen adat annak nemzeti joga alapján védelmet élvező minősített adatnak minősül.

(5) A jelen Egyezmény rendelkezéseinek végrehajtása során személyes adatot továbbító Fél kérésére az adatot fogadó Fél tájékoztatást ad az ilyen adatok felhasználásáról.

(6) Az érintett személy jogosult arra, hogy a Felek nemzeti jogszabályaival összhangban

a) tájékoztatást kérjen személyes adatainak az illetékes hatóságok általi kezeléséről;

b) kérelmezze személyes adatainak helyesbítését, törlését vagy zárolását;

c) jogorvoslattal – éljen, ideértve a bírói jogorvoslatot is – éljen, ha kérelmét nem teljesítik.

(7) Jelen Egyezmény alapján átadott személyes adatokat az adatot átvevő Fél nemzeti joga szerint kell kezelni és törölni.

(8) E cikk nem érinti az adatot továbbító Fél jogosultságát arra, hogy egyes esetekben további feltételeket szabjon, ha az adott megkeresést ilyen feltételek hiányában nem lehetne teljesíteni. Amennyiben a jelen bekezdés alapján további feltételeket állapítottak meg, a megkeresett Fél kérheti a megkereső Felet, hogy adjon tájékoztatást a bizonyíték vagy információ felhasználásáról.

(9) Amennyiben a megkereső Fél részére történő adatszolgáltatást követően a megkeresett Félnek olyan körülmények jutnak a tudomására, amelyek következtében egy konkrét esetben további feltételt kell kikötnie, a megkeresett Fél konzultálhat a megkereső Féllel annak meghatározása érdekében, hogy a bizonyíték és az információ védelme milyen mértékben lehetséges.

21. cikk

VITÁK RENDEZÉSE

A jelen Egyezmény értelmezésével vagy alkalmazásával kapcsolatosan felmerülő bármilyen vitát a központi hatóságok vagy diplomáciai konzultáció útján kell rendezni.

22. cikk

ZÁRÓ RENDELKEZÉSEK

(1) A jelen Egyezmény a diplomáciai úton érkezett azon utolsó írásbeli értesítés kézhezvételétől számított harmincadik napon lép hatályba, amelyben a Felek a jelen Egyezmény hatálybalépéséhez szükséges belső jogi eljárások lezárulásáról értesítik egymást.

(2) Jelen Egyezményt határozatlan időre kötik.

(3) Jelen Egyezmény valamennyi olyan kiadatási kérelemre alkalmazandó, amelyet a hatályba lépése után terjesztenek elő. A jelen Egyezmény alapján előterjesztett kérelmek a jelen Egyezmény hatályba lépése előtt elkövetett cselekményekre is alkalmazandók.

(4) Jelen Egyezményt a Felek közös megegyezéssel módosíthatják. A változtatásokat és módosításokat külön jegyzőkönyvbe kell foglalni, mely a jelen Egyezmény szerves részévé válik, és a jelen cikk (1) bekezdése szerint lép hatályba.

(5) Jelen Egyezmény hatálya megszűnik hat (6) hónappal azt az időpontot követően, amikor az egyik Fél megkapja az írásban, diplomáciai úton előterjesztett értesítést a felmondási szándékról.

(4) A jelen Egyezmény – a felmondás ellenére – az eljárás befejezéséig alkalmazandó marad azokra a kiadatási eljárásokra nézve, amelyek a hatálya alatt indultak.

FENTIEK HITELÉÜL, a saját nemzeti joguk szerint kellően meghatalmazott alulírottak aláírják a jelen Egyezményt.

KÉSZÜLT Budapesten, 2019. év május hó 9. napján, két eredeti példányban magyar, portugál és angol nyelven, amelyek mindegyike egyaránt hiteles.

Eltérő értelmezés esetén az angol szöveg az irányadó.

4. § (1) Ez a törvény – a (2) bekezdésben meghatározott kivétellel – a kihirdetését követő napon lép hatályba.

(2) A 2. § és a 3. § az Egyezmény 22. cikk (1) bekezdésében meghatározott időpontban lép hatályba. * 

(3) Az Egyezmény, illetve a 2. § és a 3. § hatálybalépésének naptári napját a külpolitikáért felelős miniszter – annak ismertté válását követően – a Magyar Közlönyben haladéktalanul közzétett közleményével állapítja meg. * 

5. § Az e törvény végrehajtásához szükséges intézkedésekről az igazságügyért felelős miniszter gondoskodik.
