2022. évi XLIX. törvény

a Nemzetközi Migrációs Szervezet Alapokmánya módosításának kihirdetéséről * 

(a Nemzetközi Migrációs Szervezet Alapokmányának a Nemzetközi Migrációs Szervezet Tanácsa 2020. október 28-án elfogadott 1385. számú határozatában foglalt módosítása 2020. október 28-án nemzetközi jogilag hatályba lépett)

1. § Az Országgyűlés a Nemzetközi Migrációs Szervezet Alapokmányának (a továbbiakban: Alapokmány) a Nemzetközi Migrációs Szervezet Tanácsa 2020. október 28-án elfogadott 1385. számú határozatában foglalt módosítását (a továbbiakban: Alapokmány módosító határozat) e törvénnyel kihirdeti.

2. § (1) Az Alapokmány módosító határozatának hivatalos magyar nyelvű fordítását az 1. melléklet tartalmazza.

(2) Az Alapokmány módosító határozatának hiteles angol nyelvű szövegét a 2. melléklet tartalmazza.

3. § Ez a törvény a kihirdetését követő napon lép hatályba.

4. § (1) Az e törvény végrehajtásához szükséges intézkedésekről az idegenrendészetért és menekültügyért felelős miniszter gondoskodik.

(2) Az Alapokmány módosításokkal egységes szerkezetbe foglalt hivatalos magyar nyelvű fordításának és hiteles angol nyelvű szövegének a Nemzeti Jogszabálytárban történő, a hatálybalépést követő haladéktalan közzétételéről az idegenrendészetért és menekültügyért felelős miniszter gondoskodik.

1385. számú HATÁROZAT

A SZERVEZET FELSŐVEZETŐI STRUKTÚRÁJÁNAK MEGERŐSÍTÉSE

A Tanács,

Emlékeztetve a főigazgató két főigazgató-helyettes kinevezésére irányuló és az IOM Alapokmányának ebből fakadó módosítására vonatkozó javaslatára, amelyet eredetileg 2019. május 24-én közöltek valamennyi tagállammal, majd ezt követően a tagállamokkal 2019 októberében és novemberében tartott, három informális konzultáció keretében megvitattak,

Emlékeztetve továbbá a 2019. november 29-i 1383. sz. határozatára, amelyben úgy határozott, hogy a Tanács elnökének vezetésével munkacsoportot hoz létre, amelynek feladata, hogy ajánlásokat fogalmazzon meg a főigazgató javaslatával kapcsolatban, és azokat a Tanács rendkívüli ülésén megfontolás és határozathozatal céljából előterjessze,

Tudomásul véve, hogy az említett munkacsoport hat ülést tartott, és megbeszélései során figyelembe vette a főigazgató által előterjesztett egységes szerkezetbe foglalt, a 2020. január 8-án kelt WG/1383/2020/1 dokumentumban foglaltak javaslatot,

Megjegyezve továbbá, hogy a munkacsoport az 1383. sz. határozatban meghatározott eredeti időkereten túl is kénytelen volt folytatni a munkáját a 2019. évi koronavírus (COVID-19) világjárványból eredő rendkívüli körülmények miatt,

Megfontolva az elnök 2020. június 15-én kelt, 2020. október 2-án tovább módosított levelében foglalt javaslatát, amelyet követően a főigazgatót felkérte, hogy aktualizálja javaslatát,

Megvizsgálva a főigazgatónak a két főigazgató-helyettes kinevezésére és az IOM Alapokmányának ebből következő módosításaira vonatkozó, a 2020. október 12-i C/Sp/4/4 dokumentumban szereplő, kiigazított javaslatát,

Figyelemmel arra, hogy az IOM Alapokmányának ebből következő módosításai megegyeztek a 2019. május 24-én közölt módosításokkal,

Megvizsgálva az 1383. sz. tanácsi határozattal létrehozott munkacsoport című dokumentumot: Az elnök összefoglalója a tevékenységekről és ajánlások a főigazgatói javaslat kiigazítására (C/Sp/4/3, 2020. október 14.),

Azzal a meggyőződéssel, hogy meg kell erősíteni a szervezet felsővezetői struktúráját két főigazgató-helyettesi pozíció - az egyik a műveletekre, a másik pedig az irányításra és a reformra összpontosítva - létrehozásával,

Annak tudatában, hogy a szervezet felsővezetői struktúrájának a két főigazgató-helyettesi pozíció létrehozásával történő megerősítése - amely pozíciók betöltőit ki kell nevezni - az Alapokmány módosítását teszi szükségessé,

Megerősítve, hogy az Alapokmány 25. cikke (1) bekezdésének rendelkezését, amely előírja, hogy az Alapokmány javasolt módosításainak szövegét a főigazgató legalább három hónappal a Tanács általi megvitatás előtt közölje a tagállamok kormányaival, megfelelően tiszteletben tartották,

Megjegyezve, hogy az Alapokmány a C/Sp/4/4 dokumentum IV. mellékletében szereplő, 2020. október 12-i módosításai - az Alapokmány 25. cikkének (2) bekezdése értelmében - ugyanazon a napon lépnek hatályba, mint amikor ezt az állásfoglalást a Tanács kétharmados többséggel elfogadja,

Tudomásul véve, hogy a Tanács eljárási szabályzatát, valamint a Programok és Pénzügyi Állandó Bizottság eljárási szabályzatát a 2020. október 12-i C/Sp/4/4 dokumentum V. és VI. mellékletében foglaltaknak megfelelően módosítani szükséges,

1. Jóváhagyja a főigazgató két főigazgató-helyettes kinevezésére vonatkozó kiigazított javaslatát, valamint az IOM Alapokmányának ebből következő módosításait a C/Sp/4/4 számú, 2020. október 12-i dokumentumban foglaltak szerint;

2. Elfogadja az Alapokmány C/Sp/4/4 dokumentum IV. mellékletében szereplő módosításait, amelyek angol, francia és spanyol nyelvű szövege egyaránt hiteles;

3. Elfogadja továbbá a Tanács eljárási szabályzatának a C/Sp/4/4 dokumentum V. mellékletében foglalt módosításait;

4. Elfogadja továbbá a Programok és Pénzügyi Állandó Bizottság eljárási szabályzatának a C/Sp/4/4 dokumentum VI. mellékletében foglalt módosításait;

5. Felhatalmazza a főigazgatót, hogy a lehető leghamarabb és a meglévő források keretein belül válasszon ki és nevezzen ki két főigazgató-helyettest a jóváhagyott eljárásnak megfelelően.

Az IOM Alapokmány szövegének módosítása

12. cikk

Az Igazgatóság magában foglalja a főigazgatót, a két főigazgató-helyettest és a Tanács által meghatározott körű személyzetet.

13. cikk

1. A főigazgatót és a főigazgató-helyettest a Tanács választja meg kétharmados szavazattöbbséggel, és legfeljebb egy alkalommal újraválasztható. Mandátumuk A főigazgató mandátuma általában öt évre szól, de kivételes esetekben rövidebb időre, amennyiben a Tanács kétharmados szavazattöbbséggel így határoz. A főigazgató a Tanács által jóváhagyott szerződés alapján végzik munkájukat munkáját, amely szerződést a Szervezet nevében a Tanács elnöke ír alá.

15. cikk

1. Kötelessége teljesítése során a főigazgató, a főigazgató-helyettesek és a személyzet nem kérhet és nem fogadhat el utasításokat semmiféle, a Szervezeten kívüli államtól vagy hatóságtól. Tartózkodnak minden olyan tevékenységtől, amely a nemzetközi szervezetben betöltött tisztviselői helyzetükkel ellentétes.

2. Minden tagállam vállalja, hogy tiszteletben tartja a főigazgató, a főigazgató-helyettesek és a személyzet felelősségének kivételes nemzetközi jellegét, és nem próbálják őket befolyásolni feladataik teljesítésében.

16. cikk

A főigazgató részt vehet, illetve a főigazgató-helyettes vagy más, kijelölt képviselője által képviseltetheti magát a Tanács, és bármely kisegítő testület ülésén. A főigazgató vagy a kijelölt képviselője a vitákban részt vehet, szavazati joga azonban nincs.

RESOLUTION No. 1385

STRENGTHENING THE SENIOR LEADERSHIP STRUCTURE OF THE ORGANIZATION

The Council,

Recalling the proposal made by the Director General for the appointment of two Deputy Directors General and consequential amendments to the IOM Constitution, initially communicated to all Member States on 24 May 2019, and subsequently discussed at three informal consultations with Member States held in October and November 2019,

Recalling also its Resolution No. 1383 of 29 November 2019, by which it decided to establish a working group, under the chairmanship of the Chairperson of the Council, to formulate recommendations regarding the proposal of the Director General and to present them for consideration and decision at a special session of the Council,

Noting that said working group held six meetings and, during its discussions, considered the consolidated proposal presented by the Director General, as contained in document WG/1383/2020/1 of 8 January 2020,

Noting also that the working group was compelled to continue its work beyond the original time frame established in Resolution No. 1383 owing to the extraordinary circumstances stemming from the coronavirus disease 2019 (COVID-19) pandemic,

Having considered the Chairperson’S proposal contained in his letter dated 15 June 2020, further amended on 2 October 2020, following which the Director General was requested to update his proposal,

Having examined the Adjusted proposal by the Director General for the appointment of two Deputy Directors General and consequential amendments to the IOM Constitution, contained in document C/Sp/4/4 of 12 October 2020,

Aware that the consequential amendments to the IOM Constitution were identical to those communicated on 24 May 2019,

Having considered the document entitled Working group established by Council Resolution No. 1383: Chairperson’s summary of activities and recommendations for the adjustment of the proposal of the Director General (C/Sp/4/3 of 14 October 2020),

Convinced of the need for strengthening the senior leadership structure of the Organization through the establishment of two Deputy Director General positions, one focusing on operations and one focusing on management and reform,

Mindful that strengthening the senior leadership structure of the Organization by establishing two Deputy Director General positions, whose incumbents shall be appointed, will require amendments to the Constitution,

Confirming that the provision of Article 25, paragraph 1, of the Constitution, which requires that the texts of proposed amendments to the Constitution be communicated by the Director General to the governments of Member States at least three months in advance of their consideration by the Council, has been duly respected,

Noting that the amendments to the Constitution contained in Annex IV of document C/Sp/4/4 of 12 October 2020 will, pursuant to Article 25, paragraph 2, of the Constitution, enter into force on the same date that the present resolution is adopted by a two-thirds majority of the Council,

Acknowledging that consequential changes, contained in Annexes V and VI of document C/Sp/4/4 of 12 October 2020, are necessary to the Rules of Procedure of the Council and the Rules of Procedure for the Standing Committee on Programmes and Finance,

1. Approves the Adjusted proposal by the Director General for the appointment of two Deputy Directors General and consequential amendments to the IOM Constitution as set out in document C/Sp/4/4 of 12 October 2020;

2. Adopts the amendments to the Constitution contained in Annex IV of document C/Sp/4/4, the texts in the English, French and Spanish language being equally authentic;

3. Also adopts the amendments to the Rules of Procedure of the Council contained in Annex V of document C/Sp/4/4;

4. Further adopts the amendments to the Rules of Procedure for the Standing Committee on Programmes and Finance contained in Annex VI of document C/Sp/4/4;

5. Authorizes the Director General to select and appoint, as soon as possible and from within existing resources, two Deputy Directors General in accordance with the approved process.

Annex IV

Text of amendments to the IOM Constitution

Article 12

The Administration shall comprise a Director General, a two Deputy Directors General and such staff as the Council may determine.

Article 13

1. The Director General and the Deputy Director General shall be elected by a two-thirds majority vote of the Council and may be re-elected for one additional term. Their The term of office of the Director General shall normally be five years but may, in exceptional cases, be less if a two-thirds majority of the Council so decides. They The Director General shall serve under a contract approved by the Council, which shall be signed on behalf of the Organization by the Chairman of the Council.

Article 15

1. In the performance of their duties, the Director General, the Deputy Directors General and the staff shall neither seek nor receive instructions from any State or from any authority external to the Organization. They shall refrain from any action which might reflect adversely on their position as international officials.

2. Each Member State undertakes to respect the exclusively international character of the responsibilities of the Director General, the Deputy Directors General and the staff and not to seek to influence them in the discharge of their responsibilities.

The Director General shall be present, or be represented by the a Deputy Director General or another designated official, at all sessions of the Council and any subsidiary bodies. The Director General or the designated representative may participate in the discussions but shall have no vote.

2. Representatives of Member States, the Director General, the Deputy Directors General and the staff of the Administration shall likewise enjoy such privileges and immunities as are necessary for the independent exercise of their functions in connection with the Organization.
